RANCHO CUCAMONGA, Calif. - Over six months after adult performer Mercedes Carrera and her husband Jason Whitney were arrested at their home in Rancho Cucamonga and charged with sexual assault against a minor and guns and drugs violations, a preliminary hearing is being held at the Rancho Cucamonga court to decide if there was enough "probable cause" evidence to initiate a trial.

RANCHO CUCAMONGA, Calif.-Mercedes Carrera and her partner Damon Cins sat in a San Bernardino County courtroom Thursday morning, as a prosecutor played an audio recording of the preteen girl they are accused of sexually abusing describe the alleged abuse in graphic detail. In an earlier public statement reported by AVN.com, Carrera said that the alleged victim is her nine-year-old daughter.
Carrerra and Cins have denied the allegations, but in audio recorded in January by San Bernardino Sheriff's Deputy Steven Theis-who had been called by the nine-year-old's father-the girl gave graphic descriptions of sexual acts, which she referred to as "cuddle" sessions, which she told Theis were performed on her by her mother and Cins.

And here I thought is that they recorded stuff whilsts she was in the house. This sounds horrible. Is there something else to this story I'm missing? There's a skeptic in me which questions whether there is something the girl possibly gains? I'm in disbelief really, is this story that straightforwardly terrible.
RANCHO CUCAMONGA, Calif.-After an all-day preliminary hearing in San Bernardino Superior Court on Thursday that centered around a graphic and dramatic audio recording of a nine-year-old girl describing her alleged sexual abuse at the hands of Mercedes Carrera and her partner Daemon Cins, Judge Ingrid Adamson Uhler ruled that there was enough evidence for the county to take the case to a jury trial.
Uhler dismissed two firearms charges against the couple, but held Carrera and Cins to answer for 16 counts, including multiple incidents of oral copulation as well as sexual penetration.
This is all based on the girl's testimony , on a court it could be different , I'm not saying she's innocent I don't know that, but the girl could have been instructed by her father or maybe even telling the truth but there is a total misinterpretation of the facts.
In Italy there was case in a way similar a grup of kids told their parents the teacher "touched" them and one especially in the ass , the parents kept talking with their kids for over a month with a psychologist to amass evidence then they called the police , they arrested that teacher and a few other people possibly involved .In the prealiminary hearing the judge heard the psychologist with her hearing with the kids she taped along with their parents. Among the questions were did she touch you? Yes Where did she touch you? Here indicating her ass.
Enough for a trial on many accounts for an entire bunch of teachers and a couple janitors for being passive when such things occurred in front of them.
Though in the trial the Police brought in the tapes of the surveillance cameras of the school , from the day the kids said they were abused and they found out that the teacher separated two kids who were arguing and "hit" very softly although firmly one of them in the back to push him away , nothing else happened , the janitor was there too , all the tapes showed similar situations there was absolutely nothing sexually related.
Aparently all the adults misinterpreted the touching , being afraid of abuse they literally didn't think about anything else and by interrogating the kids themselves they influenced them and they kept saying what made their parents happy , the psychologist was biased because she was always the same one questoning and interviewing the kids whereas the law requires one different psychologist per kid so that he/she cannot be influenced by the "matching" versions coming from parents and kids talking to each other , furthermore it is part of the psychologist job to try to separate fantasy from truth with especially designed question and find out if the kid has been influenced or not.
This didn't happen , even if there were actually abuses they messed up with evidence so bad it was useless and would have been very easily challenged by any lawyer, so the Judge dismissed the case.
I don't know what really happened here in the case of Mercedes , nor I know what are the requirements of the American laws in such cases about who actually questioned her kid , I assume they have been careful with this , but still a hearing is not a proper trial.

I suspect like me you also think the other shoe has yet to drop. I find it hard to believe somebody who has such an outlet for their sexuality is capable of this. We'll see.
That's basically the same as saying "that guy is too hot to feel the need to rape anyone," a misguided idea that has been proven incorrect time and time again.
I don't know what the outcome of this case will be nor who has done what. Like LCF, I am reminded of other cases where one parent manipulates a child to say things about the other parent. But, I am assuming such things are rare and I am inclined not to doubt a nine-year-old providing explicit details of abuse to a courtroom of people. Still, the case has a lot of ambiguous and complex elements. I hope justice is served one way or another and the child's wellbeing is a priority.
On the topic of manipulating children in sex abuse cases, look no farther than day-care sex-abuse hysteria which swept the US in the 80s and early 90s.
And I as I've said before, I have no idea if Mercedes is guilty of the charges or not. That will be up to a jury (or judge if that is what she wants) to decide. Hopefully however the trial goes, the outcome is the right one based on the evidence.

