This thread had just about run it’d course. caroline brought up the minimum ages for porn was 15 in Denmark and 16 in NL, untill just a few years ago.

It's got to be legal before the age can go down.

And pushing the envelope seems to be what this board likes to do. I just thought I would push it some.

First of all development of an individual happens generally at a gradual rate over time rather than sudenly and also tends to be very different in people of the same chronological age.

Now my argument will be supported by the criminal justice system and the laws that are on the books that make people in some instances adult even though their chronological age is under 18. First in New York, people age 16-17 are automatically considered an adult in the criminal courts and are treated as an adult by the state...they are automatically considered competent, they are grouped with people over 18, and their punishments are that of an adult. You are considered old enough to make tough decisions, such as confessing under pressure that can affect your entire future, even if your innocent of a crime. The other state is California, as of a 2000 law, people age 14-17 can be tried as an adult even without a Judge giving the ok. However, a person cannot be put into an adult institution until the age of 16. This further would indicate 16 being a good break point, however to be extra safe it will be even stricter then California and New York law by beintg restrictive which I'll go into later.

A person should be developmentally mature before going into the industry. People should be able to exert control over behavior and understand, the good and bad, consequences of thier actions. People who do not understand the business when limited by intellectual immaturity or through judgement flawed by emotional immaturity do need protection through law from the industry. At what age do people have enough understanding of the consequences, of the industry and the sometimes conflicting interest of agents, directors, and studios? At what age is somones development complete, their judgement mature-responsible-, and their character is not developing, or unlikely to change? Well research does not show a dichotomous distinction on a specific age line but more a trending and also major mental differences in people pf the same age.

People should have the ability necessary to protect their own interests. They should be mature enough to have responsibility for their actions. Their behavior should be established and consistent. They need to be able to make decisions, both hypothetical and logical, and think forward to what can happen because of those decisions. They should be able to look from others points of view, understand their own mental state of mind and what their reasonings are. They should be able to extract themsleves from situations that could be detrimental. Ultimately, they need to be able to make difficult decisions even in tough circumstances, if they enter the business for example they can choose to enter the business or not even with pressure of a pimping boyfriend pushing them to do so or a jealous boyfriend holding them back and not say those people forced them to do so, that they could make their own decisions and resist peer pressure. Researsh indicates that most people meet the requirements at the minimum 16 and in many people sooner. However there is concern for people younger thats why an outright ban for under 16 is appropriate.

This leads to what can be done for people age 16-17 that may be ready for the industry but are not chronologically bracketed to do so. This determination would be through competence testing and a counsler interview. A person that wishes to enter the industry at the age of 16-17 should on their own free will and not through any pressure or assitance from someone in the industry. They would go to a county appointed adult business counsler. There they would be given a competence test and counsled about the industry. They would have to pass the test, go through the appointed counselling, then wait 2 weeks and then go back to the counsler for a follow-up meeting where a permit would be issued. These measures would be afforded to protect people, the same people that are not protected by any measure in criminal courts in New York of California even if that person is innocent of a crime.

Conclusion, 16 should be the minimum age with above restrictions, for people 18 or older the current law is good. Unless of course a person is retarded or mentally handicap then even at 18 they should not be allowed to enter the industry.

When George W Bush was governor here in Texas there was a lot of talk about giving teenagers as young as 13 the death penalty. I can’t remember if he was 16 or 17 when he committed the crime. But he did commit a heinous double murder he was given the death penalty, and it took a Supreme Court ruling that stated the person had to be at least 18 when the crime was committed to receive the death penalty.

My point is if we’re going to treat, try, and convict 13 yr olds as adults in the criminal justices system. They are competent enough to have consensual sex and be in porn.

I wouldn’t give them any test. Here in Texas there’s no test to decide if they will be tried as an adult.
