Update - To prepage for the law changes here is our new image policy

For those of you who don't check polls - please see this poll about the future of adt due to proposed section 2257 record keeping changes.

Reviewers - We may have to remove all screenshots from our site. So it's not worth your time right now to create additional screenshots.

Webspace Users - We will not be able to host any websites with sexually explicit images.

Studios - Please keep sex acts on the backs of covers. Otherwise sites like ours and retailers who don't have the resources to keep detailed records will not be able to display your covers. If we know that a certain studio sometimes puts sex acts on the front cover it will be easier for us to remove all the covers from that studio as we don't have the resources to examine every cover.

Will you or someone else be able to give more specific guidelines of what is and isn't allowed? Most cases are clearcut, but others less so. Look at this week's mystery babe. Picture 1 has to go, I guess, but what about picture 2?
Also, is this something we have to do right now, or do we wait for a sign from you?

p.s. I see a bleak future for the Male Performer of the Week series. Solo pictures of the male stars are not easy to find.

It very specifically states that this records rule change applies to "whoever produces" the material, and:

"does not include distribution or any other activity which does not involve hiring, contracting for (,) managing, or otherwise arranging for the participation of the performers depicted"

This site has nothing to do with the production of anything, so why do you believe that it is going to require changes to this site?

A producer can be primary or secondary. From the definition of secondary producer in the new rule:

A secondary producer is any person who produces, assembles, manufactures, publishes, duplicates, reproduces, or reissues a book, magazine, periodical, film, videotape, a
computer-generated image, digital image, or picture, or other matter intended for commercial distribution that contains a visual depiction of actual sexually explicit conduct, or who inserts on a computer site or service a
digital image of, or otherwise manages the content of a computer site or service that contains a visual depiction of, actual sexually explicit conduct, including any person who enters into a contract, agreement, or conspiracy to do any of the foregoing.

This site falls specifically within the boldface criteria and therefore will be required to maintain records.

Drew, see Sundance Associates vs. Reno. That decision unequivocally says that ADT is not a producer based on what the statute says, not what regulations might wish, and that the term producer may not be extended to include anyone engaged in "any other activity which does not involve hiring, contracting for[,] managing, or otherwise arranging for the participation of the performers depicted".

Now, a conservative way to go might be to not depend on Sundance since that ruling technically isn’t binding in California. I’d certainly err on the side of caution. But I think the secondary producer rules you quote were thrown out in this context a while ago.

What Drew is concerned about is 'changes' that are being proposed, and those changes may make the Janet Reno thing obsolete.

The secondary producer rules were thrown out only for the 10th circuit. Since we're not in the 10th circuit we're fair game. We don't have the means to fight it if we were ever prosecuted so we are forced to cave in and comply with something that may very well turn out to be an illegal use of power by Ashcroft.

Sorry for posting in the wrong thread. Too many open windows!

Sundance addressed how the term produces should be read in the context of statutory language. The new 2257 stuff quotes that same statutory language so I assumed that had not changed. New laws don't automatically reset rulings of this sort, only changes to the areas held unconstitutional make a difference.

If the 10th circuit holds the language unconstitutional there's almost no chance the 9th circuit would say otherwise. But, I agree there may be no virtue in being the test case. Maybe make a donation to the library association – they usually fight this king of thing tooth and nail.

I don't think the 10th's ruling was based on constitutional grounds. I think they determined that the agency's implementation was an impermissible construction of the statute. I think that we would be OK if this went to court in our district (1) but if contested in districts 5, 11 or the western section of 3 I'm not so sure that the court would agree with the 10th's decision.

Sundance is conservative and breaks no ground; it would be surprising for any appellate court to disagree with it - this isn't a philosophical or new-law thing.

Sorry for the tone; I was in a hurry and did a cut & paste from a post I made elsewhere about the Paris Hilton tape and 2257. I don't think ADT should take the problem lightly, but rather say that "we need to take a defensive position against Asscroft's goons overreaching" instead of "it's illegal". Being confident of winning is of no comfort to the guy who has to spend the $$$, time & risk to win.

