Is there a production date for the scene confirming it was done since the HIV diagnosis was reported? It's not inconceivable that the scene could have been shot in 2018 but for numerous reasons, its publication could have been delayed until now. This has happened with performers who had retired long ago but a scene of theirs that had been mothballed by a studio would be published months if not years after a given performer had left the industry.

All that matters is whether Nacho performed knowing a sexual health screening of his provided a positive test result for HIV before he had sexual contact with others.
