I need to know how much money I should bring to the table. I don't want to do it half assed and I don't want "tube-like" quality movies. PQ said she's using Jay's $12,000 equipment but surely you need more than just good lighting equipment.
I know you need a tech junky to run the site. You need a website designer. Im trying to figure out what type of camera to use and what type of lighting equipment to use. What kind of business papers/permits I need to have and how much do they cost in DC,MD, or VA (Delaware if it's the cheapest). And what else do I need other than locations?
I know where to get all of the talent and how much they run. I'm thinking of building about 6 or 7 sites (maybe a total of 120 scenes, give or take a scene or site or two).
I'm not too worried about California being the only state where it's legally permitted. But if all I have to do is register my businesses there and have a PO Box there then I guess I can do that.
Also, I want to have rapid AIDS tests handy so does anybody know if Health Clinics are open to bringing in multiple tests by random people or do I not have to tell them every negative result?
I have my demographics, I have my audiences, I'm somewhat connected out here with other independent film producers and musicians/artists. I know what I'm bringing to the table and I know how I'm going to expand it and intertwine it with my other business ventures so I know where I want to take this.

^sorry, but I think you're clueless. But, Dave Cummings put together a nice summary a few years back. You should consider starting there. Try searching this site.

$80,000 on the low end (if you keep average scene cost to $500) and $175,000+ if you do it correctly (assuming you are paying typical rates for scenes)...
Good luck...

But how much would 80k get me as far as the bulk in content verses 175k? Like I said, I want a lot of content. Let's face it, if I only have 10 or so movies on my site no one would buy it. It would all get leaked before I know it.
I've read some of Dave's lecture, I read it 6 years ago truth be told. If you're talking about that guy who was giving seminars in Florida for 5k then yeah I've seen that already. But this is a new game verses 6 years ago and I'm only selling DVDs upon request.
Still tho, there's a few questions you didn't answer. I'm not trilly worried about money. This isn't my first investment. And don't think I'm just trolling becuz of the thread about the obvious racism towards us blacks in the mainstream industry.

Are you suggesting he can buy exclusive rights to good content for $1000 each? How can producers shoot it for that?? Does that mean lots of solo content to keep the cost down??

Producers shoot content and sell you the exclusive or non-exclusive rights to that content.

I think pornlaw is dead on with his numbers. The only thing I'll add is that this has to be money that you can afford to lose and that didn't borrow. Otherwise you may very well discover that porn is a great place to lose money in a very short time.

See I heard that you have to have throwaway money so I'm cool with that. I just wish I had some specifics becuz for what I can do with 80k I can probably do with 40k or 50k.
I figure the bulk of the investment is going to go into the equipment and website designer(s) and tech support. The rest of the money will go out to the talent.
You get what you pay for but at the same time you get as much back as you put into it. I'm a very different type of inda-viju-Al. I took what Rick Ross said about Hustlin seriously. To most it was just a fantastic record but to me that shit was a song straight outta tha Bible!

Oh no my man, I'm serious. I know I have what it takes. Believe me when I say that my ideas are in constant rotation now and I've helped set trends. I've already proven to myself that I'm a Suit, a fucking great one too.
Whatchu have to know is that I'm a hustla, but on top of that I have a REAL passion for Art and a real lust for money. I have no bills, I have NO KIDS, I have nothing tying me back, ideas pop into my head every 30 seconds (and if it's not 30 seconds then it's 45 seconds).
I'm into what I'm into to be the next Legend, to be the next Myth. I want powerful people at my funeral, I want people who aren't family and friends to cry and pray for my soul. I want to have some control over the next few generations to come. I want to have a Cult. Long story short, even after my death I still want to impact society. I also want to retire by the time I'm 31 (it's only 8 years).
I'm a business man and a great communicator by nature. I want to be able to put all of my grandkids thru College and Graduate School even if we don't have that type of relationship. You don't realize how big I'm taking this, I'm doing this for Icon Status and a few new toys and houses along the way. On everything I love! I'm not tryna be the corny old rich guy who's in the way of everybody else becuz of greed, it's bigger than that (even tho Greed Is Good!)

