There is no federal law banning scat. It can fall foul of obscenity law though. The problem is that when brought before a jury in an obscenity trial, the jury has to apply the Miller test to determine if it constitutes obscenity, and I am not aware of a trial involving scat in which a jury has let it pass. So, you know that if scat goes to trial for obscenity, you are probably screwed. However, it is a new decision by the jury in each case, and if a jury decided to let it pass, then that particular scat content would be legal. [Link] |