I think the case against her is extremely weak, why else would you delay the trial FOUR times now?? I mean let's be realistic here, if we're talking your garden variety hoodlum - they would have had the trial ages ago and he'd be up the creek permanently. I do think the state has a serious grudge against her or him and they are trying to make an example out of her for some reason.
Kalief Browder sat in Rikers for 3 years for allegedly stealing a backpack (the evidence was shoddy) before the charges were eventually dropped because of said lack of evidence.
it often takes years to prosecute people who are clearly guilty, like the 4 years between when Martha Stewart was suspected. and then the nearly year wait between her arrest and trial.
"A pretrial hearing in the Mercedes Carrera case has been postponed once again. The newly rescheduled date of May 1 pushes the start of the actual trial to sometime before July 1."
The right to a speedy trial seems to have long gone out the window. I'd bet that it will get delayed at least once more, and 2+ would not be a surprise.
Obviously some cases do take years to prepare because they are just that complex (Bernie Madoff, major terrorism case, massive corporate fraud, etc.), but most should be ready to with a year. Even the most backed up labs do not take 2+ years to run DNA if it is part of the evidence.
This latest delay was requested by the defense, not the prosecution. It's a standard defense tactic to delay hearings as long as possible then ask for a dismissal because of 6th amendment complaints.
There's an excellent documentary about the McMartin preschool abuse case witch-hunt on Oxygen network. Incompetent and overzealous amateur investigators goaded kids into making false accusations against PS teacher's and staff. I think that the DA would be pretty stupid to continue with charges without hard evidence against MC. I think she's is going down.
The delay seems to be that she appears to have a crappy, overworked public defender rather than the prosecution stalling-last year he said he had just got done with a long case & thus he needed time to prepare for hers, the guy has a private lawyer-so assume he is quite a bit wealthier than she is. We will have no idea what they have found on their computers/devices or what witnesses they have until it goes to trial-I find it hard to believe that a judge would set bail at 2 million if there wasn't some solid evidence of something serious, maybe in some small town somewhere, but not in California.

We don't have enough info to know what the evidence against her and her partner really is at this point but I can tell you I once watched one of her videos on YT and the claims on here that she was 'conservative' in her politics are horseshit, she was completely unhinged and ranting, slut-shaming, seriously paranoid, obsessively accusing others of being pedophiles and other completely crazy shit.
The smear against the ex-husband as a 'fundamentalist christian' is ironic as her 'views' are so extreme they make most fundamentalists sound moderate in comparison.
That they found meth in the house is far from surprising.
No word on why this latest delay took place. Some of the previous delays were asked for by her attorney, some by district attorney, some due to COVID-19. The pretrial hearing is now set for Aug 20th.
Wow, they will have been in jail for nearly 2 years already, maybe more, when this trial starts. If they had indisputable proof that they were innocent, wouldn't this have moved along by now?
Her whole defense it that it was a conspiracy between her ex-husband and daughter, if I'm not wrong? If it's straight up just a kid says/they say, they're going to lose. I don't know how it could possibly take 2 years to formulate a winning defense. This look dire for them.

The fact that she has been incarcerated for this long with no trial to me suggests that the evidence and the case against her is extremely weak. Why wait this long? I mean let's be realistic, normally a case like this would be over and done with but they keep postponing because they don't have enough to really put the screws to her.
I don't understand why she & presumably him haven't been able to get out on bail under house arrest rules, with no minors allowed on their properties etc-which is pretty much life now anyway. This is hardly the speedy trial set out in the US constitution.
^ I'd put it down to money. On a per head cost, I reckon it's less expensive to keep them incarcerated than to enforce their house arrest. Is it also not often the case that bail is set high because of the high perceived flight risk, especially as they are in California?
It may be the case that a defendant is constitutionally entitled to a speedy trial but that is not an absolute. If the effects of the pandemic disrupt the processing of evidence or giving the best chance of making witnesses available, I guess that could be just cause for a judge to delay the pretrial. Unless the document indicates an objection from Carrera's lawyer against the postponement, I'm not sure there's a compelling argument from her (and husband's) side that a trial/pretrial has been delayed without cause. Remember that bail has not been denied by the judge either.
