OK I can't figure it out. What the fuck is the big deal about fisting? Why is it any more hardcore than any other genre and why in God's name is it supposedly illegal to sell these movies in the U.S. When researching IAFD these movies are fairly plentiful with American actresses but can't be purchased anywhere? Any replies would be appreciated and especially some leads on vendors for fisting movies with American girls. I know they can be bought from Euro suppliers but mostly with Euro girls [which I like a lot too]. What's your take?

The general opinion I get from discussions over the years is that it is not illegal to distribute, but if produced in LA County, the LA District Attorney's office announced way back in the mid-80's it will prosecute it for obscenity. Other jurisdictions would probably be even less accomodating.
I don't know if Scott Kinney is in business anymore, but he used to sell fisting tapes.
Here in Canada, where we have provincial government censorship of porno, the powers that be actually allow vaginal fisting, but anal fisting is a no-no on medical grounds. The joys of bureaucracy.

The answer to your question is that people are ignorant. There's nothing really all that extreme about vaginal fisting. At least not as long as the chick likes it. It's just one of those things they decided was gonna be a no no. As usual, there's virtually no rational thought behind it.
It isn't exactly illegal. It's just that doing it will probably expose the producers to the risk of prosecution for violating community standards. It's stupid. It's pointless. But it just is.

kafka largely hit the matter right on the nose.
While fisting is not federally illegal to produce, there are just WAY too many individual states here in the USA that have either specifically classified that act -- along with many of quote unquote extreme sex acts -- as obscene it just makes no sense for a producer to take it upon themselves to really open themselves up to such a costly and long drawn out legal court case over a matter that is so small.
While there are a few USA fetish sex producers here in the states that do sneak the act as a minor backdrop like ol Max Hardcore, but most who feature that as part of the film or do it directly as part of the film just do not find it worth there time to make the film here in the USA and then distribute abroad as the courts come after the USA producer for making it here.
Besides it not that expensive today to either partner with a foreign production or set up operations over in Europe and then fly the name recognized model over to the Netherlands and film and release from there as Sweet Picture did for Julie Knights recent Charlie's Anal film. But until the restriction ease up or someone is willing to go through the courts to get fisting proven not to be an obscene act -- and after the Five Star loss I doubt it -- most USA producers will just direct the consumer to the European producers and resellers.

I was surprised to find a fisting scene in the very nicely re-issued Neon Nights. Seems that Raincoat Theater wasn't too concerned about prosecution.
Similarly, Eli Cross in his podcast makes the excellent point that he isn't worried about being prosecuted for his fisting scenes because he's placed them within a storyline that will protect him under the 'artistic value' section of the Miller test.

As stated, there are a few USA producers who will SNEAK it in their films. But can you name one USA producer who FEATURES it today in a manner similar to the old dollybuster.de production companies did back in the 1990s? Currently there are none. NOT even Max specifically features that as it just too much trouble to go through ALL 50 states to get your product declared not to be obscene according to their state laws and regulations.
I like Eli as he is good fellow. But that assumption is a falsehood that Larry Walters just LOVES to drag out as the cornerstone to his "let's feel good" plan. To consider that is a plan for defeat as it is just ONE of three (3) questions that have to be met.
And as just shown in the Five Star complete LOSS (despite no acutal person being sent to jail), a jury can consider a film to be obscene even when it may NOT meet the structure as specified under the VERY broad application of "SLAPS test" as no jury is mandated to have to specify in any detail what content in an adult film meets the criteria that classifies it as successfully meeting said criteria of being "obscene".
Also remember some STATE laws do list "fisting" as meeting their LOCAL criteria of being obscene. Thus if said producers' product ends up in that state they and their distributor CAN be hauled across country to face the local laws. Again most just figger it is far less costly and more orderly to avoid all that rather than go state by state (or federal district by federal district) to find out what is permissable and what is not to that locale municipality.

I think it would be pretty hard to argue that Corruption doesn't have some 'artistic value.'
As Eli says, the film may or may not be any good but you can't say that it isn't TRYING to say something, unlike plain gonzo footage of two people fucking each other.
In Canada the laws are even tougher than in the US and a guy got off for writing child molesting short stories for his own 'pleasure' because it was determined that they could still have 'some artistic value.'

Are you referring to the denial of federal funding for productions deemed "offensive?" If so, then that hardly sounds like censorship. Rather, it seems to be selective usage of tax payers' money.
Censorship pertains only to distribution and/or viewing, not to production. You may have the right to view one person harming another (depending on locale), but that does not justify the perpetration. Nor do destructive tendencies excuse the demand for such acts.
That makes sense. The vagina is very stretchy and durable; babies even pass through it. The anus and especially the rectum are much more delicate.

