To respond to the OP's question I'm not sure what will be next but one thing I definitely think should make a return to porn is the hardcore anal type of porn that was produced in the US from around 2001 - 2006. Credit card companies have nothing to do with it. Years ago, there were a few pissing sites around like PissMops, YellowDiscipline, Kink's pissing site, and the stuff Max Hardcore produced. Anybody who wanted access to these sites had no problem getting it. The sole reason that all these sites disappeared was, as you pointed out, the entire porn industry got scared of producing anything "extreme" anymore in light of the obscenity conviction of Max Hardcore, who was basically doing everything that was considered taboo in porn. His scenes combined pissing, rape fantasy, and pedo play (adult women pretending to be underage, which is legal) all in one. Despite the fact that nothing he produced was illegal, he ended up going to jail anyway simply because he was a controversial figure who made people uncomfortable and his movies pushed the envelope. When that happened, no one else in porn wanted the same thing to happen to them. Hence, porn became a lot more tame and vanilla, and all the extreme niche porn that we used to see more of has since disappeared. Not to mention piracy and decreased porn production in general have also made it more unlikely to see these things in porn. The credit card thing is just a convenient excuse so companies like Brazzers won't have to take responsibility for their own decisions. Brazzers had even acknowledged that the PornstarsPunishment site was its most profitable site. However, it was also controversial due to all the whiners and handwringers who take porn too seriously, and complained that the site "promoted rape." Since Brazzers didn't want to deal with the controversy anymore, it just got rid of the site. If porn companies still wanted to do it, then they would do it.

^I remember that Clinton signed a bill into law, the CPPA it was called I think, that made it illegal for adults to imitate minors in the depiction of sexually explicit situations in any form of media. I only remember this because the makers of the '90s remake of Lolita spoke at length of the cuts they had to make to scenes in that film featuring a body double in order to comply with what at that time was a new law. Anyway, I'm pretty sure that the CPPA was overturned by the courts over a decade ago and no longer applies, but maybe there are similar laws on the books. Performers in Max Hardcore's videos were dressed to look like young teenagers and directed to act like young teenagers, but in the videos he always had them state that they were at least 18. ^Yes, you're right. The Supreme Court struck down CPPA. As a matter of fact, this is why Max Hardcore couldn't be charged with producing child porn. There was an attempt to prosecute Max Hardcore for child pornography, but the case ended up being dismissed due to the fact that, by legal definition, it was not child porn. It was like trying to charge someone for murder because the living victim is pretending to be dead. Child porn only applies to porn involving real minors, not adults acting in role play. Due to the fact that the Supreme Court ruled that something cannot be labeled child porn that doesn't actually involve real children, the child porn case against Max was dismissed. However, this was before his prosecution for obscenity, which is a much more ambiguous charge, and can literally be made to apply to anything from kissing to blowjobs. The law doesn't even have to specify why something is obscene, which is why it's a stupid law. After the child porn charges were unsuccessful, they went against him for just the vague charge of obscenity, which was successful, unfortunately. Since they couldn't get him for any real crimes, they had come up with something.
I'm not familiar with any such disclaimer as I never saw it. But yes, it is legal. Again, it is only illegal for anyone under the age of 18 to be in porn. As long as the performers are legal adults, that's all that matters. Just because people are unreasonably hysterical over something doesn't make it illegal.

This is exactly true. Unfortunately, there are a lot of people even in the porn industry who just don't get that point.

Since you're saying that credit card companies have the discretion not to allow payments to go through for sites if "they don't like your content," then what's to keep credit card companies from allowing transactions for porn site subscriptions at all? Certainly, if this is the case, then porn sites must have a back-up plan. Maybe I'm just skeptical, but I also find it odd how this credit card issue only came up after the porn industry ran the gamut of all the other reasons it was no longer producing certain types of porn. First, the reason was that porn couldn't produce XYZ anymore due to legal ramifications. That reason was debateable. So the next reason was that producing XYZ wasn't profitable due to not having a large enough audience. That claim was also brought into question. Now the claim is that porn can't produce XYZ because the credit card companies don't like it, even though they apparently never had a problem with it before, and there are still a couple of sites around that produce extreme content and don't have a problem with credit card subscriptions.
