For example, I am considering joining Annette Schwarz's website, but I am unsure if all the content is legal here. How can I know before I decide? I am not interested in anything illegal.

The CP issue is what I wonder about. With amateur sites and different age limits for different countries, how does it all stay sorted out? My guess is that file sharing/hacking sites will be the first to get burned on this.

I wish anyone convicted of having cp or making it or helping someone make it should be punished with death. Same goes for rapists and child molesters. Those people can not be fixed.

I don't think the issue is so much about CP as it is about making sure you don't end up with it. Am I safe to assume that I can't see a site to join that has girls that are legal in that country, but not in mine?

I'm trying to remember which Country used to consider 16 legal to do porn. I think it's one of the Scandanvian Countries but I just don't remember which. Technically you could have some of their content and although it was made when it was legal. It would be considered CP by todays standard.

I guess a distinction needs to be made between what is illegal and what is considered obscene. Clearly CP and bestiality are illegal. Things like scat, piss, and fisting are not illegal but might be considered by some courts to be obscene. U.S. based porn producers seem to stay away from scat, piss, and fisting videos because I think they fear possible obscenity charges. I don't think the individual who downloads scat, piss, or fisting videos really has to worry about facing criminal charges. I think law enforcement is quite busy enough tracking down the CP producers and customers.
Personally I don't think there would be a problem joining her site even though she might have some of the material I mentioned above. It depends on your comfort level.

The problem is that the law doesn't do that. A person with porn that is legal in the country it came from can be charged with CP in the US. CP is obvious to most people used in terms that we understand. It's not so obvious used in terms of the law. And, when they want to use the letter of the law to go after someone, they will quickly ignore the intent of the law.

Most definitely someone in the U.S. would be prosecuted for CP regardless of the country it came from. However certain sex acts that are common in European porn such as the ones I mentioned earlier might or might not be considered obscene in the U.S. The whole "community standards" argument would come into play which could vary from state to state, even city to city. That is why I don't think law enforcement would really go after someone who joined Annette Schwartz's website. It would be an enormous task for them to try and prosecute people who MIGHT possess something obscene. With CP the "community standards" do not apply. It is simply illegal.

In the USA people have been convicted for possessing CP because the prosecutors thought the girl was under 18. There is a famous case of somebody convicted for possessing porn with Tiny Tove, who was definitely over 18 when she started porn, but the prosecution found some 'expert witness' who claimed she was under 18 and the poor guy (or his crappy lawyer) did not manage to prove she was over 18.
Or this year, the case of the guy who was saved because Lupe Fuentes appeared in court to prove she was over 18. Read and see how other 'experts' for the prosecution claim she was "definitely" under 18.

^ While it is great that Lupe Fuentes helped this guy out, you would think the defense would have gotten the judge to agree that being a Special Agent of Immigration and Customs Enforcement does not qualify one as an expert on human aging.
As to the pediatrician, she should have her license revoked for incompetence. She can't tell someone's age just by looking at them and she knows it. At least, she has no excuse not to know it.

I know of a case in the UK where the first X pediatricians said to the prosecution "No, you can't tell age from just a picture" but the prosecution kept shopping around until they found one willing to do what they wanted. Reason and sanity seems to go out the door as soon as it is about those poor helpless abused children, even if they are not children and not poor, abused or helpless.

Just because you get arrested doesn't mean it is illegal, and just because it's legal doesn't mean they won't arrest you. Much depends on how aggressive the DA or PO want to be. Even in California, not everyone is happy with those that produce porn. Best to be VERY careful even if what you're doing is VERY legal. I've been targeted more than once and I play it VERY legal. Tread lightly.

I have read the federal obscenity laws out of curiosity before and while i am no lawyer it sure seems like a majority of the porn that is out now could easily fall under it. I think it just depends on who is in office.

It is interesting to see the tactics the F.B.I. uses against citizens who produce or distribute porn. They'll pick a venue where the community standards are very conservative and order porn (via the U.S. postal service) to be delivered to the "conservative venue".
They'll edit out the scenes that they choose and present the "sexy evidence" to the jury. Unfortunately, just like those who want the Federal prohibition against marijuana repealed, most folks are afraid to petition their representatives to end the harrassment.

To be clear here Child Porn and Bestiality are illegal here but you will not find that covered under the statutes that most porn is prosecuted under. They are guilty under there own separate laws.
Most porn in the US is prosecuted under the "obscenity" umbrella. Which is not clearly defined. In the US nothing is obscene until a court rules it is, which makes this a very difficult question to answer. In the early 80's, I think, one of the lawyers in the industry put out a list he advised you stay away from unless you want to end up in court. Among them was scat and hardcore sex with bondage or S/M.
Now as to things like the girls appearing underage that is a much more difficult area to address.
What it really comes down to is that if law enforcement has a reason to check your computers,movies, etc is it possible they will find something that they consider obscene, sure that is an individual area thing.
The Lupe Fuentes case is a strange one. The DVD in question was a compilation of scenes made outside this country so while here we have the 2257 regulations to list when each scene was made some countries do not obey that. So what the law had was a movie with a bunch of scenes with a young lady who looks underage even now, with no idea when it was made.
But I do question the prosecutor's conduct in that they had to know Lupe was in the US yet made no effort to contact her to verify their claim. It was up to the defense to do this. Very nice, we do this to protect children, yet the child we think was victimized we are not even going to attempt to locate?

I have to believe that most people know someone that has had the law used against them to serve a different purpose. The fact that they let stuff slide, or haven't gone after someone for what is considered obscene doesn't mean they can't if they so choose. It's amazing how often people are busted for side crimes when the law can't get them for the one they want. So, when you have your pc taken for suspicion of tax evasion, and they find no trace of that, but do find iffy porn, well, you got it. I personally know a person that got busted on federal charges of using the internet to entice underage girls, when all he had done was communicated with a girl that was in his class. IF, and who knows, but IF anything did indeed happen between them, it had nothing to do with the internet. He had one on one contact with her multiple hours of the day. But, they had no proof that he did anything with her, so they used the federal internet charge to go after him. Total misuse of the law. If he did something, he belongs in jail where he is. But not by misusing a law.
So, it's not a bad idea to know what the laws are and that you are on the right side of it. I'm not saying to run around all paranoid, but to just not be stupid.

Seriously though, I've seen some cheap DVD's that have covers suggesting that they are having sex with animals, but I doubt very much if that is the actual content.
