I ordered a title from www.awtvideo.com this was my first and probably last order with them. I believe the postman has delivered it to my neighbour in error and I would like your advice as to what offences I may have committed by ordering the DVD. The title concerned has an "R18" certificate and is listed on the "British Board of Film Classification" website as being passed with no cuts.
I have known my neighbours since childhood and they are very nosy, occasionally I have had letters correctly addressed to me delivered to them and they have opened the envelopes. I have asked them why they do this and get the response that they don't look first at the name and address on the envelope.
AWT have assured me that they do have my correct address and I should have received the DVD. They will not say whether it was shipped from within the UK or from Europe.
I don't have the courage to ask my neighbour outright whether they have seen any good DVDs lately ! Have I committed an offence by ordering an "R18" DVD via the post, especially if mailed to myself from within the UK ?

You wouldn't have committed an offence as such but the retailer could have if they knowingly sent them through the Royal Mail from the UK. If the DVD has been classified its highly unlikely anyone would face prosecution as far as obscenity charges are concerned. If your neighbour did contact the police or the Royal Mail, you may receive a notice confirming a complaint but I doubt very much it would be taken that much further. The Royal Mail could also be accountable in this instance for mis-delivering the article too. So its fair to say , for the trouble it would cause, its probably not worth investigating further. And I would imagine sorting offices throughout the country are full of porn dvds so I wouldn't worry too much. There is the obscenity charge the police could go with but they would also have to investigate why the neighbour opened the parcel when it was clearly addressed elsewhere. This could result in a seperate charge being brought against them by you. So as you can see, it would all be a slapped wrist and don't do it again scenario. What I would suggest is you open a mailbox account for receiving dvds so you can be sure no neighbour or postman discovers what you're buying if you need it to be discreet. I would suggest asking your neighbour that a dvd bought for a lad's birthday at work has been sent to them by mistake as a cover story? Just a thought anyway.

Let's be clear about this - there is no prospect of an obscenity charge, and only the retailer has committed an offence by selling R18s by mail order, presuming they sent it within the UK, or your neighbours if they have nicked your DVD. R18s should only be sold on licensed sex shop premises. If it is R18 it is a perfectly legal movie, so don't sweat it on that side. It is perfectly legal for you to order, own, watch etc.
Stuff does simply go missing in the post, so why not contact the vendor and ask them to help you out? If they are decent, they will at least go some way towards resolving your problem. Otherwise, chalk one up to experience, I am afraid.

The DVD turned up in the mail today posted from an EEC Country. It would appear Airmail was missed off the envelope hence took nearly 10 days to arrive, unfortunately a few minutes earlier was when I told my neighbour that I had strong suspicions either him or his wife had it, they hurriedly went off in their car.When they returned I grovelled an apology for accusing them etc which was very hard to do but necessary in the circumstances

For future reference:
Gabriel is totally right, only the retailer commits an offense, not the customer.
Also, ordering with recorded delivery gives you the possibility to track your package.

Satellite Guy, glad to hear you got your goods OK. Hope you can now relax and enjoy the movie! Post from Europe can be quite slow. Recently I've also found the usually rapid Global Priority from the States to be extremely variable, from 4 days to well over 2 weeks.
As usual, Jacco offers sound advice. Go for a recorded delivery or a courier if you can afford it, and ask them to leave it with reliable neighbours if possible!

The Royal Mail is still as reliable today as in the heydays of the British Empire. It took a few weeks then to get a letter from one end of the Empire to the other end and it still does now.
Postmaster General: "Waddyamean, the Empire is a lot smaller now? We never got the memo."
