Mandatory Condoms
So I read this today.
The thing I keyed in on is that OSHA can only take action when someone reports an infraction right then and there. I imagine they can't do a thing once the production is released.
Now what I predict is that many people won't report because they'll fear be blacklisted. Would you report something at the risk of never being able to work because you were a whistle blower?

Additionally, for those of you who have some powers of deduction, ask yourself why now. I mean they've kind of sort of had a condom thing for years but it was never really enforced (obviously). The STD threat has always been there and if anything, it has been somewhat diminished by new meds and treatments.
So why did they choose this specific time to really start ramming this kind of thing through? I know what I think and nothing will convince me otherwise. Obamacare. The timing couldn't be more obvious.
I'm telling ya. This guy is worse for the porn business than all the Republicans put together. At least you can get people off their asses to fight the Republicans.

On a more serious note, here's three recently released statements by GOP candidates about whether they would "ban porn":
Rick Santorum:

Mitt Romney:

It includes strict enforcement of our nation’s obscenity laws, as well as the promotion of parental software controls that guard our children from Internet pornography.”
Newt Gingrich:
Gingrich was asked if he will enforce existing laws that make distribution of hard-core adult pornography illegal, he responded: “Yes, I will appoint an Attorney General who will enforce these laws.”

Republicans have been cracking down on porn since the Meese commission during Reagan's presidency. It has had roughly zero percent effect. The candidates statements are the necessary pandering to their base during the primary fight. You can't close down the local porn shop anymore, it's already gone.

Where did I say I was a Republican? This condom thing didn't come strictly from the right or the left (and neither did Obamacare). What this is is so much more than a one sided attack. Just wait and see. Nobody is going to be laughing when the tentacles start showing up in their own homes.

Agreed but he is not bad for just the porn business, rather business in general.
There was a period where condom usage was more common, some studios used them a lot, like Vivid and Wicked. The public did not embrace it so directors dumped them. I see condom usage more often in amateur porn these days. IMO this story is more chatter that will fade away.

They know that mandatory condoms will drop the sales of American produced porn in favor of foreign porn , they also know that they cant forbid porn or porn producers in California , so to actually erase porn they need a key which would allow their goal without looking like censors , what would be that key?
Health care and security.
With this they destroyed the AIM (though without even naming nor caring about gay porn with no test at all) now they will destroy American Productions with this mandatory condom rule , it is obvious that in Europe we will film porn as we please, then another law is arising at the horizon, a new legal age to do porn , 25 years , of course with a claimed good reason , to avoid the exploiting of too young girls (without giving a fuck for people exploiting too young workers of course) thus putting out of porn say 80% of the pornstars , and maybe outlawing foreign porn for being "underage".
I think there's a planned strategy ongoing
Does that seem plausible to you guys?

I completely concur. Ultimately it's a whole lot of folks with differing agendas and political perspectives finding common cause to kill the CA porn industry and try to run porn back into the shadows. Though there seems to be this generalized acceptance on the left that porn can be fun, fulfilling, and not traumatizing to young woman; I pretty much assume that there is also vocal and powerful element just ready to go back to the days of feminist Andrea Dworkin, when every sex act was considered an assault by men, and all women who appeared in porn could and should be considered rape victims. When you start seeing people like Dworkin coming back from the sewers they've been hiding in and forming coalitions with religious fundamentalist nutjobs, you know the porn industry will be in a fight for it's life.
I guess one thing we have on the porn side is that there are so many clearly intelligent women who love participating in porn and are amazingly articulate at explaining how they find it empowering (such as Bobbi Star, many of the kink.com chicks, BellaDonna, etc.). Leftist anti-porn arguments at least now have to come up against the reality that most girls clearly aren't traumatized by their experiences. And porn has been mainstreamed in so very very many ways that it would also be harder to paint it as an abberation.
So what Laurie Cameron Fan is saying could absolutely be a new tactic to kill porn with a death by a thousand paper cuts... Little things that sound "reasonable" to general non-porn consumers--people who don't believe in censorship--could easily fuck things up. There is no doubt that the CA porn industry would cease to exist if the age limit were changed and condom rules were put in place. And all the while, average folks who bemoan censorship, but support these "reasonable" accommodations unwittingly become the censors...

