That wouldn't surprise me, especially since the porn biz apparently doesn't pay for health coverage (at least in Teagan's case). I don't imagine that any sort of contract or waiver would keep away the ambulance chasers when they get going on the "personal injury" angle.

Actually it would be considered work comp and you are correct, no waiver will protect any producer/studio here in California. If the girl suffers an serious anal injury she might be considered 100% disabled under California law.

I'm not a lawyer, but I'm curious: Isn't the porn industry setting itself up for major liability problems in the future? I'm thinking about these things:
- Intent to cause harm (criminal liability?)
- Personal injury (civil liability)
- Class actions
Does consent in the porn business waive all liability, even for activities which cause harm? If so, then why so? Other industries in the U.S. have federal safety regulations pertaining to workplace injuries[1][2]. I assume that these don't apply to pornstars unless they're considered employees...
1. Willful - A violation that the employer intentionally and knowingly commits.
2. Serious - A violation where there is substantial probability that death or serious physical harm could result and that the employer knew, or should have known, of the hazard.

Yes, it is. But in terms of litigation as well as regulation.
Work Comp injury litigation is unlike PI, at least in Cali. There has been a liberal bent towards finding most work place injuries to be work related. The standard is not high and an injured worker need not show negligence by the employer. Usually just the existence of an injury is enough.
On the other hand, punitive damages and big verdicts rarely happen in work comp injuries.
Easy to prove and attach liability = less monetary damages.
Serious & Willful are very difficult standards to meet in work comp. And it doesnt matter if the person consented to it, or signed any so called 'waiver' at the time of the shoot. There is no such thing as any legal 'waiver' that circumvents the law or allows any company or employee to give up their legal rights. I agree with you in that the potential for serious injury is there. However, you should avoid prejudicial language: suggesting that anyone who disagrees with your assertion would be unreasonable. That's a logical fallacy.
Doesn't that depend on the specific circumstances? DAP can be injurious[1], so you have to consider how careful those involved are. My opinion is that many porn directors are not being gentle enough as far as anal insertive activities go. I think we both agree that liability is going to be an issue in the future as a result.
Anyway, extreme anal insertions -- which include fisting and DAP -- are undeniably very risky (moreso than the already high-risk "vanilla" anal intercourse). There can be serious consequences, such as potentially fatal rectal perforation[2].

It seems to me as a (non-practicing) lawyer that the big problem with pursuing porn lawsuits is that the producers don't have any money. Maybe Vivid has deep pockets, but I don't see any of the Gonzo houses where most of the hard anal is produced having money worth going after.
Let's say you get someone who is found to be 100% disabled. Who is going to pay? I doubt these producers have insurance worth an damn. The studios seem to be broke. Maybe you can pierce the corporate veil, although that seems unlikely to me, and go after the owners. Even if you were to be successful doing that, how many owners have the kind of money worth pursuing?
These types of claims seem impressive when you are discussing the damages, but I don't see them continuing to be impressive once you start discussing recovery.
In fact, I would guess this very problem is why we haven't heard of any suits so far.

Not true. There was a recent decision involving a HIV+ performer. The Work Comp Board determined that the performer was an employee and was 100% permanently disabled. The award was made against California's Uninsured Employer's Fund and will be paid by a combination of California tax payers and businesses.
The UEF will go after the business owners in an attempt to collect on the outstanding, for a better word - "judgement." But it is unlikely to be fully repaid. Estimated cost of an HIV claim over the course of a performer's life could be well in excess of $1 mil.
The money is there, it just belongs to the tax payers.

I didn't mean to turn this into a law discussion; I won't be pursuing any legal avenues any time soon. I'm primarily concerned about the medical issues, because women are being pressured to have anal sex due to porn[1][2][3]. As a result, I think that porn directors--and not potentially innocent tax payers--should be held accountable for their promotion of anal sex done wrong*, among other activities. Additionally, anoreceptive pornstars should take responsibility for their choices, since they may influence impressionable viewers (some are even underage[4], as I was when I began viewing porn circa 1993).
Nothing should be done about people doing risky things in their own bedrooms, though; that's their business. Still, everyone should know about the risks involved so that informed decisions can be made. This doesn't appear to be the case very often; desensitizing creams seem to be popular, for one thing. There is also plenty of anecdotal evidence online that receptive people are experiencing problems as a result of anal sex, and some of them are too embarrassed to see a doctor.
On the other hand, something can and should be done about porn directors causing harm to women via anal insertive activities. If existing safety regulations aren't adequate, then more may be necessary. Of course, it's possible that some existing ones aren't being enforced (looking at the OSHA list, the "Other" category[5] seems very pertinent).
Anoreceptive pornstars are definitely in a bad situation without health coverage, too. I can't find any public medical studies relating to the effects of repeated and rough anal insertions, but going by what I've seen, cumulative trauma that builds up over time certainly can lead to rather unpleasant problems.

