I've seen a Andrew Blake movie where a girl is stripping and touching herself on a balcony and you can see people outside,but it's far away and you can't see their faces.
And I've seen a movie with a scene in a mall, with people driving their shopping carts around. But they are all censored with a black box.
Do they have to do this or just to be safe from suing?
I was wondering what happens if you see someone you know:..."hey that's Mom shopping there"...
thats odd because in RayVeness' Bangbros/MILF Lessons scene they find her in a public place and other people can be seen walking by and even being talked to by the talent... no censoring in that scene and I doubt they flagged them down and said "wanna be a passerby in a porno?"
you have to have releases for everyone if they are identifiable as well as products, we take down all pictures when we shoot or we have to have an artist release, we also cant show labels like nike etc, also car logos are a nono
Does trademark law really allow a company to have that much control over their logo? If so, it's a bit ridiculous. Nobody is gonna think Nike started making porn just because somebody happens to be wearing some of their gear in a movie.
I'm not criticizing you, btw, Kami. Even if they don't have legal grounds to sue over a logo, it would be totally unsurprising if some company did. And again, if you don't think they have the grounds, lawyers still cost you money.
On another note, I could've sworn I read that people aren't entitled to an expectation of privacy in public places. I always figured release forms were so producers felt secure against frivolous lawsuits (which again, even if you win, you might not get your fees covered by the loser, and you certainly don't get your wasted time back).

nah I think you understand it right. my thought was always if a product is being used as the manufacturer intended it was ok cause you were not mis representing the product like if you are drinking a can of coke its ok that's what it's for, but if you stick it in your ass that's not ok

You can often see a yardman or day laborer passing by a window and glancing inside. Most of the location houses have a yard service and sometimes those guys show up with their mowers and blowers during a shoot.
Can't they post a sign as a general release like you see at sporting events and nightclubs? You know, by entering these premises you agree to have your likeness appear on MTV's wax my crack. I always see those things around hollywood.

The porno with the Harley issue is Anabolic's Gang Bang Girl #20 starring Erika Bella, Mercedesz and Tyra Olsen. It featured a scene inside a motorcycle dealership, on the showroom floor. As the gang bang is happening, you can see motorcycles in the background (not that I was paying attention to them).
I remember this film because I rented it when it first came out, and when I tried to get it on DVD, I found that it couldn't be purchased anymore.
