Case in point, a girlfriend of mind made it through 3 screening sessions for the OJ jury. The judge spent 5 minutes telling everyone that this case was about his theft trial and should not be considered a payback opportunity for his murder trial acquittal. Your second sentence eliminates everyone, so what would be the purpose of a jury trial? [Link]

The judge has to balance whether the probative value of the evidence would be outweighed by the prejudicial effect it might have; it's a no-brainer here: none of it has any probative value to the issue of whether she was driving while intoxicated. The only reason the prosecutor would want to try to get any of that in would be to try to prejudice the jury against Bree. (If, however, the prosecutor can show some connection between Bree's occupation and the alleged DUI, then the evidence might come in. If, for example, she was in town doing a feature dancing gig, and employees of the club are prepared to testify that she was drinking like a fish all night long and that by closing time she was slurring her speech, staggering around, etc., before she got in her car and drove away, that's probably going to come in. But that still isn't going to open the door to talking about Charlie Sheen, unless she brought him with her that night to take Polaroids and clean the poles before her sets. Several months ago she asked on Twitter if her fans would prefer her with bush or clean-shaven. I'm guessing the majority said they wanted bush, and I know I did. Clean-shaven is boring, and bush is always better.
