Everything goes in cycles, Porn was more corrupt so to say and underground in the 70's and 80's. You can't be a manager at Wal-Mart and show portfollios of strippers without being reprimanded. Their harrassment policy is very clear. If you talked about this shit outside of work that may be one thing. But even during your lunch break, busting out photos of strippers around someone who finds it offensive will get you in trouble if they tell the store manager.
Eric, if people in the industry are complaining about the threats of censhorship and more regulation. Do you just think this sentiment is comming from a few white men in ties in Washington. People got serious problems with Bush porn policy because they interpret as indirect means of censorship.
Actually, there are still people who get arrested for producing porn. Case in point in Florida. Hopefully it is an abberration. But if you think our culture is all embracing of porn and all embracing of free expression of porn, you are sadly mistaken.
The motive is that these people exist and threaten our industry as a culture. Simply ignoring their attacks waged upon the industry won't make them go away and in fact completely blowing them off may reverse the free expression privilges we have.
Trust me dude, there are some states that still ban watching porn and there are other states who find other ways to make sure adult shops don't get built.
AT some Wal-Marts, they can and will if they follow a strict interpreation of the sexual harrasment policy and image code. Trust me if I started to talk about porn stars on break and some dude find porn offensive, he could go to my supervisor. And they would probably give me a talking. That is why no male/female manager with any sense brings penthouse magazine for their friends to see. Penthouse magazine doesn't show nudity on its cover. Obviously you do not stand there and say "hey look at this" if in a conversation like it has with me, someone mentions about the strip club down the street from us and I say "Ya I used to be a DJ there years back" and then the conversation flows. I mention that back in the 90's the weekly feature dancer would be a XXX Star and then questions ensue and I I say I got a photo album with a polorid of me and each star. Also you work with people you know what they think. My 3 managers are quite cool. One who is the Ass't Mgr I worked with 16 years ago when I got into this business in another company. The other Ass't Mgr is a young guy in his late 20's and I have gone for drinks with him numerous times. My Manager she is easy going, and she knows why I am going to Vegas as she was told and she laughed and said it should make the Vegas experience even more fun and worthwhile. None of our conversations at work are in detail of porn, just talk about who is who nowadays, how the studios work etc. Nothing about what scenes and stuff. Mind you I am Unionized so that makes it a bit better. Wal-Mart they treat thier employees unfairly. As long as you are not being deatil about something sexual and showing all like a seminar "Here are my pics" nothing can be done technically. I just use common sense. Mid you where i work, the crew of people I work with, we are all pigs.

I work in retail and what is funny is me and a couple of co-workers were chatting away while we worked and we were talking about hot female celebs and I said Jenna Jameson, and a customer says "Sorry to bud in here but you got good taste, Jenna is a the hot blonde babe in my books..have a great day guys" LOL Was quite funny. I definitely respect my co-workers and don't say things i know they will get all bent about. But the shift I work, the crew of people i work with..ya we are pigs for sure. And add in 2 of our managers, they are the same. Yes, I agree that showing ANYTHING to anyone on a jobsite that they might consider offensive is against MOST company's policies. However, to reprimand an employee for the simple act of associating yourself with the adult industry, or anyone in that industry...that's against the law.
As a matter of fact, alot of the "cons" to the porn industry appear to be Bible-thumper who feel that the adult world (and many other "offensive" industries / hobbies that people enjoy) can NOT co-mingle with their following, and therefore distance themselves from it as far as they can. That's fine, just don't take that right from everyone else.
Much alike the argument about what we listen to on the radio...if you don't like it, turn it the fuck off...don't feel compelled to take that right away from others who do enjoy it. As for "the children", be a responsible parent and keep them away from it, rather than "ridding society" of it.
For some reason, I don't think it's against the law in FL to produce porn. I could be wrong, but a fair makeup of the East Coast adult industry thrives here. States like Arkansas, however...that's different. I know you can't distribute porn in that state.
The problem with "our culture" is that people can't mind their own business, and take responsibility for their own lives. They need to "clean up society" from such "dangers" as porn.
Thankfully, the Constitution still protects crappy lil' local laws from generalizations. Much like the industry I work for (the railroad), many lil' local laws don't mean a damn thing...thankfully.

You can NOT be fired for associating with something perfectly legal (ie: porn) outside of duty hours at your job. If you believe otherwise, talk to an FELA lawyer.

Yes, but any company who terminates you, must have a valid reason to do so, unless it was stated in the guidelines of temporary employ which you "may have" hired under. It's quite different where if a company does not HIRE you, they do not need to give a reason.
Since you're such an expert on the matter, whip open the labor books & prove me wrong. Trust me, I've been through alot more in the "employer -v- employee dept." than you've dreamt of. I'm also in an industry where contracts get violated all the time.
Nowhere is what I said anything like the spatter which you barfed up below. "Beating up an employer in the parking lot" is considered assault, and therefore punishable by civil & criminal penalties, aside of likely getting shit-canned at your job.
As long as the S&M didn't involve rape, torture or other illegal activities, there is nothing that can be done to that employee outside of his job. If you know someone who has been fired, and hasn't taken civil action against their employer for privacy violation laws - then f'n shame on them. A company CAN fire you if you're involved in ANY felonious activity inside/outside of the job...BDSM hardly qualifies. Oh yeah, my company gives me that line of shit when they pay for the hotel they force me to stay in (when I'm only 50 miles from home). They pay all thier employees crap, minimal wage increases, hire illegal immigrants for cleaning and then lay blame on the company they contracted out to do the cleaning, intimidate the employees, use employee ignorance to screw with them, fire people who want to start a union or intimidate them when they want to organize the union for the store. If they get Unionized like 2 stores in Canada had, they decide to close the stores so that the Union is out. These corporate greedy pricks will shut down other businesses and that way they can keep thier wages low...it is bringing down the wages in the retail industry because of all this. If they would pay thier employees full and part time, a decent wage then everything would be ok, but come on you cannot say they pay anyone other than thier managers, decent. Get a 2nd job while working there to supplement your income, they will then conflict your schedules so you gotta pick one part time job over the other. Seen it with many people here in Canada.