Your biggest costs will be shooting the scenes...
120 x $500 per scene ($500 for the women and basically male talent for free) = $60,000.00
The other $15,000.00 will be for a mix of equipment costs, location costs, website costs ect...
If you want talent that is experienced and can get the job done in a way that someone may actually want to pay for your content then...
120 x $1500 per scene ($1000 for the woman and $500 for the male) = $180,000.00 for just the costs of the scenes...
I would add in another $20,000 to $30,000 for other costs...
If you want to try your hand at porn... I would suggest a Clips 4 Sale store.
You can do that for relatively cheap and you will see very quickly if your content will sell to the masses.

Just wondering, if you have seen this thread with Porno Dan and craven moorehead on a never released completed scene with Tory Lane that is in limbo waiting for someone to buy the rights to it.
Adult DVD Talk Forum Post
Would this be something you would consider to purchase and put on your site or would you know how to go about buying this scene?
Sorry if i am not making sense, I just don't understand how not releasing this scene with Tory is good business sense, and this topic you have here is about a business thx

Possibly. Tory Lane brings in customers.
But basically if I were to buy a scene I would have 100% of the publishing or does that stuff get negotiated? If so how does that work when I'm giving you multiple sites for the price of 1?

I may not be able to help with actual start up costs but as someone who pays for a whole bunch on different sites over the course of a year i though i'd give my thoughts.
The first is, at launc i dont think you need that much content. The more the better but the important thing is really regularity of updates. If you have 7 sites, are you planning on 7 updates a week? If so consider that that is 28 videos in month one, to add to the videos on the site at launch.
I'd suggest having at least 2 motnhs worth in back up so you know you wont have to miss an update. 28 videos a month also means you will probably have to be shooting most days a week. Do you plan on being behind the camera or just a financial backer? Seems you are going to need at least one or two directors on the books and at least the same number of male talent.
That gets to point three. Part of your cost will depend on what the sites focus will be. Blow Jobs and handjobs must be relativly cheap compared to blowbangs and dps.
anyways food for thought.

I gotta tell ya, you would be better off trying your hand at day trading than porn. The days of megabucks falling out of the sky are over and the numbers have been getting whittled down so that only the best and most well financed have survived this far.
1. Forget mainstream boy-girl boinking. You will get your ass handed to you by the megasites. Bang, Reality Kings, Brazzers, Naughty America - the business model is unsustainable and you will lose your ass. FORGET IT.
2. Find a niche that is underserviced and try to present something fresh and unique. Kinky Squirting Rubberbound Interracial Teenage Trannies in Bondage. Perfect. Not kidding. You start out small and build. This is the Sam Walton approach. He went out into the countryside and found small towns with a crossroads and ran his numbers and if there was 30k people within a one hour drive, he put up a wal-mart.
If he had gone straight into NYC , LA, Chicago, ANY of the top 200 markets , he would have been creamed. He knew this.
Moral: DON'T TRY AND TAKE ON THE MEGASITES. They have been developing their affiliate programs and marketing for a decade now. YOU WILL DIE.
3. START SLOW. Forget shooting your own stuff. Just forget it. There are lots of pros shooting stuff on spec. You tell them what you want and they send you the scene when it's shot and in the can. You don't want to hassle with staff and actual production on top of everything else. The 100th time a girl flakes and you're out a nickle for staff to show up to an empty set you will realize I was right. Mingling with pornchicks if fun for a minute. If you want to keep your fucking sanity - hire others to deal with it.
MORAL: IT TAKES MORE THAN $$$ AND HARDWARE> IT TAKES TALENT.
Once you have launched and are actually showing a positive cash flow - like after a year - then maybe you dabble and dip your toe in the water and shoot some stuff and build a little corner on your site . Call it 'homegrown video' and treat it as bonus footage. You will think it's great. It will suck.
As I am sure you know , Adult Industry webmasters hang over at gfy.com - be prepared for a very cool reception. Not for nothing - the GFY stands for Go Fuck Yourself.
REPEAT: FORGET ABOUT SHOOTING SCENES. ESPECIALLY ANYWHERE BUT LA COUNTY and MAYBE MIAMI-DADE COUNTY FLORIDA.
You fuck up one time and some runaway with a fake ID gets in front of your cam and it's all over but the crying. Forget about the other ways they can get you. Ask pornlaw.