Again remember the failing the SLAPS (SERIOUS Literary, Artistic, Political, Scientific) content test is only ONE (1) part of a THREE (3) part condition.
While MOST jurisidctions usually only prosecute material that meets ALL three conditions in order to try to optimize their chance for success, said prosecutors CAN prosecute if they believe the material in quesion only meets ONE of the three under the Miller decision.
Fisting usually fails on the SECOND condition of the Miller decision test -- "whether a work describes or depicts content in a PATENTLY OFFENSIVE manner adherent to all applicable laws ("all applicable laws" being INCLUSIVE of the locale state and municipality laws DESPITE the content is originating from a locale OUTSIDE that jurisdiction). And I'm sorry too many people see anything outside straight penis to pussy insertion as "patently offensive" under their LOCALE understanding which is why "showing the ejaculation on the lady/man's hands OR face OR back" IS still being actively prosecuted in many jurisdictions here in the USA.
Hence one of the reasons that most of the producers do NOT produce too much edge content as there ARE states where just showing sex films regardless of storyline and others things that make the film to meet their locale definition of being obscene
-- though these restrictive states are usually well known to most producers, distributors and large scale consumers.
But those states who have such blanket bans is one of the reasons most producers do NOT ship their products into those states as they KNOW they do NOT want to be dragged across country to face some locale little attorney general with an election/re-election issue need.

I personally agree with your understanding.
But too many people think of the Miller decision as being narrow when in reality it is VERY VERY broad and DOES include material that specifically does "ONLY try to say something" regardless of whether it tries to or not.
The illusion that a LOT of us operate under that if we put a plot in a film -- even if it is the WORST plot ever like say "pizza guys gets lucky AGAIN! Episode 453!" -- that film will be absolved of being obscene

The same is true of just showing two people having sex together. Simply by itself most think that is NOT a condition for being obscene and many would agree as it is fairly normal act for everyone over 13 as a general rule
But the REALITY is UNLESS the jurors in a locale jurisdiction say it is, such content IS obscene.

As recited by several of the jurors of Five Star AFTER they gave the verdict they were NOT instructed to judge ANY particular act or event in the film as breaching what they deem as obscene but just they general feeling about the films in question which DOES say ANY locale municipality CAN prosecute ANYTHING they coming into their area.
So yeah I respect Eli a lot for his great content and fairly straight talk. But there is no way he is going to be making a FISTING FEATURE any time soon. The same for any other USA producer here in the USA though several will continue to make and release from certain locales in Europe as there is a viable niche market for such.
Canada is different from the USA -- where Miller is applicable. Though I guess because it did not have at least "one depiction of the act" it did not meet your locale condition of being a "crime comic" and thus illegal like a lot of Japanese hentia is now in Canada.
But most of the content that is created here in the USA that many do NOT consider hard BDSM (I am talking about that which is COMPLETELY non sex and keeps the pants ON) is routinely denied entry import, such as "Harmony's Tickling Frenzy".
As far as child molestation stories goes, here in the USA that is blanketly considered under current law (PROTECT ACT) "child porn" even though there are NO actual people involved and NO PICTURES AT ALL as the ongoing prosecution of Red Rose clearly shows.

In each province, there is a Film Classification Board. They set the ratings (ie equivalents to G, PG, PG-13, R, NC-17) for each film shown in movie theatres in that particular province, based on local standards. In addition, they approve DVDs and (in the old days), VHS tapes to be rented in video stores. In the case of adult videos, they can and do demand that material they find offensive be cut out, or they will not permit that video to be legally distributed.
In most places, they hire a bunch of 20-something film students to review the adult movies, so generally not too much gets cut (unless you're Max Hardcore), but some of the results are wildly inconsistent, and highly irritating if you want to see the proper version.

And Canadian porn channels on satellite are a lot more liberal with what they show than American porn channels. I'm surprised they won't show fisting.

My canadian distributors have no problems with fisting. The only thing that seems to get rejected is Pissing Scenes. You can pee on the ground or in a toilet or anything to that nature. But peeing on a person is a big no-no for the film boards. Unless you live in Alberta where there is no film board of course.

Yeah, but Evil Angel doesn't usually have storylines, which is what we were talking about.
That is lame to hear, but I think Evil Angel will have a much better chance than JM on getting off (JM got off on a technicality, not on actual substance, that is why 5 Star was left holding the bag).
I wonder what films they're going after EA on? The 'squirting' films? Jake Malone or Belladonna? She-males? What do they think will get them a conviction?

Yes they do. WHile the majority are NOT like the BItchcraft series with a cohesive plotline through the enture film, most all have the very lame and very very very very overused "never successful guy who has the lamest job gets to successfully pick up the beautiful girl" scenario but there ARE storylines.
And again even if the film was to pass the SLAPS test, that is still NO PROTECTION to the locale state which like Tennesse has SPECIFIC laws that prohibit things like fisting and vampism fetish films (showing tomato juice) and other so-called "extreme acts", really even base sex.
We should find out by the end of the week.
BUT just like Five Star AND Extreme and several others, the prosecution does NOT have to specify any particular act or situation that said offending product has within that jurisidction.
THAT intentional vagueness is the key problem with the obscenity laws as they stand for any producer can hauled in to a community that said producer has never even be in before for anything and the prosecutors do NOT have to specify in any detail and leave the matter in generic terms of " 'the matter in question' violates the obscenity standards of this community"
