Four Performers File State Labor Complaint Against Hay, LA Direct From the link above: Four adult performers have filed a formal complaint with the Department of Industrial Relations for the State of California against LA Direct Models and its owner Derek Hay... ... [the performers] allege that Hay and LA Direct "exploited his position of power to abuse his clients both emotionally, financially and sexually."
LA Direct Models' Derek Hay Is Target of Complaint Made by 4 Performers (Xbiz) OAKLAND, Calif. - Four adult female performers have filed a complaint with California's Labor Commissioner against talent agency LA Direct Models and its owner, Derek Hay, alleging numerous improprieties. The performers, all named as Jane Does in the complaint, signed deals with Hay for representation, but said that they've been led down a pathway of fraud. Hay failed to account for all fees earned, coerced them into improper business arrangements - including those involving sex acts - and threatened to destroy their careers if they didn't comply with his wishes, according to the claim, which seeks a disgorgement of revenues and fees the four models earned and revocation of Hays' agency license, as well as attorneys' fees. Industry attorney Allan Gelbard, who represents the four performers, told XBIZ that he and his clients are looking forward to "presenting a compelling case, supported by sworn testimony and other evidence, to the state Labor Commission." Gelbard said he thinks that there are other adult performers in the industry who may have faced the same circumstances, and that they should raise their hands. more at the link above
I've only been moderately aware of the issues around LA Direct and Derek Hays. Siri's career was cut short in part because of problems she had with them.
^^ It's gonna be hard to get anyone that currently working with any level of consistency to come forward. They might be able to find some performers that have since retired that are willing to testify, like the above mentioned Siri or possibly Morgan Lee (IIRC).
I cant recall the specific performer, but wasnt this the same person who allegedly forced performers, the one in particular, to stay at his personal residencies which would then lead to pressuring and if the performer declined, he would either cut their work off or invoke clauses that would have him basically strip all their earnings, regardless if it was contractual obligations or side work? It might be multiple performers, because I think the one I'm thinking of having these problems in their early career is no longer alive.

I read the article. I'd be interested to know who these accusers are. According to the article, the only one who has identified herself is Charlotte Cross because she gave permission to be identified. But who are the other three?
How this ends should be pretty interesting considering I have heard about LA Direct Models and Derek Hay's misconduct from many girls, certainly more than the four brave enough to take them to court. I would not be surprised if a lot of those girls, who are no longer in the industry, spring back around to get in on the action!
It took like 20 years to expose Harvey Wenstein - Derek Hay sounds like his equivalent in porn [Tweet is no longer available] After a description like that I'm surprised this actually happened. It took this long probably because previously models struggled to deal with Derek's mob-like tactics on their own while this case is a joint effort of several models. I don't think would have happened without Adria Rae's campaign against Derek earlier this year.

I disagree. If the accused has no right to anonymity, then neither should the accuser.
^ Contrary to what you believe, people don't lie enough for that to be worth doing. It is much, much more likely the accuser stands to risk harm (monetarily or otherwise) unfairly because of the accusation being true than the accused because of it being untrue.
Speculation based on your own beliefs is no different to his bias. You haven't done the research required to support your claim, if that information even exists.
I wouldn't be because there's no reason for Adria to be anonymous after her public campaign against Derek earlier this year. Also, article mentions 4 performers are seeking to be let out of their contracts while Adria's contract expires in August so technically she doesn't have to fight for it. There's no lack of former LA Direct models who'd want to see Derek go out of business.
^Figures. This is a great story for the mainstream press. For one, the only time the mainstream press reports on anything porn-related is if it's something negative. Secondly, it fits right in to what people think happens in the porn industry anyway.
The mainstream exposure will hopefully make a lot of upcoming and aspiring models weary of signing with them in the future! That's a solid win for now.
^ As someone who is just learning of this recently, I think it's a strong statement. Your point about FSC's knowing about it for years is well-taken. But as an active participant on this forum, I am just learning about it. (To be honest: I remembered Siri's statements about it, but I had to go into the archive to confirm it was the same agent.) So others have been silent besides FSC. For my part, I didn't look into Siri's complaint enough to even remember whom she was complaining about. Are you saying that you have known about this for years? Do you think others on this forum have known for years? If so, can you explain why it wasn't common knowledge here?
