As a investor in Platinum Pictures, I feel, I should enlightened adult Dvd talk Members that In "Euro Girls never say no" #1 Jocelyn where's a Anabolic T-Shirt in the scene,somehow Chris the owner of Anabolic Video got the tape and in turn he served letters to Mike stefanio and Me,he ordered us not to sell the movie no more, we will still sell the movie, but after we re edit the movie, which has been done already, I wonder what Nike or calvin Klien would think of all those times Mr Marcus wore there logo in all those Anabolic movies.

I dunno but to me it seems Dion wants to turn us pornfans against Anabolic but I don't care about that because I'm not a fan of either RLD or Anabolic but when did Dion become the spokesperson of Steve Holmes? I think Steve should decide for himself who he wants to work with without having to think which companies that don't like each other. Steve Holmes is a great performer and he should work for as many companies possible and he shoud not be used in this fight between RLD and Anabolic.

That is really pathetic! Anabolic should be worried about simultanious DVD releases, DVD extras, new directors, and making good porn. These are things that Red Light District have mastered. Now they want to sue RLD over something so rediculous? That is really sad! As a longtime fan of Anabolic/Diabolic and RLD I am really disheartened by this.

Ramsey if I understand it correctly Steve Holmes is a part owner in Platinum Pictures. If a company I am part owner in is being sued I don't think I am going to go do some side work for the company that is suing us, especially if my company is being sued for a petty issue such as this.

I got a different take on Dion's post than you did. There are bits and pieces and innuendos on other sites around the web.

My take, Dion was just saying "a letter was served, yes the scene exists, we are re-editing the scene but not stopping distribution." He never hinted at boycotting or not getting Ana/Dia products, it seemed more just a statement of facts.

Regarding Steve, Steve is very capable of talking for himself. I came across to me as more just repeating what Dion heard or something Steve may have said to him. Dion never came across with "I am advising Steve to not work for them anymore" or anything similar.

Steve's involvement in other projects is covered by other posters, and it makes sense in light of those involvements that Steve probably isn't even interested in performing any more for Ana/Dia, especially after the current incident.

Is Chris Alexander behaving like a jilted housewife or what? How petty can you get? I mean, I'm rooting for the wwweirdness of Chico Wang to either save Anabolic/Diabolic's reputation or Utterly Destroy Porn As We Know It (either option is fine with me). But trying to compensate for your lame-ass business policies driving away all your top talent by firing off cease-and-desist orders to the competition not only creates a breach in the talent flow (as PXP and RLD have a lock on so many top-notch porn studs who now own/direct their own lines), so there's a lot of talent that [won't be in Ana/Dia titles anymore, but it also just makes him look like a desperate, defeated man. A hot EuroBabe wearing an Anabolic T-shirt in a movie from another company built by former employees? Sounds a like a "shout-out" to me. Not a red flag in front of a wounded and bleeding bull staggering on its last, crippled legs. Anyway, this really makes me lose a lot of regard for Anabolic, even though some folks there (like Cal, WW and Strong) seem to be working hard to keep the "romance" flowing. I don't know, I just don't know. It's too bad.

Probably an oversight or mistake, not much more.

It seems even sillier on Chris's part to get upset over some free advertising. It might be a different case if the Anabolic T-shirt was used in the movie to make derisory or negative comments about them, but that doesn't seem to be the case. It just happened to be worn.

It never bothers me to see Dior, Calvin Klein, or even the Tommy Hilfiger labels and logos in some of Jules Jordans movies when they appear.

Here's a conspiracy theory to chew on. (Please keep in mind that I have not seen the movie in question and have no idea of when it was produced.)

Considering that many of the RLD/PlatX directors and talent used to do the vast majority of their work for Anabolic and left for greener pastures. Is it possible that this footage was originally shot with the intention of being distributed through Anabolic?

Guess none of us have done our homework!

The thing of it is, I don't think RLD has improved on Ana/Dia's style -- for the most part, their set ups are less interesting. But they have been getting better and better, and they kick the living shit out of the competition in the DVD packaging department: Tons of previews, bonus footage, behind the scenes, and very well laid out design.

Evil Angel still rules supreme -- but they have a more rational production schedule. RLD is kicking something out every week! Which is also where they kill. Believe me, I am pining for the first avalanche of Ana/Dia DVDs that boast the bonus footage, and all the wacky Wanker whackery-jackass hijinx in their full flatulent effect, but it's pretty clear who's taken the lead in Gonzo Land.

For another example of a man named Jocelyn, think of French-Canadian NHL goalie Jocelyn Thibault. As to JYL, I believe the scene in question was made circa January 2003, while he (and the others who left) still worked for A/D, which is why he had the shirt on. I think it was only around March of this year that he stopped wearing it, so to speak.

Basically trademark infringement. You can't use someone's trademark without their consent; especially if you're in the same business. Of course, like in everything there's exception. I believe the trademark laws are similar in Britain too.

