I got a lengthy email from Consumer Reports when I called Adult DVD Talk the consumer reports of adult DVD in a press release. I had no idea that was a trademarked name (I guess I should do my research.) Thay may have a trademark but that doesn't mean thay can control what you say. It seems to me just calling yourself casually the Consumer Reports of porn is probably fair use. But as you probably don't have the money to fight their lawyers you'd probably better back-off. But legally I think they're wrong. In fact the words "consumer reports" is a generic term. It means reports by consumers, I suspect you may be able to trademark the name "Porn Consumer Reports". So long as you're not trying to take advantage of their trademark or confuse people it's perfectly legal to mention their name. [Link] |

I suspect in your case, their lawsuit would be so obviously frivolous the judge would probably throw it out.....but you never know after all that woman got 3milllion form McDonalds for spilling coffee on herself.