Looks like you poke your head in here every few years but you obviously have some first hand experience with the production/business side of the industry and have been around the block a few times.
Care to comment on the state of the industry in general?? Just curious about your perspective.

@Unicorn: I appreciate that 2times. But I have a real vision of where I want to take this and I know I'm pretty much the only 1 who can pull it off. Tha rude.com style of business and quality of movies is definitely not what I'm trying to do. That shit is so lame.

No one in any industry takes a businessperson seriously who cannot use proper grammar and spelling. Business plans don't include spellings like "becuz" or "tho." If you want to be taken seriously then write like English is your first language.

I wouldn't know where to begin.
Ok.
Problem # 1. Cost of admission affecting quality:
25-30 years ago (8/16/35mm film days) the cost of admission was a million dollars or so (liquid - as in cash on hand) and you usually had to be connected or at least have approval from certain people but regardless - you had to be liquid 1mil. This is what it took to open and staff , buy or rent the gear, shoot , edit, score, title, dupe and box 6 features out the door in 6 months.
You had to be able to survive that long without any dollars coming in from distribution because it took that long for your money to catch up. Budgets were routinely 100k + per film. A lot of the guys behind the camera worked in Hollywood during the day for no money and at night or weekends they made porn and got paid well to do it. There was a higher bar and skillset required to operate. This for lack of a better phrase , kept the riffraff out.
You couldn't just take a cam out of the box , flip it on FULL AUTO and shoot a scene.
10-15-20 years ago (VHS/Beta) that cost was down to about 100-250k. Videotape brought a lot of those costs associated with film down but you could still get decent money fronted to shoot a feature. 25-30k budgets were common.
Now that cost can be as little as 10-12k for a 90-120 minute allsex vignette driven release with 4-5 scenes and some are even less when you get into the POV stuff.
Now with Clips for sale you have people spending $500 for decent 3 chip HD digital cam and some shop lights from home depot.
What this means is just about anyone with a camera can shoot, edit and sell content.
As in all things, the dropping of the bar has allowed an inundation of crap to happen. There are very few TRULY TALENTED producers and I can practically list them on the fingers of one hand.
This has killed the industry more than anything. You walk into a video shop and pick out a good looking box cover, 9 out of 10 it's crap. 95 out of 100. Crap.
So now you have a bunch of even sketchier people running around , all out for themselves. There is no consensus on anything and nobody gives a fuck, even about the talent. It seems that the mentality has changed. Used to be these girls were put on a pedestal. At least for the box covers.
Now a lot of the middle to low end gonzo scenes seem to be more about it's 'how much piss will she drink for $600 and how much can we degrade her' and that brings you to your 2nd problem.
2: Attracting QUALITY Talent and retaining that talent.
Everyone knows the biz is about the girls. I saw over 500 girls come and go in about 5 years . Most were gone in 60 seconds. A few lasted 2 weeks. 4 or 5 made it a year.
So the fans discover a girl and - well, she's gone.
Tough to build an audience that way but even if you could there's one more deal breaker and that is:
3. The Muthufuckin Internet
You can get it all right, have a talented director and staff, great marketing and budgets to hire or even lock up under contract and key the A list talent of your choice and STILL lose because the minute your DVD hits the rental store shelf , some kid takes it home, rips it and uploads it to whatever file service is clever these days.
So instead of selling 10,000 pieces out the door at $20 each like some did in 1999, now it's 500-1000-2000 pieces at $10-15 if they are LUCKY and then it gets downgraded to a catalog title for $5-7
Getting people to pay for a product that is freely available for free is nearly impossible as compared to even 10 years ago. Webmasters who used to convert 1 in 10/20/50 are now happy if that's 1 in 200/500 and as in all things, the Big Corps rule the roost.
If you can find some small niche and make a great product that no one else has, you might have a chance. Otherwise you will get destroyed. Even if you are well financed.

I mean it was like seeing the light but reading it. Seriously that was really helpful.
I'm all for pissing on chicks and having them drink it all but the Degrading part is senseless and it's a huge turn off. I mean I guess it comes down to the way they do it, but if a female isn't into it then it's a waste of time (and money) and plus it degrades the quality of the overall product. I like chicks who are eager to get down and do the deed, not sum Diva or a Party Pooper
That same logic applies to everything in porn. She has to either enjoy it or fully submit, otherwise it's a spoiled product and a waste of money.

