producer had stated that she would not dare to include fisting scenes in her flicks due to the legal trouble this could bring. In its answer Yahoo said that state laws vary widely but
if an act can be considered "patently offensive to a community's standards" and could result in physical harm, its depiction can be outlawed in some states or even localities.
In Oklahoma it's still illegal to sell most hardcore pornography, really anything that shows penile penetration. And although Larry Flynt won most of his legal battles his hardcore stuff still can not be legally purchased in Cincinnati, Ohio. Glad I live in the Akron, Ohio area, where we don't have the uptight laws that Cinci has.

^^There's a very important distinction here; the act isn't banned, but given context, it could be considered patently offensive. The producer is simply trying to reduce their risk and liability. Fisting isn't outright/explicitly "illegal", but someone could bring a suit and claim that is was patently offensive. The plaintiff would then need to prove, in court, that the content was patently offensive given community standards. I know that it sounds like this subjectivity might be unfair, but by keeping the definition of obscenity vague, we prevent the government from creating blanketing censorship laws which prohibit certain content regardless of context.

I don't want to de-rail the thread but certainly some things are illegal...What did Max Hardcore do in his movies that landed him in jail? Why were some of the EVIL ANGEL guys in court? I'm not being funny, I'm seriously asking.
From what I've heard fisting could get you in trouble.I heard that having a woman restrained or tied up during sex is a no-no. Showing a rape in porn can get you in trouble. No scat. A girl shooting the wrong color liquid from her butt can be trouble.
I think all those are only illegal in certain states. Which is why you didn't see them in mainstream porn but they're all over on the net.

In the US I believe only child porn and bestiality are illegal. The rest falls under the gray area of obscenity, which is up to states and the federal government. As to what is obscenity? That is the problem.

I suspect he's making a study and porn consumers are his/her sample , this question could be also translated as "what porn consumers would find illegal, what they actually would outlaw? and how fucked up is the view of porn consumers , how sick are they toward obscene and grotesque sex acts?
depending on what side he's in and what is the purpose of his/her study.
Each of his/her questions could be reformulated into a more logic and less naive one.
Note that as would do any true researcher he doesn't intervene in debates he wouldn't lead or turn any of them out of their direction , it would ruin his/her study , I'd been silent about him/her until now because I didn't want to ruin his/her effort , but I still can't see where he is going and why it's taking so long , I mean how many questions does he/her have?
As for the very question at hand , "porn" is a too limited definition porn is produced in so many countries with so many different laws and different attitudes toward sex , for example Fisting isn't even see obscene in most of European porn , there are/were lines completely dedicated to it often linked to other behaviours for example there was a French series called Fist-uro and was dedicated to fisting and pissing , other series are devoted to fisting alone (Teach Me Fisting was one) there are stars who only shoot fisting and extreme objects content (Italian Veneisse fo example) or do most of her shooting in fisting productions such as Betty Stille. also, keep in mind that these obscenity laws apply only for media that are sold physically. Therefore no fisiting on DVD in the US. But Kink still can publish this in the online-only access. The DVDs by Kink that are to be distributed by JJV have to be edited. And Kink-DVDs sold abroad contain the fisting, but contain warning on the back: "WARNING: It is strictly forbidden to own or sell KINK.COM DVDs within the USA"

^^^ well to the best of my knowledge, it has to do with the way the goods are shipped to the customer, and the legal handle prosecutors have apparently is different depending whether the movie is distributed physically or virtually. IIRC, it had to do with the possibility that prosecutors could have the movie shipped to them in whatever county/town they pleased, contrary to a digital download, where no such thing is possible, or apparently the location of the servers would be the county/community whose community standards had to be applied.

There is no precedent to state that.
In The United States vs. Extreme Associates one of the charges was for computer files that were made available through their website.
In The United States vs. Kilbride one of the charges was for images in e-mails.
Neither one required that the community standards of where the servers were located be used. Although Kilbride did allow standards from outside the immediate community.

^ See Flash's posts. Many of those are not illegal acts but may run the risk of an obscenity charge. If deemed obscene, then the offending artist will be prosecuted. The acts are not illegal in and of themselves, necessarily. Many of the acts listed appear in porn with no prosecution of the artist, and the consumer of the material would not be prosecuted (as far as I am aware).
And snuff (if you actually believe it exists) is illegal because it's murder. So, that's hardly an "illegal sex act."