What Captain Jack said. These accusations have been known and talked about for years in many forms . This should not be news to close followers of the industry. Folks haven't been silent. Many industry-related topics never get shared on these forums. It is often not worth it for one reason or another.
Another Actress Files Complaint Against Derek Hay, LA Direct (AVN/Mark Kernes) LOS ANGELES-In the wake of the report last week that four adult actresses had filed a complaint with the state of California's Department of Labor Relations, alleging that veteran talent agent Derek Hay and his company, Direct Models, Inc., dba LA Direct Models, had failed to live up to the terms of his business relationship with them, AVN has learned that an additional complaint had been filed by actress Nadya Nabakova, alleging similar contract violations, and charging that he had violated various sections of the state Talent Agencies Act. more at the link above
[Tweet is no longer available] ^ Lots of tweets from Lisa Ann regarding LA Direct and Derek Hay under that tweet [Tweet is no longer available] [Tweet is no longer available]
It's been 10+ days since this news broke. At least the FSC put out a statement. APAC has yet to make any public statement or tweet about the issue. APAC claims to be the leading performer advocacy group "giving performers a voice both on set and off." Yesterday, they tweeted an INDUSTRY ALERT for a fake audition scam. LA Direct? Radio silence. To date, they only have one retweet on the LA Direct issue by Charlotte Cross. Performers deserve better. Chairperson Tasha Reign, who used to date Derek, did encourage others to speak up on her personal twitter account. She said she couldn't speak up. The chairperson of APAC said she couldn't speak up. None of APAC's other current board members have addressed the issue on their personal twitter accounts. They have on other issues facing sex workers. Just not this one. [Tweet is no longer available] [Tweet is no longer available]
^ Isn't the new APAC Board being elected this week? Do you think the old Board feels already in "lame duck" status, where they feel they have to leave all future positioning to the new leaders?
^ Yes, they are electing a new board. That hasn't stopped them from rallying around other issues, including Stormy Daniels and fake auditions. It's a good excuse, but issues such as this are too important to sit down for. Unless you believe the new board would be against this, there's no reason I see they couldn't advocate for performers on it. If the new board is against advocating about this, they shouldn't be on the board.
As I recall he wasdeclining work and even saying around she quit , as it appeared he wanted his share even for work she did that wasn't in their contract some feature dancing or camming I'm not sure , but apparently he thinks his contract means everything. Anyway it could even be worse than that , I haven heard anything specifically saying this , but i remember that Nica Noelle was willing to ignore Hay's diktat about not booking Siri and she did hire her and kept booking her but then her company AEBN despite her being their top seller , she then went to shoot trans-gender sex and possibly still does , I like her work and wanted to support her but not to the point to buy stuff I don't like Mason hired her too but ceased very shortly after that the guy alse demands "his girls" to work even during a moratorium I remember a star ([redacted by legal demand] if memory serves) being fined because she didn perform during that time back when the Syphilis Outpreak sprung out It's also worth mention his problem with Lisa Ann when he kept hiring Alex Gonz despite the fact that he knew the guy had Hepathytis C which is not listed as a STD but can be trasmitted by blood contact and the unprotected rubbing of gentials can leave some scratches so yes it's not a STD but no, you don't hire those who have it . Lisa Ann complained once but he kept pairing him with her then she went public , She quit less than a year after that, possibly unrelated but still...

At least one of them apparently isn't all that concerned: paragraph 67 of the complaint alleges that Derek refused to let a producer book one of the girls to do a scene with her own husband. Presumably, the list of LAD models who are married to male performers against whom Derek harbors a grudge is short enough that anyone in the industry can probably figure out who this is.
Sounds like Derek Hay tried to sneak in Nadya Nabakova's real name in that article in retaliation for her complaint against him - he can't be that incompetent to mention it in his statement by accident.
Whoever manages this account (it's not Mike South) tweeted that APAC's mentor Karen Tynan represents LA Direct - that would explain their silence though wouldn't take any information from that account as fact so can anyone confirm this? [Tweet is no longer available]
As Zaxmate implies, take everything from MikeSouth.com and the corresponding Twitter account with a grain of salt. I know for a fact that people that post on the website post under 3 or 4 different names and they are tied in with LA Direct Models. I had to laugh when "Mike South" posted, " it has been years since I had a performer complain to me about LA Direct..." Really? I've heard from at least 5 or 6 girls myself this year about Derek.