Wait a minute. Let me get something straight. Isn't there a way for the industry to massively protest against these "section 2257 record keeping changes"? I mean, since i thought that the US is a democracy, that means that you can always protest against decisions your government makes, right? I don't get it. Perhaps i'm totally off topic here with my reply, but if the US is the land of the free, home of the brave, a country that lives for freedom of speech, information and press or freedom per se, then i really do not get it. What's going on over there? If i understand the whole thing correctly, it is that within a short period of time adult video covers have to be removed from websites? How in the world is this possible? You can no longer link to websites with 'sexually explicit pictures'?! I truly am shocked, stunned and amazed to read all this. It's so simple: since adults are perfectly able to decide themselves what they can and want to see on adult websites, without a government deciding what's best for the adults, you shouldn't even have to think about a ridiculous measure like this. This is pure censorship. And censorship is a tool usually used by dictators. What has the industry done to prevent this? Has anyone forcefully opposed to this? You guys should transfer all your content to European servers to bypass this stupid rule.

Can somebody well informed please enlighten me on this subject in detail?

Baby Grandpa's got it exactly right. What is going on over there? I used to visit the US lot on business. It used to be a fine place with great people. Since 9/11 the US looks less and less like a democracy and more and more like a dictatorship. It seems that if you criticise you are disloyal. What has become of free speech and freedom of expression? Now the government is going to decide what you can look at - next thing they will tell you what you can read.

If the democrats start to make headway between now and end of summer, it would not surprise me if Bush and Co manufactured some sort of Middle East or North Korea crisis in the fall as an excuse to postpone the election...indefinitely? A move like this would be the next logical step.

Don't forget where you read it first.

Well, John Pype, it's a good thing to know that you agree with me on this one. Especially since you too add that typical bush thing to the subject. Ever since 911 i can't help but think that 'Mr Dubya' has taken away a lot of the freedom that the Americans were known for. There's even a friggin' "Patriot Act" that basically allows the feds to invade your house and put everybody in jail even if there's no direct evidence for such a thing. Everything is going out of proportion. Thieves, robbers and total and utter scumbags like Cheney, Rumsfeld, Rice, Wolfowitz, Bill Kristol, Eliot Abrams, John Bolton and Lewis Libby (to name but a few) are taking the US back into the middle ages. They also happen to have connections to mob companies like Halliburton, General Motors and the Carlyle Group (to name another few). Besides this, these hardliners are slowly BUT SURELY taking away all the freedoms that the Americans built up for themselves over the decades. The Dubya administration at this moment promotes bullsh*t like "the silver ring thing" in stead of promoting the use of condoms amongst youngsters to prevent STDs and HIV. The Dubya administration supports the (ultra religious f*cks) that fight abortion. At the same time a whole nation went berzerk when Janet Jackson's nipple was shown on TV. "Bad words" are muted on TV, Compact Discs contain 'Explicit Lyric' stickers, NO ONE can sun tan topless throughout the US, Fox News is a 24/7 propaganda machine for the Republicans, Reagan's death, memorial and the whole nine was on TV for a f*cking week as if The Lord himself died all over again AND IN THE MEANTIME they manage to gag a whole industry when it comes to adult entertainment. Even though i might be Off Topic and even though my comments are considered too political, too rough or too rude if you will, i still won't take back any word of what i just said, even if my comments may be removed. I truly and sincerely believe that it is a crying shame and a total outrage that a government can actually lay down laws that completely cancel certain freedoms. You are NOT living in a free country if adult entertainment is gagged. Period. Hardline islamic countries do not allow porn either. Adult entertainment, whether one likes it or not, is the ultimate proof that a society lives in freedom and that freedom of choice is in effect. Adults are not little kids. We have freedom of speech, and all that, but that doesn't mean people in power won't trample all over our rights if we let them. They've done that repeatedly in our past, continue to attempt it today and will undoubtedly do so as long as the Republic stands.

One thing we might want to consider is that the people doing it often have a good excuse, and probably believe that what they're doing is in the best interests of the country. That doesn't make them right, it just makes them human, not evil soul-sucking mummies hiding out in a rest home in Texas.

OK, so what the proposed revisions would do is require anyone who puts up a 'pornographic' image to have complete documentation on every person in the picture, including proof of DOB and any and all names they've ever gone by. Furthermore, it would require anyone linking to any such images on other servers to also have said documentation, and it would require that a record be kept of every URL that ever pointed to such a picture. While it might sound OK in theory, for anyone familiar with the scope of the issue it's a prescription for shutting down most, if not all, porn sites owned by citizens of the U.S. of A.

Yes, the individual owners can respond to the department with how they believe this ruling will affect their business, but, if Steph's reaction is any guide, most see that as a good way to become the department's next anti-porn target.

Did I miss (or misrepresent) anything?

Oh, can you have a whole industry gagged? Of course you can. Have you forgotten McCarthy, the Red Scare, and the Hollywood blacklist already?