Some countries in Europe allowed sex performers, with written parental consent, to be filmed or photographed at age 16.
The US, ever arrogant and contemptuous of others, pressured the EU to ban performers until ege 18 when parental consent is no longer mandatory. The US succeeded.
I'm a big college football fan and one thing that gets many football players in trouble is underage drinking. The federal law is age 18 but Bill Clinton, another arrogant prick, threatened to withhold highway funds to any state which didn't raise their drinking age to 21. Some states had age 19 as legal for beer and wine, 21 for distilled spirits, the idea being age 19 is post high school.
A guy could legally drink on any US Military post or base, but as soon as he left federal territory, he/she was now subject to state law and they are age 21.
In college, most students turn 21 their junior year so alcohol is easily obtained by having a friend a year or two older who can buy it and furnish it. Almost anywhere on Planet Earth, it's OK to drink at age 18, we do have to consider it's completely illegal in Islamic countries for beleivers. but the rest of the world has sane ethanol laws.
21 is legal drinking age in the US, Indonesia, Oman,Pakistan, Sri Lanka, Tajikistan, and US administered Guam, American Samoa, and some of the Micronesia islands. Thailand is age 20, so is Iceland.
What's legal is some places, like wagering in Nevada, or drinking alcohol in most of the rest of the world is a felony in others. drinking age
Long ago I knew I wouldn't see intelligence from government, who else subsidizes tobacco farmers at the same time trying to discourage smoking or furnishing condoms to underage students too young to legally copulate. Los Angeles has a legal section(Special Order 40) that that doesn't allow police department officers to inquire about immigration status when it is the law of the land. Only government can ignore other government edicts like immigration ormarijuana laws but intelligence and government get along like Superman and kryptonite,

This is not entirely correct , , it is true that in Holland the age of consent for sex (16 as it is in most countries) had a very extended meaning which included consent for pornography , such material was illegal in the rest of the EU, they could not sell it outside of Holland so most major producers already ceased to film with performers that young.It is possible private flick may have existed and be legally taped, but I don't know for sure
Then a political party emerged with the official purpose of dropping that age of consent to 13 and give full legal status to bestiality so the topic raised to newspapers and the public opinion for months in the whole Europe , with great scandal , the Hollander themselves were shocked , I have no doubt that this was the actual purpose of such party , in fact this lead to the ban of porn bestiality in Europe and raised the legal age for porn at 18 in Holland too.
It wasn't just the US , the public opinion of the whole EU was against it too.

^LCF, you usually seem to be well informed, but what you wrote here is complete nonsense.
First, porn with 16 and 17 year olds was not illegal in most of the EU untill the late 90-ies and even early 2000's. The main legal problem with producing it before then was that a 16 or 17 year old could not legally sign a contract (a model release is a contract) and very few parents where willing to sign for it.
The infamous Traci Lords titles that were banned in the USA were widely available in at least France, the Netherlands and Denmark (those I know for sure as I have seen them in shops myself) till the law changed.
Secondly, definitions of porn change over time and keep changing. The famous page 3 girl in England is not considered porn normally, but before the laws changed in 2003 there have been plenty of 16 year old page 3 girls, including famous ones like Samantha Fox and Linsey Dawn McKenzie. Those pictures which were perfectly legal then and in national newspapers are now considerd child porn.
In the Netherlands the law regarding pornography was changed in 2002 to raise the minimum age from 16 to 18. This had nothing to do with any specific political party.
In 2006 a polital party (the PNVD) was founded with as one of its points making sex between adults and minors over 12 legal. They never got the required signatures to participate in an election and were disbanded in 2010. They had ties with the lobby club for pedophiles Martijn, which was banned in 2014. Neither had anything to do with beastiality or porn. The PNVD was actually for banning all meat eating and against animal cruelty.
Porn with animals was banned in the Netherlands in 2010 on the initiative of a member of the Dutch Labour Party. This had nothing to do with the above mentioned party.

^Thank you for more detailed informations but perhaps I have to reformulate something , Neither in Italy nor in France could be produced porn with minors and as far as I know it has always been as such , however porn produced in other countries that was deemed legal in there could be sold , this changed after the infamous "Lolita magazine" case.
It was a magazine that could be found in either countries possibly up until early '80 (not sure) It showed girls from seven to nine YO , in naked and other explicit content (not sure about actual sex I never saw one of those and I was too young to possibly buy one) when some parents filed criminal charges over the owner , apparently he recruited the girls out of schools or playing camps shoot them and let them free , not sure how the trial ended nor if he was paroled or something similar but he ended shot on the street by one of those parents.
From then on sex with minor was forbidden for sale in Italy and France even though I don't know all the details.
As for Traci Lords , well there were theatres back then , her movies were shown in those , In Italy you need a rating to do so, her movies got the OK . It is an official stamp made by an authority. So it could be a grey zone , such ratings are official must be challenged one by one.
I'm not sure anybody filed a claim on her movies so they can be still sold , I remember a Right Wing review called il Borghese the new director Vittorio Feltri (1998) begun to add a gift in their issues it was an erotic movie with Traci Lords ,most if not all the sex was removed it was "erotic" not XXX rated so it could be sold along with the newspapers by regular newspaper sellers , I saw on the cover shown in the reviews that the "visto" was still that of the eighties , it has not been revoked at that time.
Nobody complained , yet it was a minor in a sexual related context and was released by a newspaper deemed bigot go figure
I assume in France happened something similar .
As for bestiality The "manifesto" of that party published in Italy contained references to bestiality , it wasn't the main goal but was one of those things they wanted to "free" , It was a translated version I couldn't verify the actual content I can't speak their language
As far as I know the most known producer of young content in Holland the Seventeen series was already using adults only for a while