Spend any time in any emergency room in the valley(st.Joesephs Hospital, Northridge Hosp.) and see how many girls are getting their rectums stiched up EVERY WEEK. LOts of jobs carry inherent risks, and it is the duty of the EMPLOYER to minimize those risks, not the employee. If I hire someone to do DA, then it is my responsibility what happens on my set.
HIV and rectal tearing would definately qualify as 'serious' and because EVERYONE in the buissneknows that injuries occur regularly while performing these 'stunt' acts, the 'willful' standard is easily met.

just a side note regarding all these intervies with porn girls who say they LOVE anal sex. A few weeks ago on HOward Stern they did a 'gameshow" with a bunch of porn stars.(FAMILY FEUD) The first question was what do you NOT like doing in porn. With all due respect, until you say otherwise, I will assume you are a layman. I am not and have practiced law within the specialty of work place injuries for more than a decade.
You are simply wrong. Serious and willful is a standard that is not easily met.
Based upon your logic and reasoning every and any work place injury could be considered "serious and willful."
Based upon your logic.....
Having a secretary type could be considered "serious and willful" since it causes carpal tunnel if performed improperly.
Working in a warehouse lifting items could be considered "serious and willful" since lifting a heavy box could cause a disc injury.
The standard is almost a criminal type of behavior where the employer is CERTAIN that injury will occur.
It cannot be that injury CAN occur, it has to be than a injury WILL occur.
Or if someone can show prior Cal-OSHA violations for the same type of injury from the same act, then the employer is on notice. S&W's require a certain mens rea on the part of the employer/supervisor.
The act has to be deliberate and not negligent.

It's true that some women do find receptive anal sex pleasurable. That doesn't make it any less risky, though. Anal sex can potentially be extremely harmful; the tissues involved are much more delicate than the vagina's. Cumulative damage is a major concern, too.
Moreover, men are much more likely to feel pleasure from receptive anal intercourse, since all of us (should) have a prostate which can be stimulated via receptive anal sex.
Could you define injury, please? I would say that damage will occur from anal intercourse which is both painful and rough. However, I'm uncertain as to whether this damage equates to injury in a legal sense.

There's a major difference here. That multi-billion dollar corporation is unlikely to expect you to do anything which has a high probability of harming you. Why do you think that many employers require the ability to "lift up to 40 pounds?" Why 40 pounds specifically? Why is that such a common requirement? My guess is that it's a requirement enforced by regulation, because lifting over 40 pounds frequently and without assistance was determined to be potentially hazardous to the average able-bodied worker's health.
By contrast, the porn industry seems to have no regulations whatsoever pertaining to hazardous anal-insertive activities. That is obvious from the existence of this thread alone. Also, I've been watching porn long enough to have witnessed many anal activities which are, without question, very hazardous from a physical damage standpoint.
"Very hazardous" anal-insertive activities include: Any act which is rough and/or painful, large insertions, fisting, and DAP. The perianal skin, the anus, and the rectum can be injured. The rectal lining is especially delicate. Too, it "does not heal quickly" according to a registered nurse[1], and it is "relatively insensitive to pain" according to a Merck page reviewed by two medical doctors[2]. Physical trauma to any one of those three areas can lead to a variety of unpleasant and potentially chronic (persistent) problems.

I wouldn't bet the farm on that statement. For the most part worker safety is one of the most overlooked areas of Human Resources. I have and still do represent mulit-billion dollar companies that you refer to and I have given countless seminars on improving worker safety in order to reduce costs. Most companies do not see their employees as vital parts of their business plan. The working class is expendable to most companies, especially here in Southern California where there are a plethora of illegal aliens crossing over from Mexico willing to work for less and do more, even lift over 40lbs on a consistent regular basis.
By the way, none of the companies I have ever represented have ever instituted a general lifting restriction. The 40lbs you refer to is a minimum, not a maximum.

I can believe that. What I'm focused on probably is just a small instance of a much greater problem. Yet, hazardous practices outside of public media aren't likely to encourage so many people to emulate them.
Okay. Still, my point remains that the porn industry needs more oversight. Regulation (in the form of safety standards) is the best solution, IMO; treat the cause of the problems to minimize the symptoms.
It seems to me that we're unlikely to see that, though. So, I'll assume the present situation will continue with what appears to be a positive feedback loop*. If Drew Pinsky (among a few other physicians whom I won't mention) is right about long-term consequences, then things could get very ugly. Personal injury lawsuits, tax payer burdens for porn star compensation, etc.
Of course, I may be overestimating affected porn stars.
* More demand for high-risk acts leads to more people--not only pornstars--engaging in them, which in turn feeds the demand. This has been shown to have a "slippery slope" effect amongst some of those with porn addictions, with more extreme content being desired over time. (Note that I am not opposed to more extreme content so long as the activities are harmless.)

