Due to proposed section 2257 record keeping changes we have a new image policy. The law will not going into effect until at least September. From then we will have 30 days to comply.

Since we have been emphasizing R-rated for the avatars for a long time, probably 99% of them will be acceptable. But as Saki says, as long as they comply. I know of only one that needed to be changed.

I read a bit of the proposed bill, and I see that it mentions the internet or world wide web in a generic way, without mentioning the USA specifically.
I would like to know whether they think about prosecuting even internet services outside of the USA and how could they do that, since the USA laws don't apply to them.
Otherwise, instead of keeping all those records, wouldn't it be easier for internet porn sites to simply move outside of the United States, both phisically and in term of originating ISP?
For the very nature of the internet media, they would be able to keep on providing their services even to USA customers without having to endure such an hassle.

Quite possibly the dumbest question ever asked , but how does this relate to Anime screen caps ? The women featured are a little difficult to get hold of for past aliases and current living addresses , so presumably they're OK . On the other hand , are you trying to implement a Zero Tolerance policy here ? Allowing animated penetration and all its dastardly relations might breed confusion ( if only for one poor fella ! ) .

anime would be allowed with the new 2257 issues, however, while we're are going thru this huge effort we are also attempting to avoid obscenity prosecution. so no animated penetration either.

sir noel - no sex acts is all we're told. seemingly someone sucking a dildo is a sex act. please don't make me choose every word in the image policy perfectly. obviously someone putting in a mouthgard and someone shoving a baseball bat up their ass are not the same.

I am afraid that 2257 will spell the end of the ADT forum as I have grown to know it over this past year or so. It may still have a function for those in the biz but for folks like me looking for information, IDs etc its usefulness and appeal will be greatly diminished. As I said before, the idea of a porn forum without porn stretches credibility. I hope I am wrong. This is one very sad punter.

man, this really sux. this totally hurts the value of reviews for me. often times i rely on seeing a few images before making a purchase. and i fail to see how this is going to curb child pornography. is what it is is another law for politicians to point to when people ask them what they are doing to protect children (but in reality the law is doing next to nothing).

I plan to re-do all my review screenshot pages well before Sept. and hope to have at least a few each that are still acceptable.

God knows I love posting nasty pics in the forums as much as the next person, but look on the positive side (something I rarely do, btw) - it can add an element of tease, and leaves something to the imagination.

Steph is probably getting tired of these questions, but I don't want any trouble. Would a lap dance be considered a sex act?

If I were the guy's wife I might consider it a sex act, but that's beside the point

Don't think so, Kperv. Other sites are in exactly the same position as ADT and will have to sanitise. The legislation applies to all sites hosted on US-based servers.

by "no gapes" i mean those pictures of big red gaping assholes. the nudes a poppin shots are rarely gapes - mainly they're just spread cheeks.

other sites outside the US will not have to comply. and plenty of webmasters and hosting companies are unaware of what's going on. plus IDs can still be done without penetration shots.

the law is plain and simple an attempt to make it harder to run a porn business. the doj wants to get rid of as much internet porn as possible. it gives them a legal means to go after companies they want to prosecute. it'll be about as succesful as the war on drugs.

its not about repealing one small peice of legislation

so far alot of other crap like that has already been passed and the Democrats probably wont reverse any of it but getting Ashcroft out of there would definately prevent any further damage from happening

the latest thing right now is he's going before Congress trying to convince them why a law must be passed to elimanate softcore sex on cable and ban "offensive" sex themed shows on HBO.

Now I know that the Democrats have there own people to worry about who are into censorship but you have to admit that this guy is out of control.

Okay, zo i have to change my Avatar. Which happens to be a hot booty with a thong. Maybe, maybe not. The wording in the definition section seems to indicate that those who are involved in the mere distribution (i.e. sale) of porn who were not also involved in the creation, duplication, editing, etc. of the material are not liable for the record keeping requirements.

However, the definitions are vague (perhaps intentionally so) when it comes to web sites. How does one distinguish between an online store that sells videos/DVDs and offers screenshots or boxcovers from a TGP site? From a review site? From ADT? From a pay site that requires payment to see explicit images? One would think that the intent of the law is the latter, but again, it's not clear.

