Yeah, Lords of Acid is pretty obvious. About 10 years ago, I semi-dated (whatever that means) a dancer who loved "The Power is Mine." Good memories... Sometimes obvious is ok. Sometimes subtlety has its advantages. "Open your ass" = Not subtle! "Dost thou thinkest thou might engage in anal activities in the near future?" Slightly more subtle!

I kinda miss the fun hair, but can tell you I most definitely do not miss people being able to spot me from two blocks away, nor do I miss the blue and purple stains all over sheets, clothes, bathrooms, and occasionally people. The people stains were probably the most awkward.

Stoya, didn't DP trademark your name so that no one else can use it? I'm sure you can get Sam & Joone's lawyers to sue the Stoya Corporation or something. At the very least, you can make sure they never use "Stoya" on any more sexy posters.

They do put the little TM after her name, but unless its in the database, it's not actually trademarked.
Which means that, when her contract is over, Stoya could still use her name in porn. Otherwise, she will have to change it.

^Well, usually when the girls leave DP, they do have to change their names... (Teagan being the exception, and even then there was a bit of a legal battle about the name before they got it all sorted out). See for example Sophia Santi who is now Natalia Cruze, or Adrenalynn who didn't want to give up ownership of her name when she joined DP, so she changed it to Adrianna Lynn, and then changed it back when she left them, or Arianna Armani who took on Angelina Armani when she joined DP, likely for the same reason, or Shay Jordan who has recently become Jasmine Jinn now that she's left DP...
I don't know anything about this database stuff you guys are talking about, but maybe it just hadn't been put in there yet when you checked or something. I can't imagine that they'd just put the "TM" next to their names for no legal reason at all.

Not being in the database means the trademark not registered. You don't have to register a trademark. The ™ symbol just means that the entity is claiming a trademark and putting you on notice. A ® symbol means the trademark is registered with the feds.

No. Just a notice that there is a claim of a trademark. Once you use a brand name commercially and the name is intended to be exclusive, that's supposed to establish a trademark unless the name is too generic to trademark or already belongs to someone else.

Registration is not that important in trademark law, other than being a clear statement of intent by the registrant. If the trademark is registered, then the violator has a difficult time claiming that they were unaware of the pre-existing use of the trademark.
The two keys to trademark law are first use, and whether the violation is likely to cause confusion in the mind of the consumer. So Hustler calls its sitcom parodies "This Ain't _______ XXX --- This is a parody." The strong statement that "This ain't...." would defeat any claim that the consumer might be confused, and the statement that it is a parody gives it first ammendment protection (satire is given pretty broad protection as speech).
When Apple Computers started up, there was already a company, which had been formed by the Beatles, called Apple Records. The record company claimed infringement by the computer company, but the claim was tossed out because because at the time, the consumer was unlikely to confuse a computer with a record. Things changed when the computer company started selling mp3 files, and the lawyering started up again. Eventually they settled, probably because the fact that you couldn't buy Beatle songs on iTunes was hurting both companies.
Trademarks are given more respect when the trademark in discussion is a created word. The computer company would probably not have been allowed to call themselves "Beatle Computers."
"Stoya" is not a word in the English language, so DP would have a pretty strong case against these guys, and I would urge them to send them a "cease and desist" letter.
I would also urge Stoya (the beautiful and sexy woman, not the word) to lay some claim to her name. She was using it as an indivual model before she gave the rights to DP.
I don't know if she might want to do fashion design (or anything other than porn) in the future. If so, she might want to start by just selling one or two articles of clothing using the Stoya name, and then let the trademark office know of her claim to use the name within the fashion industry.