I am not just speculating as you say. I am speaking from FIRST hand experience. And yes, "EVERYONE" in the business knows that injuries occur REGULARLY while performing these acts.(up until about 4 weeks ago there was a doctor at ST. JOESEPHS Hosp. in the valleyburbank actually} named DR.Butler. He got the nickname 'DR. BUTT', because of all of the rectal suturing he did on a weekly basis for injured porn girls.)
And of course there are people who enjoy anal sex, but the vast majority of people do NOT engage in these acts, and the vast majority(not all) of porn performers do it ONLY for the money. And very very very few people ever do Double anal outside of the porn industry.
If the porn industry ever wants to considered in the least bit 'legitamate" they have to adrees the issue of workplace safety and work related injuries and illness. A monthly voluntary program that cheks for only HIV and gon/chlam doesnt even come close to addressing all of the issues that porn performers face.
Does anyone here know why VIVID pictures settled the suit bought by Kira Kenner(not sure if spelled correctly), their contract star?(funny thing, in one of the briefs submitted by VIVID they tried to maintain that their contract star, who worked excusively for them, was an independant contractor.)
Aside form alleging 'failure to pay", one of the main parts of the suit alleged that she got an STD while 'working' for VIVID. VIVID settled the suit out of court because they did not want an actual court decision declaring a porn performer an employee. But that all changed last december when Brooke Ashley was declared an employee of the company that whe was working for when she got HIV. As Pornlaw has pointed out several times on this board, like it or not, performers are employees, not independant contractors.
And like it or not, the industry is going to be in for a rude wake up call when girls in this buissness realize they have alot more power now than previous 'generations' of porn stars. These girls are going to soon realize that companies will glady settle out of court, for significant amounts of money. And since 'most' girls are in the industry for less than one year they wont be worried about future employment in the adult industry. They'll get paid more for the settled lawsuit than they would make in that year. (OOPS, i forgot, this is another little industry secret that none of the 'industry' news sites want to talk about, just like they will NEVER talk about what the industry has ever done for any of their HIV infected 'stars'. But maybe that is because their is NOTHING to talk about, because they did ABSOLUTELY NOTHING.)

Don´t misunderstand me, I also love to watch anal scenes, probably for the same reason since regular sex is something I can have in real life. Actually I´m not even into anal sex in my personal sex life, I just like to watch it because it is different and curiosity and imagination are some of the main reasons to watch porn.
What I meant is that people should just wake up and be more reasonable in their requests. Too many seem to forget that a porn actress is a human being like everyone else, when people want to see someone cringe in pain then they should join the BDSM scene or something but please keep certain filthy demands out of mainstream porn.
It should be obvious that a petite woman cannot take someone like Mandingo up the chocolate starfish. If someone loves pain that much he should join the appropriate fetish scene, but not make certain outlandish demands in mainstream porn.
A fine example how bad and unfeeling male actors can ruin an anal scene is Rocco´s Initiaions 1, the scene with Cassandra Wild. Anyone who has seen her other movies knows that she is a sexual powerhouse. But during anal in this scene it was obvious that one of the guys was hurting her and that she hated every second of it. Something like that makes me physically sick, and to demand more such scenes in mainstream porn is misogyny in it´s purest form.
To sum it up: I hope people will be more responsible and reasonable when asking for certain anal sex acts. Don´t go demanding stuff that the human body isn´t made for. This also applies to actresses, actors and directors. A girl who is unexperienced in anal sex shouldnt star in some double-anal-whatever flick, take a minute to think if that paycheck is worth the trouble and the danger to your health. Male talent should be more responsible and keep in mind that anal sex takes a lot more patience, you can´t just rush in and pound away, if you don´t believe me buy a replica of Mandingo´s tool and stick it up your rectum, then you will see. And directors and agents shouldn´t try to talk actresses into doing scenes that they are not made for. There are enough anal acrobats like Sandra Romain or Belladonna around who are better suited for certain scenes than a new and inexperienced face.

Totally ,but right now porn is such an age game that I hate to play and I'm stepping back a bit. I've seen a 'porn blooper' just like that... probably you (shot from behind, don't think it showed any faces). It was quite shocking. I can think of it happening when amateurs go at it, but a male performer should be a little more skilled imo. I believe he apologized though...

@chodemaster: It's ok your not prying.I am an EMT and drove an amubluance up until a few months ago,I resigned because I want to be able to come back to a department after I've completed my paramedic.Porn as entertainment is widely accepted by my former co-workers , however for someone to be a porn performer is not accepted, especially for females.I now work with the agency I am represented by,not just as talent.The funny thing is once you are exposed to an industry where no one wears uniforms,the structure is laid back,and the people are so easy to get along with,it's very hard to want to go to a 9-5 where you constantly have to watch your P's and Q's.It's funny how your whole pursuit of happiness changes as you learn more and more to catch a case of " fuck it, this is who I am" .