Given the uncertainty, I would guess that some stores will choose not to offer the service rather than have to maintain a huge number of records or risk a surprise visit from the government.

Another thing: The genius in the government's strategy is that it doesn't "prevent" anyone from viewing or displaying explicit material (that has already been held Unconstitutional)--it says that in the preamble of the rule change. Instead, it gets around that by imposing recordkeeping requirements that the Congress has already passed a law for. And by the time this rule is struck down by the courts, it will have already done its job.

Because the inventory will not be sold the same way in the future. Therefore, a product (especially if it's very popular) can become rare or just in demand in the future.

I'm not talking about the DVD itself , but the box with the DVD.

My guess is that the companies who are really in tune with the legal issues have already been prepared to implement softcore boxes or different versions (or have been doing so).

Any perceived "rarity" or value in a disc based on packaging is just that...a perception. I don't see much of a secondary market for porn packaging or memorabilia. So just because one release will have a HC back and the next will not, won't mean that the HC will be "worth more" since 99.9% of the people buying the disc are buying it for the content.

Now, if the content on the disc was forced to change, then the OOP version might be worth more to some people. But given the really, really small runs of adult DVDs in general (a minute fraction of mainstream runs) and the difficulty for some retailers to sell all of their inventory as it is, unless the content is illegal or completely out of print, there doesn't seem to be a premium demand for anything in porn.

Bottom line, if it make you happy to have a hardcore box, then buy it. But if you think you're going to make a buck off of it, then I've got some other investments that you might be interested in too.

I wouldn't say that it's trivial either. The amount of work that this site has had to do in preparation for these changes is not insignificant. Going through thousands of box covers to determine which might be covered under the new recordkeeping requirements is not fun. And I don't know any online business that would be willing to request and maintain hardcopy files for the sake of showing a hardcore boxcover.

It's probably managable for smaller companies, but I can only imagine how it might impact a large company like LFP or Vivid, who not only has substantial video operations but also derivative web sites that have tens of thousands of images, each which will require individual copies of records with cross-referencing.

I think you missed my original point .

Some buyers/fans do have an affinity for an "old school style" of product. This law is not a big deal, but those buyers/sellers that can benefit from the curve (through overlooked info) either can own rare DVDs/videos or just cut into a new market.

Sometimes a small new law can precede a big law. Porno is changing all the time, but it can't be suppressed at a dramatic level. So those that see the curve or benefit from the curve will be less disappointed with any new changes or new laws.


Right now if production companies in the Valley (or Calif) could collaborate or even create a new formula that focuses on a European Style with the goal of satisfying the horny American buyer ... can be ahead of the curve and dig into somebody elses market.

Just bumping this back up for people not familiar with it. We most likley will be revising this policy in the near future.

Within the next 30 the entire site will have every image removed that depicts actual humans involved in actual sexual contact.

I haven't thought too much about it yet but my gut reaction is that any image that appears to be of a sex act taking place will not be allowed, even if it is only of the faces with the genitals outside of the frame. The law is fairly clear on this.

To be honest I think I'm going to have to remove the ability to post images in the forum. It's the only 100% surefire way to be safe.

I'm also most likely going to suspend the my.adultdvdtalk.com hosting space and remove all of the content from our servers.

yes, but in a Hollywood movie you can assume that the sex is simulated. It's pretty safe to assume that a screenshot taken from a porn flick has actual people having sex.

The rules are fairly clear in that if the original image(s) were taken when performers were having sex then records must be kept.

However, there are some things that I still need clarification on and may need to consult an attorney with experience in this area.

The biggest thing that sucks with these new rules is the extensive burden placed on online retailers. Online retailers are specifically required to maintain records for all items that they have boxcovers posted for. Their brick and mortar conterparts are not required to do so. Selling a DVD in a porn shop is considered 'distrubution'. Selling the exact same DVD online and displaying its box cover is considered publishing. It's totally fucked.

I don't know yet. There may be exceptions to the rule but in general I don't think I can leave ourselves exposed. We have too many fucking assholes out there that just love to fuck with us anyway they possibly can. If I leave the ability for people to post images in the forum then some jackass will eventually post a bunch of hardcore images and then tip off the feds. This may sound a little too paranoid but I'm not willing to risk it.