Unicorn, Thanks for your thoughts.
I agree there's a lot of crap and that's a problem. When customers pay for content and it turns out to be crap, they're less likely to buy again.
The same issue impacts the ability to develop and retain Talent.
But, IMHO the real issue is your third one. Even if someone produces quality content, and even if they develop and promote good talent, the truth is their product will be stolen and distributed for free and the producer's ability to see a profit from their hard work is lost.
It's hard for an industry to prosper when they can't turn a profit on quality product because someone steals it and gives it away for free. Game Over
Thanks again, Rod

Really sad and heartbreaking to read all that , just to add , some fans still want to buy or rent thier favorite stars movie (Tory Lane is the goodhouse keeping seal of porn for me). This pirating crap has been brought up in the Tory Lane thread and it is very clear, her fans have posted how sick they are of her movies being stolen, and how it really has hurt her career, and hurt directors .
Last, sorry for the dumb question, but does this horrible business description impact someone like craven moorehead who has a complete Tory lane scene in the can, and will not , or cannot release it because no one has the rights to it or something like that. I still can't believe after all the trouble and money to shoot an entire scene, not releasing the scene for sale is the best solution.
Just asking, wish someone would explain it us (paying consumer) thx

Hollywood... Two ideas for niches:
1) Deep creampies. You know, like the ones in JAV. Almost no one does deep creampies in the rest of the business.
2) Real sex positions, with camera angles (NOT TILTED!) that focus on the woman's body, and her natural figure in natural positions. There is no need for constant closeups of penetration. The few scenes out there that highlight the natural curve of a womans tits, whether she's riding, or on her back, or on her hands and knees... are so hot. The penis doesn't always have to be in the picture!

Is it that? Or something like that? Because if you didn't get your paperwork signed and sealed by your talents, you don't have a legal model release and without a legal model release you have no choice but to stick it in a drawer.

Didn't consider that there maybe a problem with release forms, you would think with craven moorehead and Tory lane that this would not be thier first time at the rodeo, but who knows, maybe someday craven will tell us.

I tend to agree with you. You gotta remember that before the internet made porn easy to get and free the porn industry was doing well and profitable even with cheaply shot porn and girls who didn't stick around. Quality content is great for those who want it and have those types of standards but for many casual porn watchers when faced with the choice of a $30 DVD from a high end studio or a $12 DVD from a low end studio they'll go for the cheaper DVD and be content with it. I think they understand that they're getting what they pay for but don't mind because they aren't that choosy.
There are different types of porn fans out there it's a tricky thing to figure out if there's enough of an audience to sustain a particular ninche. You have some fans who are simply into certain sex acts and they don't care who's doing them. Some fans are all about seeing certain girls and are happy seeing them do anything even if it's the same ol' thing. Some fans are into certain studios/directors and like how/what they shoot and the girls aren't as important. Someone figuring something different doesn't necessarily mean a sizable audience will want to see it or be interested. Sometimes it's even hard to determine if a ninche is as popular as it seems. For example, there are people who like anal prolapsing but would that be as popular if it was mostly total unknowns doing it? It seems o be a popular thing but is it as popular without big name stars doing it at big name studios? Are most people really into it or do they simply put up with it to see their fav star in a scene or their fav studio/director doing their latest movie? Is there truly enough of an audience to sustain anal prolapsing in it's own without big name talent and studios? The same could be asked of other sex acts.

Legally I think it's even a problem. Maybe PornLaw can comment, but if you don't have complete documentation on a scene, you're at risk even having the original video. As a producer, you're required to keep documentation showing the performers are 18. Without it, I believe you're in violation of the law. If the performers are all well know, maybe it isn't an issue, but if they're amateurs doing it for the first time, you have no way to prove they're legal. I wouldn't keep that video 'in a drawer' just in case the feds came knocking on my door. If you can't sell it or release it, I'd destroy it.