The difference between the Harley debacle and this is that Anabolic figured, almost certainly correctly, that Harley would actually follow through with litigation if Anabolic didn't cave. Pulling the tape off the market was going to cost them much less than they would have had to spend in legal fees to defend a suit by Harley, even if they ultimately prevailed.

Here, it seems likely that if Platinum told Anabolic to shove their cease-and-desist letter up their ass, Anabolic wouldn't do anything. Chris would have a meeting with his lawyer, who would explain how much it was going to cost to sue Platinum, and how much of a retainer he'd need, and Chris would say, "uh, let me get back to you on that," and that would be that.

Still, from a risk-avoidance standpoint, it probably makes more sense for Platinum to do the very minor editing needed to mask the Anabolic logo in the scene in question.

I hoped you would answer as I know you are in the legal business.
I would have thought that clothes brands (both names and designs) must appear on the television without permission almost all the time. How legally does one seperate a roving reporter interviewing a member of the public who happens to wear an Anabolic top and a performer who just decides that he will wear that t-shirt on a particular day?

Another interesting point that comes to mind is, where does Anabolic cease to be just a porn company and becomes also a clothes brand. Did not Camel cigarettes get around an advertising ban by claiming their clothes brand should be treated seperately? The reason I ask this is on account of, as you say, it being the same line of business (or not if you would regard the Anabolic logo on a t-shirt, part of a range of branded clothes, as some kind of allied clothes brand in its own right).

When I look at this it does not seem as if PlatX is in any way trying to hoodwink the consumer and feeding off Anabolics reputation; the t-shirt is not being used in any way other than the purpose for which it was designed and sold, that being to cover the torso. I am not conversant with the Harley-Anabolic case but I can see a glaring difference in that whilst Harley could claim they would not wish their product associated with porn this is hardly something Anabolic could reasonably suggest.

As you can probably tell, my legal knowledge on all of this tends toward zero but there seems something fundamentally wrong if you can sue anytime someone wears a recognisable branded garment on film/tv.

I had to laugh when I read this. This is a joke right,lol. What possible offense could Anabolic take from this. It's not like the piece of entertainment in question should be offensive to them. Perhaps they wished they had filmed this kick ass film and that's why they want it pulled. I had forgotten about that part of the scene but now remember him wearing the shirt. However, the more interesting part of the scene for me was Vivienne sucking two cocks and getting her ass fucked every which way but loose. I don't blame Steve if he never wants to shoot for them again nor would I think anything less of Jean Yves LeCastel if he never shot another scene for Anabolic. This seems petty to me and I agree with the post if they had talked shit about Anabolic then yeah sue them but the shirt he was wearing I am sure was an afterthought to the hot woman he had in front of him. Now if he was wearing the shirt as some sort of petty get back at Anabolic I wouldn't like that either but suing to stop distribution of this title seems way over the top. I also agree with the post that perhaps time and money would be better spent trying to get your newer releases out on dvd to a public that likes your product but hates waiting unreasonable amounts of time getting it. I am still a fan of Anabolic but wow this one just seems not worth the trouble. Perhaps Steve can ask Jean about wearing the shirt of the man himself can address if there was any hidden reason for wearing the shirt.

Does Trademark infringement not occur when someone else uses a trademark which is the same as or similar to your registered trademark for the same or similar goods and/or services ? I know little of this but, if that is right, then I think, without more, there be nothing in this, at least on this side of the pond.

Although the multinationals do like to write their letters they (as in the general business community) didn't get far with the web names either when the targets were legitimate businesses.

The metatags seemed to be a different story....you're much more likely to get burned on those. Oh yes...

I figured what the heck and popped the scene in. Sure enough you can see the shirt but the front is barely readable because of the design. The back, however, clearly shows the company name and when Steve and Manuel arrive the fellas make some small talk it's mentioned Jean having just shot his last Assman but other than that nothing about Anabolic and I don't see how anyone could infer anything negative in what was said. The shirt is left on during the scene but you never get another clear shot of the name Anabolic after that initial viewing so where the big deal is I just can't see. However, if blurring the name will keep this great piece of adult entertainment available then I say do it and move on because you're the ones setting the pace now as far as I'm concerned along with Evil Angel, RLD, Zero Tolerance, and DVSX.

Several points...

1. On the surface, this lawsuit sounds frivilous. I don't think Anabolic would suffer any real damages from this alleged infringment. Nominal damages only might be pretty weak.

2. It sounds to me like free advertising. I don't think it would cause any confusion with the public. MAYBE it would if it was displayed prominently on the front cover. Even then, that's a stretch.

Hell, if I owned a studio, I might love it if other high quality porn companies were flashing my name and logo in front of viewers. Can't say I understand why they would want to do that... but hey, why not just enjoy it if they did?