Yes, but imagine Laurie Cameron Fan's scenario. Our porn industry is basically killed over the condom issue and the parallel track of upping the minimum age to 25. So the whole industry moves to Europe. How long do you think before suddenly being able to obtain even euro produced porn becomes harder and harder? Remember, midget-dicked Max went to prison for porn that would be perfectly legal in Europe, yet was illegal in (parts) of the the US.
So in our nightmare scenario, now it's not just slapping the shit out of confused 18-year-olds and pissing in their mouths that's illegal in the US, but now it's simply shooting with girls under 25 and productions without condoms. How long before these products become harder to obtain?
Right now the US govt. is about to pass SOPA, which gives incredibly wide discretion for shutting down sights that supposedly have copyrighted material on them. How long do you think it would be before it's used to shut down sites featuring "horribly illegal acts" like seeing a 24 year old girl getting fucked without a condom?
Seriously, don't assume that because the "genie is out of the bottle" in regards to gonzo porn that it can't be shoved back in that bottle kicking and screaming.

The world wouldn't end if humans went extinct. That's not the point. It is the end of porn for those of us who will not watch it. There are gay and bi men who have little to no gay/bi porn to watch because of rubbers. It's all fine and dandy for those who don't care or at least tolerate it. Everyone else is just SOL. Including the ones who are willing to take the risks.

It will take more than this to push porn offshore. San Francisco was the capital of porn in the 80's and they are ready to be that again. SF and Marin voters are the most liberal in the country and they would take a condom mandate as an assault on freedom of speech. Oakland would just be thankful for the jobs porn moving would produce there. Also Kink.com is one of the biggest taxpayers in SF, no way would the board of commissioners there allow a condom mandate to become law there as they want the millions of dollars Kink pays each year in city taxes (and if a state law was passed, SF police would not enforce it).

As I see it, the threat from OSHA is a more realistic challenge. Essentially OSHA is charged with protecting employees in their work environments. OSHA made sure that the Department Store warehouse I worked for when I was younger had me wearing a safety belt. OSHA ensures that roofers wear safety lines. There are lots of opinions about the efficacy of OSHA (and I'm sure RandomPrecision has an opinion or two about OSHA) but it is a fact that OSHA determines workplace safety rules. If, because of OSHA, it is determined that porn shoots represent an unsafe work environment because the lack of condoms represent a risk for sexually transmitted diseases, then condoms might be required...
At least that's he scenario.
Ironically the rule would almost certainly be geared towards AIDS prevention, when in reality AIDS transmission has been effectively non-existent amongst the hetero california porn world. Condoms might actually make a difference in the prevention of other sexually transmitted diseases like chlamydiae, etc.--which I've heard are pretty rampant--but the people pushing for condoms don't really give a shit about those STDs.
When BustdownGal says "stop worrying...gay porn has condoms and the world didn't end" it leaves me a little bit bummed. Why should we just accept something that demonstrably isn't necessary? If we were having a dozen girls a year getting AIDS, then condoms would absolutely be a clear necessity. But there have probably been 100,000 sexual acts committed to film in California in the last 10 years in the straight porn industry, without condoms. How many girls got HIV on one of these shoots? 1? 2?
Should we really "stop worrying" and accept condoms, even though the justification for their need is completely and utterly non-existent?

Why does everyone assume that Republicans are the impetus for these changes. As a Republican, who also supports the porn industry, I think it is shortsighted to blame a political philosophy for some imagined "War on Porn". I would also like to point out that although the Meese Commission stated that pornography was "harmful", 2 other presidential commissions (1 Republican, Nixon, and 1 Democrat, Johnson) found that there was no evidence of harm, and that most Sociologists discount the Meese commission report as biased. The bias is not because a Republican President commissioned the report, the bias is because the members of the commission were evangelicals and anti-porn from the start.

My point was not to blame one political party or another for pornographic censorship, etc.. I was responding to previous post which quoted present candidates for the Republican nomination. I use to subscribe to AVN magazine. Each month , they'd have an article alarming the readers about a legal case which was going to harm the industry big time. However, the adult film industry just kept marching along with increasing more explicit content. This topic reminds me of those articles-I'm doubtful the industry can't adapt to this ordinance becoming law. Would the ordinance hold up to a legal review ? Couldn't companies shoot outside of LA ? Most porn sets don't exactly resemble Gone With The Wind. I'm more concerned about the weakening profitability of porn for the LA companies than this matter.