I don't know about Italy, but France changed the law to make 18 the minimum age for pornography in 2003, Here is the actual law.
I don't read enough Italian to understand it all, but here is the relevant Italian law.
The "manifesto " you read must be wrong, since when that "party" was active bestiality was still legal in the Netherland, it was only banned after they disbanded. They wanted to make it illegal to kill any animals or eat meat, so they were actually fanatical animal rights activists.
In France the Traci Lords movies were sold on DVD till 2003. I know for sure, as I personally destroyed our stock when they became illegal in the Netherlands and we bought them from a French company who made the DVD's.

That in Italy is not a law it's a Supreme Court sentence about a man accused to be a paedophile because he had pictures taken on the beach with kids in them those kids weren't his , but the Court sentenced it was not a crime unless the kid are related to something sexual.
But there are numerous references to the laws applied , so it is useful but you need to speak the language.
I stand corrected about Holland too, although possibly that party may have raised a debate in the Country.
Last , my first point about the US having nothing to do with those laws changes in the EU I believe still stands.

The "party" failed to get the 30 signatures required to participate in the elections, so they were very marginal. It was bascially just a few press releases by three guys and there was not much of a debate, they got mostly ignored except of course by the sensationalist press. I had completely forgotten about them until now and I even live in the same town as the founder at the time.
The US pressure story comes from the "Optional Protocol to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography" adopted on 25 May 2000 by the UN, the USA were a big proponent of that.

I know it was the Jubilaeum (A very annoying thing ) , but our laws changed a little after and were enforced with the new Pope (age of consent raised to 18 but maybe not , a very complicated new law was issued ) including a brand new one to forbid to sell alcohol to minors , which we never had in centuries not even the wine in stores
I remember to go down to get some beer or some wine when it was finished at home, I was probably 12 , I didn't drink it, just bought it and brought home, it was for supper of course.
Anyway , I'm not sure about what are our points , I stood corrected , isn't it?

^I know that last year the age of consent within Vatican City State was raised from 12 (which was in accordance with earlier Italian law) to 18, but I didn't know that change affected all of Italy. The whole thing strikes me as bizarre considering that some of the countries with the lowest age of consent, such as Mexico and the Philippines, are heavily Catholic. Angola is also predominantly Catholic, though I don't know that the Catholic hierarchy there has as much political influence as they do in the Philippines, a nation just shy of theocracy.

Our law is chaotic to say the least and has been amended a couple times in ways I don't know , I was interested in girls this young so it wasn't an issue , but it's really a mess, looks like our rulers have not a plan but are reacting to pressures , either the public opinion , the Church , other bigot groups.
For example there's an age of consent for minors , those above age 13 can have sex but not with a partner over two years older ,the age of consent was 16 but not with partners over 3 years older.
Full consent is obviously 18
the reason is that they realize that minors have sex , it would be very awkward to arrest a 15 yo with a GF of 13 for having had sex , also it would have put a weapon in the hands of their parents if those of one of them don't like the other for whatever reason.
Even though the age has been raised due to a change of mind in the public opinion (for example among my circle of friends we had such debate about age years before the law was changed, more than once but we weren't alone, the issue was there) provoked by a series of situations made public over the years from the eighties to the nineties, but as said if they begun to arrest or put on the bar all those teenagers who turned eighteen and still had a GF/BF who was younger and still a minor would have created an opposite roar, it's just dumb.
In reality this late part of the law is not enforced there are people well over 21 who had or have GF/BF under 18 and even the idea of Berlusconi with 17 YO girls didn't create much of a scandal , in the newspapers maybe and in those who oppose him, but not much in the Country, the judge could easily have avoided troubles by believing he invited such girls to protect them , he had basically no choices , he wasn't backed up by the Country, you can't condemn such a powerful man if the Country is not at your side.

Its rather unfortunate that fisting is normally frowned upon. Except for kink, every company tells me strictly no fisting though sometimes I get so into the scene that I forget and do it anyways!

Something else to consider, is that there are ongoing cases in the United States where a person produces content in one location where the content is legal, then the content ends up in another part of the United States, where it is not considered legal, and the police in that jurisdiction then prosecute the person under the laws of the place where the content isn't legal under their community standards. Polk County, Florida sheriff Grady Judd has a notorious habit of doing this.