I dont wanna sound ignorant but who actually digs that deep? If its an 18 year old/barely legal series type of thing then sure but I'm pretty sure MOST of the industry isn't under a microscope. For those people who are they need to reassiciate themselves or find a new hobby. There's so much wild ass porn out there it's literally impossible to keep up with all of it. You'd have to be a little bit of a paranoid skitzophrenic to be worried about releasing a tape of Tory Lane with 25 guys ejaculating on her face lol
#my2cents
I get it but I'm not completely sold on it. And for the record I'm not planning on hiring teenagers, they're way too inexperienced and would probably just lay there for the most part smh.

Wow. Really?
lOCAL/COUNTY/STATE AS WELL AS DOJ/FBI have fucked with a lot of people over the years starting with Harold Freeman who is the reason you can legally shoot a video in LA but even today it is not legal by statute. It's only legal by decision and while the .gov folks have 2 strikes - they don't have 3 and there IS still a ballgame going on.
Every so often the pendulum swings their way. We have a pretty big thing coming up next year. It's called an election.
If they get in , and by THEY, I mean the REAL batshit crazy right-wing bible thumping folks who would overturn Roe v. Wade and take us back to the 60's with their family values and 'small town values' bullshit.
Yeah, it's politics but it's power. And one thing these right wing types all rally behind is Sin.
Sin is code for porn you dirty fornicators. 'Protect our kids' is code for destroy the porn industry.
In the US, they push SOPA and PROTECT IP through first. This establishes the legal framework to flip a site off like a switch.
Then you go back in 6 months later under the 'protect our children from porn' flag and FORCE all adult content to the xxx domain system and then they can turn that shit off like a light switch.
Think it can't happen here? Look at the Aussies. I'm not sure about right this minute but I know you couldn't even post a picture of a girl with small boobs on a website down there - the site admins would take it down because THEY would be held responsible if they did NOT.
I don't know about right NOW but if you shot a video in Britain and released it, you went to prison. Ben Dover anyone? Export only and all his videos ran with that disclaimer that any copies found in the UK were not the doing of the producers.
I don't want to get started on a rant here but IMHO the 'wild wild west days' of the internet are coming to an end. We had a nice run.
But getting back to your statement. If that is the mentality you bring to this industry you are in for a serious wake up call and that brings me to the 4th reason to stay out of the biz if you are lacking in actual BUSINESS SKILLS:
4. It IS a fucking BUSINESS and how you CONDUCT your business is critical to your REPUTATION and your REPUTATION is CRITICAL to your BUSINESS and it's continued existence.
THIS MEANS:
DON'T Be that producer whose records are not in order and verifiable the FBI comes and spot checks.
DON'T Be that producer who is equally sloppy in your model releases and maintaining your ID's.
DON'T Be that producer who doesn't document the completion of that paperwork ON VIDEO with a copy of todays newspaper showing the date and questioning the models as to their state of mind. Is anyone forcing you or coercing you to be here? Are you under the influence of drugs or alcohol?
DON'T Be that producer who doesn't run a BTS camera that documents every moment that talent is on your property or in your care. From the moment they step out of their drivers car to them driving out the gate.
DON'T Be that producer who does not check medical tests and VERIFY them online or allows a performer to work with an expired test. It expired today? ITS EXPIRED.
DON'T Be that producer who says ' There's so much wild ass porn out there it's literally impossible to keep up with all of it.' and shoots something that crosses some stupid line in someones head. And if you want to know what I mean when I say stupid?
To cite a very recent example: A very well known company was dragged into Federal Court because a very popular talent shot a scene where a enema nozzle was inserted into a female talents butt and milk was introduced and then expelled.
The line that was crossed? Apparently the girl didn't clean out very well and some of that milk came out brown. They had a list. That was one of them. Guy got hauled into Federal Court and it will never be known if he would have prevailed because the Feds fucked the case up so bad the judge threw it out. I wonder what a year of prep and a thousand hours of research and building a defense cost him?
I know it cost Jim South a cool Million in 1980's dollars due to the Traci Lords fiasco and at the end of the day the thing that won the case was the fact that the .gov folks gave the girl a passport based on the same ID.
This is why the big corps don't just glance at the ID and make a copy. They question it like cops. They swipe it through a reader which checks to ensure it is a valid ID that's 'in the system' - not a fake that bounces back 'BULLSHIT'.
They quiz the talent on details. I had a girl bounced off a shoot because she didn't know her Social off the top of her head. Her defense? She had never had a job and didn't carry the card with her. She had to ask her mother for it. Legit? Perhaps. But the good people in the back office were not about to put their operation at risk. They showed her the door and rightfully so. NO girl that is unknown is worth that risk.
Is the fuzziness starting to go away? I hope so.