3. If they want to try and win the litigation sweepstakes through intellectual property law, why not spend time going after bootlegers who really do hurt the bottom line. A couple of years ago on eBay I won an auction of an Anabolic disc and it was a well done fake with bogus cover, plastic wrap and everthing.

4. Sir Plum hit the nail on the head by distinguishing between mainstream products that do not want to be associated with or seen as endorsing porn and seeing the name of another porn company in a porn movie.

5. This type of conduct is not desirable to see in the industry. There's enough crazy legal situations to deal without without this kind of balony. This is only going to create bad feelings which are not worth it for such a minor thing. This is a lose-lose situation for both studios and consumers.

6. This threatened lawsuit seems to be creating a backlash with porn consumers against Anabolic who see it as unjustified and sour grapes. Not good!

7. I liked Drew's theory! Very X-Files like! :-)

Well a lot of the times, the clothes you see on TV and movies are donated by the clothing company so they can get publicity. Hell some even pay for the privilege of having their wares publicised. It's just product placement.

As for the second scenario. That's "news" and is one of the many exceptions to trademark violations.

It's the logo that's important; not really the clothes. I have no idea why Platinum X would want to display the anabolic logo in anyway other than as a big fuck you to them or sheer stupid ignorance.

Does it really matter anyway? Anabolic is an afterthought in the porn world they once ruled. All of the leading directors/cocksmen left for greener pastures. I have not seen one good Anablic movie since the guys left, not one.
I'm not the biggest RLD fan either as I feel they stress quantity over quality, but every once in a while they put out a good movie. I like Platinums stuff better right now than RLD's cause they got Brandon putting out some kick ass shit and soon Mason will be putting out her nasty porn too for PXP as well.

Well it wasn't really displayed as such. It was just the t-shirt he had on, and probably no one gave it a thought. Someone above noted that the movie was filmed in January; this is the same shirt Anabolic was giving out at its booth in Vegas. I'm sure he just had one lying around.

Sh#t has got to be rough when you are after someone for advertising for you. Suck it up and ride the mediocre backlash of purchases of Assman videos because someone's memory got jogged by seeing Jocelyn. Man when you've lost it, you've lost it, let it go and breathe deep. I recently posted my dissatisfaction towards the policy makers at Ana/Dia and was stoned by hardcore forum fans. I think I should sit back now and let the actions of these few speak for themselves. Funny my beef was the quality of the material and how fast I could get it, didn't know this crap could happen.

Dear Ramsey,

the reason why Anabolic wants to sue PLATINUM X PICTURES is the movie Euro Girls Never Say No. This movie is produced, directed and owned by Manuel Ferrara and me.

In this movie my friend Jean Yves LeCastel wears an Anabolic T-shirt at the beginning of one scene. Anabolic gave out hundreds or thousands of this T-shirts and people wear it everywhere in their private live and at their jobs. We didn't use the Anabolic logo to advertise our product. Only who already have the movie and watch the scene might realize it.

On request of Anabolic we re-edited the scene and the T-shirt is no longer visible in the copies sold from now on.

We didn't take advantage of their trademark and we caused no damage for Anabolic.

If they still want to sue PLATINUM X PICTURES it will only cause trouble for Manuel Ferrara and me, because we own the product and are responsible for it.

You will understand that I don't want to work for a company who wants to threat me with a legal case.

Here's a theory that I don't think has been explored:

When Red Light first started, many commented on the BLATANT
imitation of Anabolic's box design and logo. Many thought that Anabolic had a good case for a lawsuit there.

However, Anabolic did not pursue an action at that time. It's a good bet that, at this time, it would not be actionable because many in the biz have followed Dion's lead and have adapted the Anabolic style of boxcover.

In retrospect, it was really GENIUS on Dion's part and on Anabolic's part, a case of too little, too late. So perhaps
Anabolic is trying to cash in on a missed opportunity.

So Anabolic is going after PXP in an offhanded attempt to
get at Dion, an "investor" in PXP.

But, I do agree, it is rather a frivilous lawsuit... I
mean, c'mon, it's FREE advertising for Anabolic! If anyone
wants to wear an Evolution Erotica T-shirt in a movie, FEEL FREE!!!

Thanks for explaining things here Steve. It clears a lot of things up. I just hope Platinum X doesn't become the victim of this personal war between Dion and Chris.

I guess those of us who own the first release of the awesome 'Euro Girls Never Say No' dvd, now have a collectors item

As for AnaDiabolic, they should be more concerned about making money from releasing dvd's that porn fans want to see, like 'Un Natural Sex #9' than a bloody T-shirt

Hey, where can I get a Platinum X t-shirt? I'd definitely wear that before my Anabolic one, especially now.

Heck, the only reason I have an Anabolic shirt is because Aurora Snow asked if I wanted one and I could "never say no" to her.

Anyway, I hope this doesn't actually cause you guys any real trouble.