Since I'm not American I'm out of all your political issues also I can't be counted in any of those parties In some things I can be considered Republican in same others a Democrat , I'm mostly a free thinker , so said I wasn't blaming the CA commission for anything , I mostly was blaming the OSHA and those anti-porn activists who are falsely showing concerns about safety in porn environment,
It IS an issue of course but not the way they put it, for example if they want to reduce the risk of infection why they actively contributed to shut down the AIM?
The very first way to avoid an infection is to have sex with an healthy person and to make sure the workers to be as such , a reliable tester is required.
So instead of having mandatory HIV tests in gay porn (as incredible as it may seem , to make Gay Porn isn't required any test as far as I know , that is why they use condoms it is their only defense) they actively helped to close the only reliable tester available and put attention to condoms.
Those voting in the commission aren't actually anti-porn but very likely are out of the matter and decided with some study some presented , maybe about the spread of infections in CA so they believed they actually were contributing to save people and not seeing the big picture.
What I put in my scenario above is the big picture, a series of actions and decisions which sum might very likely wipe American Produced porn and workers out of the market.
Politicians in many cases are fooled by anti-porn activists who present them a view of the matter but not the whole view , do you know if any porn producer or worker has been asked to point out his view?
I believe the commission only heard what the OSHA had to say

This is all kinda funny. I mostly watch JAV and condoms are entirely mandatory there with the big studios, but it's not an issue since you can't tell with the pixilation.
The only American porn I watch is older material from the 80s and 90s, so again, it's not an issue. Except for Nikki Dial. Don't know how she got away with demanding that.

Come on, this is yet again another disingenuous argument denying the obvious through the pure distortion of facts. First off, you're confusing one commission into two. The President's Commission on Obscenity and Pornography was set-up under Johnson but not released until Nixon was in power. It's one report, not two.
Nixon tried to suppress the findings of the commission before they came out and publicly dismissed them once they were released.
The Meese Commission wasn't just commissioned by the Republican administration, it was cherry-picked and stacked heavily with anti-porn conservatives, the bias was intentional from the start. You can't rewrite history. Facts are stubborn things.

If SF was going to react in this way, they would have likely already done so -- especially with Kink.com being SF's most active and one of their largest employers/businesses. SF is also the most liberal (i.e. whatever floats your boat) city in the country.

I seriously doubt Kink is their largest employer when compared to Zynga, Salesforce, BofA, Bechtel, TransAmerica, etc.
And again, it was gay activists trying to stop the spread of AIDS who pushed gay porn into going all-condom years ago. Some of these people actually have a sense of responsibility that overrides their hedonism, you know.

I said one of the largest employers, not the largest. Certainly in the top 100 largest employers, big enough to influence local government policy. Bevan Dufty (former SF supervisor and the guy who should have won the recent mayoral race there) has said that there are other porn companies (mainly gay porn currently) in SF that are on their radar as well, for him to mention that fact on camera means porn must be a big moneymaker there for the city (and not shunned as in most cities). In the same video Bevan seemed to welcome porn companies in SF. I don't know of any other area in the US other than San Francisco/Marin County whose governments puts out the welcome mat for porn companies -- that is why I believe porn will move there (as they did in the 1980's) when LA passes their condom and inspection requirements.

How are we to take a government seriously that wastes time and effort trying to force condoms on porn performers for "safety," while year-after-year coal mine safety issues are ignored (while the regulators look the other way), professional football players demolish their bodies and sustain life-long cognitive impairment (even though they wear mandated brain-buckets for "safety") and our food supply safety is routinely compromised (even though "regulations" have succeeded in putting small family-owned farms out-of-business in favor of the agribusiness corporations that actually cause the problems)?
We, the United States, are a country in decline.
The politicians NEED non-issues -- like porn -- to rant and rave about, in order to distract the electorate from things that matter. As long as anti-porn politics can deliver dozens of rabid "base" voters in primaries, the "issue" will never go away.
And, "yes," they mean to regulate us out of existence.
Take a lesson from our real corporate criminals...
When the Clean Water Act rightfully began to stop companies from dumping raw sewage and hazardous chemicals into the environment, companies merely moved operations to foreign countries that had no regulations (and/or whose leaders could be reliably bought-off for reasonable amounts).
The porn industry will, eventually, have to do the same.
The forces of evil -- masquerading as the religious right God party -- are never going to let this go.
They are like pitbulls with the Constitution in their jaws.
Remember this, though: once they succeed in destroying the adult industry, then will start coming after the adult end-users -- and that's all of us.