Hi folks .... I know what I'm about to say won't be so popular, but there is a Silver lining in this black Title 18 "cloud" ......

For starters, one of the biggest problems on the net right now are the damn Website Pirates! - These so-called webmasters who buy/rent our stuff, rip it down and put it up on their pay sites. 85% of the damn movie sites out there don't even have permission to use our videos yet alone have the docs to support them on their sites. We, like others, have lost a ton of money to these thieves - this could be a means to an end to put them down. Like others, we own several pay sites and have lost a bundle during the past several years becouse of places like AdultBouncer and Deluxepass

On the Down Side ......

Title 18 is nothing new .. we've been dealing with it for some time now, and the same problem as before will exist in the future with these revisions - who is going to enforce it?

Can you imagine how Usenet & newsgroups like Easynews or Pictureview is going to deal with this? How about the 10's of 1,000's of banners that have Sexually Explicit images? Not to mention the 100,000,000 sponsor pages out there that have been floating around for 8 years.

Personally ..... I Think ( yea .... I sometimes have a thought or two ) that this isn't going anywhere yet. It's really designed to go after sites that continue to promote underage content not sites that are legit. This revision will allow law enforcement to retrieve documents without having to go through the courts. I heard that there are just 7 people who police the internet in this area - HELL!!!! I have a hard enough time keeping track of the 64 sponsors we have. There are some good points that could be looked at, as well as the bad - Privacy Issues, control, enforcement are going to be the downfall of this proposal. It will end up going back to the "drawing board" for a long time. Look at COPA - that was knocked down 5 years ago and still hasn't gained any ground since last weeks Supreme Court ruling.

One thing to keep in mind is that this is an election year.

Ashcroft beating up on the adult industry to curry favor with the Bush base is almost to be expected. They really don't care if they "win" any court cases... they merely need to be seen as fighting against us evil doers.
And, as has been correctly pointed out, ADT does not have the resources to fight with the government. They can put you out of business just by accusing you.

The Los Angeles Times ran a disturbing op/ed piece by a freelance journalist from the U.K. who flew into LAX on both a pleasure and working visit. Well to answer some of the questions.

I just today loaded an upload to my site that took off all of the hardcore images (I think).

Unlike most my problem was not in getting the proper documentation on my shots since most of my work was with companies I am on fairly good terms with I probably could have done so. The problem came with the requirement that I post the 2257 statement on the images as is required by law. In the past I just posted the statement from the company but due to the proposed changes I would have to make my own statement with my address on it.

Like a lot of web based people I work out of my home and as such really don't want to post my home address on the web for all to see.

I see that you have updated your first post and that a new image policy has been posted. 2 questions:

1) Maybe a seperate 'sticky' thread for the new policy is a good idea? Now it is kinda lost on the first page of an 'older' thread, that already has 3 pages (when using the default 15 posts per page setting).
(OK, I haven't read all the forums yet, so if this has already been done elsewhere, pardon me.)

2) Is the posting of the new image policy also the sign I asked for in my first post in this thread, the sign that we should start looking at all the pictures on ADT serverspace? IOW, should I begin to go through my pictures now and remove the ones that are not conform with the new policy or can this wait?

FYI, many times she is busy with admin things, answering emails, and posting reviews. Also she doesn't necessarily read all of the threads when she is busy with other things.

Not that my website has been updated in like... FOREVER, but I'll be removing any objectionable images sometime within the next week. For me it's mostly just a few screenshots, some of which will still be ok under the new guidelines I think. My website isn't fancy enough to have a whole lot other than reams and reams of textual dribble.

Back in the day (under the cloud of another Bush presidency) when I was shooting mag layout we had a strange set of prohibitions. A woman could spread her twat till you could see her cervix, but if she was touching herself in a way that might indicate she was enjoying it that was a no-no.

Apparently the rational was that the spread shot was informational/educational; where as the clit-frigging shot was a graphic depiction of sex and prosecutable.

It's a wonder republicans reproduce.

Well, I removed the spreading is ok as the pic that DB posted is too close to masturbation. When I wrote spreading I simply meant showing pink. I want to keep things as clear cut as possible even though the govt won't give us that courtesy. All we're doing with the policy is trying to comply with vague standards.

Walter, the law won't go into effect until at least Sept. From there we have 30 days to comply. I have started going thru our covers (6,000 reviewed so far) as I know it's going to take us all that time to "clean up" the site.