Explain to me why this officer was fired for doing a activity outside of work and why he lost the lawsuit you are so certain he would win. You assured us by your legal knowledge that no employer can fire you for your extracurricular activies without a lawsuit and the defendant winning the laws suit. The city of San Diego (City), a petitioner here, terminated a police officer, respondent, for selling videotapes he made and for related activity. The tapes showed the respondent engaging in sexually explicit acts. Respondent brought suit alleging, among other things, that the termination violated his First and Fourteenth Amendment rights to freedom of speech. The United States District Court for the Southern District of California granted summary judgment to the City. The Court of Appeals for the Ninth Circuit reversed.
The petition for a writ of certiorari is granted, and the judgment of the Court of Appeals is reversed.

Respondent John Roe, a San Diego police officer, made a video showing himself stripping off a police uniform and masturbating. He sold the video on the adults-only section of eBay, the popular online auction site. His user name was "Codestud3@aol.com," a word play on a high priority police radio call. 356 F. 3d 1108, 1110 (CA9 2004). The uniform apparently was not the specific uniform worn by the San Diego police, but it was clearly identifiable as a police uniform. Roe also sold custom videos, as well as police equipment, including official uniforms of the San Diego Police Department (SDPD), and various other items such as men's underwear. Roe's eBay user profile identified him as employed in the field of law enforcement.
Roe's supervisor, a police sergeant, discovered Roe's activities when, while on eBay, he came across an official SDPD police uniform for sale offered by an individual with the username "Codestud3@aol.com." He searched for other items Codestud3 offered and discovered listings for Roe's videos depicting the objectionable material. Recognizing Roe's picture, the sergeant printed images of certain of Roe's offerings and shared them with others in Roe's chain of command, including a police captain. The captain notified theSDPD's internal affairs department, which began an inve stigation. In response to a request by an undercover officer, Roe produced a custom video. It showed Roe, again in police uniform, issuing a traffic citation but revoking it after undoing the uniform and masturbating.
The investigation revealed that Roe's conduct violated specific SDPD policies, including conduct unbecoming of an officer, outside employment, and immoral conduct. When confronted, Roe admitted to selling the videos and police paraphernalia. The SDPD ordered Roe to "cease displaying, manufacturing, distributing or selling any sexually explicit materials or engaging in any similar behaviors, via the internet, U. S. Mail, commercial vendors or distributors, or any other medium available to the public." 356 F. 3d, at 1111 (internal quotation marks omitted). Although Roe removed some of the items he had offered for sale, he did not change his seller's profile, which described the first two videos he had produced and listed their prices as well as the prices for custom videos. After discovering Roe's failure to follow its orders, the SDPD--citing Roe for the added violation of disobedience of lawful orders--began termination proceedings. The proceedings resulted in Roe's dismissal from the police force.
Roe brought suit in the District Court pursuant to Rev. Stat. §1979, 42 U. S. C. §1983, alleging that the employment termination violated his First Amendment right to free speech. In granting summary judgment to the City, the District Court decided that Roe had not demonstrated that selling official police uniforms and producing, marketing, and selling sexually explicit videos for profit qualified as expression relating to a matter of "public concern" under this Court's decision in Connick v. Myers, 461 U. S. 138 (1983).
In reversing, the Court of Appeals held Roe's conduct fell within the protected category of citizen commentary on matters of public concern. Central to the Court of Appeals' conclusion was that Roe's expression was not an internal workplace grievance, took place while he was off-duty and away from his employer's premises, and was unrelated to his employment. 356 F. 3d, at 1110, 1113-1114.

A government employee does not relinquish all First Amendment rights otherwise enjoyed by citizens just by reason of his or her employment. See, e.g., Keyishian v. Board of Regents of Univ. of State of N. Y., 385 U. S. 589, 605-606 (1967). On the other hand, a governmental employer may impose certain restraints on the speech of its employees, restraints that would be unconstitutional if applied to the general public. The Court has recognized the right of employees to speak on matters of public concern, typically matters concerning government policies that are of interest to the public at large, a subject on which public employees are uniquely qualified to comment. See Connick, supra; Pickering v. Board of Ed. of Township High School Dist. 205, Will Cty., 391 U. S. 563 (1968). Outside of this category, the Court has held that when government employees speak or write on their own time on topics unrelated to their employment, the speech can have First Amendment protection, absent some governmental justification "far stronger than mere speculation" in regulating it. United States v. Treasury Employees, 513 U. S. 454, 465, 475 (1995) (NTEU). We have little difficulty in concluding that the City was not barred from terminating Roe under either line of cases.