^ My thoughts exactly. The best is, as always in the comments, where one commenter writes (I'm paraphrasing): It's better if Derek sends his models to his affiliate escort/pimping agency instead of the models having to give 35$ blowjobs on Hollywood Blvd. SMH.
The thing to realize about AIPAC is that they are a creation of the FSC. The FSC styles itself as a defender of free speech but at bottom it is the porn industry's trade association. Their sole purpose is to advocate for the interests of the major porn companies who comprise its membership. They're no different than a trade group like the National Association of Manufacturers in that regard. So when the interests of the porn companies and the performers align, like the anti-Prop. 60 campaign in 2016, you can expect a strong position from AIPAC. But when the interests of the companies and performers diverge, expect a tepid response from them at best. AIPAC is essentially a company union. All the porn companies depend on agents like Hay to keep them supplied with a steady stream of performers. They rely on them to put pressure on the performers to make sure they always show up when they're hired. They rely on them to enforce kill-fees so production isn't disrupted and their losses are minimized. The agents are integral to the continued functioning of porn as a business. The reason the FSC and AIPAC never took a stand against Hay all these years is that they have by and large benefited from his practices. Now that it looks like he might have to finally pay the piper, they put out a meek statement trying to distance themselves from his actions. I think the solution to a lot of these issues would be a genuine worker organization that can actually freely advocate for the interests of performers. AIPAC isn't that, and unfortunately the last attempt at organizing porn performers turned into a disaster. Hopefully someone will try again soon. Industry Attorney Hints More LA Direct Models Claims Could Be Coming (Xbiz) Attorney Allan Gelbard told XBIZ today said that since the industry has become aware about the legal moves against the agency, more performers are sharing stories about their experiences at LA Direct. "It is still very early in the process," Gelbard said. "But there have been significant number of performers who have contacted me about the case."
Looks like I linked wrong account though since @MikeSouth1226 appears to be real Mike South (that account tweeted that he doesn't own his site anymore) while @MikeSouthXXX is managed by Dave Wight from The Luxury Companion, according to Charlotte Cross [Tweet is no longer available] [Tweet is no longer available]
Labor Commission Hearing Pits Nadya Nabakova Vs. Direct Models (AVN/Mark Kernes) LONG BEACH, Calif.-Yesterday, adult actress Nadya Nabakova was given a forum to air her grievances against Direct Models, Inc. and owner Derek Hay in a hearing before Max Norris, an attorney with the California State Labor Commission acting as hearing examiner. Representing Nabakova was Courtney L. Puritsky, while Direct Models and Hay were represented by Joseph Baldivia, who was the attorney doing the questioning, and David Pierce. The hearing-which Norris described as "informal," though both witnesses were placed under oath-began just after 10 a.m. As AVN previously noted, Nabakova filed her complaint with the commission last January, and Tuesday's hearing was largely a "she said/he said" affair, with the decision in the case likely to revolve mainly around whether or not Direct Models (better known in the adult industry as "LA Direct Models") and/or Hay violated the California's Talent Agencies Act, since although it's currently based in Las Vegas, Direct Models is chartered in California. Though no ruling has yet been issued-the examiner will issue one within 30 days after the two attorneys submit closing arguments in writing by Monday-the hearing covered many points of interest to agents and performers in the adult industry. more at the link above
^ I believe Alana is wrong. LA Direct left LATATA in 2015 amid infighting and hasn't rejoined. Shy Love's VIP Connect left around the same time. They founded the original LATATA with Joel Lawrence. LATATA's website does not list LA Direct as a current member. APAG exists for performers, but has also seen its share of drama, both within the guild and with their parent IEAU. All of them (FSC/APAC/APAG/LATATA) have done good things for performers and the industry, while leaving something more to be desired.
Allan Gelbard's Smoke And Mirrors Obsession with Derek Hay Alternative narrative from a blogger Sonny Brennet (@TRPWL) who positions himself as an industry insider. It's interesting that this guy regularly exposes agencies like Glamour LTD, Plush Talent, VIPConnect, HussieModels yet when drama around LA Direct comes up he pushes a narrative that Derek did nothing wrong and that's just a smear campaign by Allan Gelbard using made up claims by Jane Does - I guess he's completely clueless about dozens of other models who spoke out against Derek over the years, albeit wihout AVN and XBIZ writing about them.
