When Ron Jeremy was on the Stern show a few weeks ago, he said that the reason he never got into producing porn was that he was afraid of going to jail, and that all of the big time producers have been arrested and served time at some point. While I have no doubt that this was true during the 70's and 80's, I am wondering if this is still true today. For example have any of the heads of companies like Vivid, Wicked, or Digital Playground ever been charged or convicted of Obscenity or Pandering, or whatever else DA's use to go after producers of porn? Do producers live with a constant fear of being charged with a crime for what they do for a living?

My observation is no but I've got no knowledge to any facts. If you stick to "vanilla" porn, pay your taxes and keep your paperwork in order then you shouldn't have too much to fear. Depends on how far you're willing to push the envelope.

The main problem is that it is not equally risky to all participants. The question becomes is it possible to reduce individual risk? Will one sacrifice ones integrity making those comprimises? Will one accept the possibility that she could be made into "an example". It is like a cavalry charge. Maybe most will survive but surely some will not. Does the possible upside (fame, fortune, and creative expression) balance the downside (time in prison, property seizure, social consequences, and getting shot at by whack jobs)?

Due to the vagueness of obscenity laws and the ridiculous new 2257 requirements the risk level is random. It doesn't matter if you make vanilla porn or chocolate porn. No one can predict who they will go after. Your movie could end up in some small town in the south where the prosecutor thinks IR or buttsex is an abomination. They could prosecute.

I doubt any producers lives in constant fear. But there is no denying that simply being in this industry is a risk.

I think one of the reasons the government is trying so hard to make these new 2257 rules "stick" is because they haven't been able to prosecute the adult industry by claiming something is "obscene". Even Rob Black's case (and his stuff is at the very outer fringes of what most are making these days) got thrown out of court, and who knows if that case will ever come to trial.

So with these new 2257 rules you may have perfectly "vanilla" porn, but if just one of your records is screwed up (even if it's for an obviously "of age" performer - say Nina Hartley or Ron Jeremy) and it's off to jail for your company's owner and probably financial collapse of your studio. (To say nothing of sites that have nothing to do with the making of these movies that still have to keep records on them if they want to show box covers or face the same kind of criminal charges).

So yeah, it's much more safe to be a performer in porn these days than a studio or even the owner of an adult website.