Look I'm not really tryna hear all of that. If AdultDoorway can get away with all of what they've done for almost a decade then I can do me. I know it's fucked up in California but the rest of the Nation isn't in the same boat. I'm sorry some of y'all don't understand that but thanks to people like u mentioned and all of the other mainstream companies I think it's safe to say that tha doors have been opened and have been knocked down.
True, if you don't have your business right then of course you'd be fucked up out here but lets be honest, who's doing the background checks? If u don't think companies like Brazzers and Evil Angel don't have Judges and Lawyers dictating who can do what then you sir have a lot to learn about Business and the real world. I think you're coming from a place of fear and I can see that. It costs to do business but if u think the FBI and The Courts are going to come after me for recording Lesbians and Anal Sex and things of that nature on camera and putting it on a website then you must not know a lot.
Like I said, that's how it's done on the West. And that's the issue I think some of these prosecutors are getting at. California wants to dominate and have any and everything stuck in California without opening the door for anybody else. So in turn it keeps the money in a pot for the very few and nobody else can catch a break. Also, if companies weren't too busy beating the shit outta chicks while they're having Sex then maybe certain companies wouldn't have went thru the scrutiny they went thru, it's karma and it always comes back around. U get back what u put out there. That's why all of the Companies who've shot that type of porn get shut down quick (Max Hardcore, Booty Chasers on rude.com, GagmasterX on rude.com, etc etc).
You get back what u put out there, if u can't understand that then you'll be the dickhead locked up. Plus when you start making more money than the top companies then that'll happen (theyll call the Feds on you theirselves), but that's a whole different story. But for somebody like me just starting out I think it's safe to say I'm not on anybody's radar no matter how good and original my scenes are.
And like I said, I doubt some 18, 19, or even 20 year old girl is fit for the types of scenes I'm shooting. I'm not looking to play baby sitter for some runaway or play sponsor to some high school graduate looking to play for college. Only pedafiles have to worry about shit like that. Of course I'm going to have the right documents but I'm not going to really have to worry about filming under aged chicks so its not at the top of my list on concerns.
Also, I'm a Black American. You don't think I already know what happens when a black man gets too powerful or gets a little bit of money, I'm already hip to wassup. We're the cash cows of America.
If you've ever heard the song "Under 21 Not Permitted" by Kool G Rap then you know where I'm coming from

Best to you, but I don't want to be the one some DA decides to make a name for himself/herself by filing charges against.
If you think shooting outside of California or NH makes you less visible, I suggest just the opposite.
As for filming under age chicks, I'll just say I never SCHEDULE a shoot without first inspecting and making a copy of two IDs and have had more than one girl try to pass off fake IDs. Even checking IDs before the shoot and again on the day of the shoot, I've had IDs change and had to cancel a shoot I had spent hours arranging and building a custom set.

Shooting outside California puts your model releases at risk. Paying people to have sex on camera is only a protected (case law) First Amendment right in two states - California and New Hampshire.
In every other state its quasi-legal and might even be considered illegal. Therefore you cannot contract for an illegal act. And thus your model releases might not hold up in court.
You may want to read this article fully...
Georgetown Law Review Article on Contracts in Porn...
Without a model release your model is your partner in profits... He/she would be entitled to a share and quite possibly half... which really makes it impossible to make money in porn, especially if you had to pay him/her all that profit as a lump sum amount after a jury verdict.
BTW - I have defended several cases where websites didnt have a model release and got sued... It wasnt pretty for the site owner...

Good luck to you Hollywood. People with expertise have taken their time to provide you with some very good information and advice. What you choose to do with that information is up to you.

If you honestly don't think they will then you are an idiot. Look at how many obscenity cases show up in the courts. Now imagine what the happy prosecutor will do when he or she finds out you don't have the proper paperwork. Every hear of 18 USC 2257, that legally requires documentation?
