This is not to give a socially licensed acceptance to adults fucking minors, however, when you bring punitivity into the equation you are giving a sense of ammunition to the social no that I don't think is needed or even works. In regards to the age spread, it's not that big if you compare it to age gaps as a whole which can be much bigger within legal bounds. What's 7 years to 3 years so long as sexual activity is at least biologically possible? What about a 20 and a 34 spread? I can certainly understand the drug aspect as being disturbing though even there, abuse has to be actual abuse in my eyes. Numerous kids that age take drugs and alcohol whether we like it or not. Dogs on the other hand have no capacity to take drugs, in that regard the abuse and cruelty charge makes more sense. Your point on the liberal minority of countries that partially agree with my position is not a demonstration of impracticality, it simply shows that people have a conservative paternalistic bias towards minors and sex. The Netherlands is one of the best countries in the world by various barometers. Marsha and company do not seem like good people that I would positively defend on this issue, however, what they did while undesirable is not pathological or forceful and is partially legal in some parts of the world(usually minus the drug part). Unless you are taking about someone on the rape or murder continuum I really see no need to put these people in jail for any length of time. In terms of closed court cases that argument goes both ways. I'm willing to bet you will find minors who say they were not personally victimized meaning their victim status is purely statutory. My view on whether someone should be punished or not is contingent on whether there was actually a corporeal victim who wants some type of justice. These minors may simply be told they are victims based strictly on law. If you remember the Mary K Letourneau case, Vili Fualaau is the ultimate example of a non, purely statutory, victim. I at least keep these kind of things in mind especially given that punishing people is time and money. [Link] |
