That might be true but then they wouldn't be transexuals anymore since the piece of equipment that makes them TS is gone. Gore Gore, the birth certificate link you provided explicitly states that you need sex reassignment surgery in order to be legally treated as a woman if you were born a man. I don't want to come across as rude, but I think it's stretching the truth a bit to say that any state legally recognizes a person born a man to be a woman while that person still has a penis. I get that you're saying you feel you are "fill in the blank" and that your feelings should be all that matter. But, America is an extremely procedure and rule driven country. We like things categorized and legally defined. So, perhaps just as you ask others to accept your view of how things should be you too can understand where others get confused when you ask us to set aside legal definitions. Perhaps the answer lies in expanding the legal definition of "transgendered" or just expanding the body of law addressing transgendered people in general.
@ Blomkvist. Thanks for the thoughtful, measured reply. I didn't say "any state." I said some. Sorry if I phrased things in a way that mislead you into thinking every state allows birth certificate changes for pre-op trans people. Regardless, yes, indeed, the birth certificate is an issue in terms of surgery. But, as you reflected, legal classification is only one aspect -- this doesn't refute the issue of gender/sex/identity. We're talking about two pretty distinct (though related) issues. Both are important though, as noted. I absolutely understand peoples' confusion, especially as this sort of thing is not generally part of public discourse (and when it is discussed, the conversation is often muddied by transphobia). I also understand the desire for specific classifications (hence the ongoing fight on the part of LGBTQ groups to change the laws so people can legally change gender without surgery). Interestingly, there are articles I have read providing advice as to how to get your gender changed on your birth certificate without having to get reassignment surgery. However, this involves finding a compassionate doctor who will advocate for you, and it also involves pathologizing being trans -- saying you have a disorder. This is rather problematic, obviously, but it's one way of doing it. (The most recent article I read about this was in regards to Vermont). Things are quite rapidly changing though, so these laws in connection to reassignment surgery may change in the very near future. Edited to add a recent change in law in Hawaii.
