FWIW, I don't believe Nikki ever intended to file a police report and/or press charges.

^ I think he means most of the time the woman is telling the truth. False accusations are usually no more than 2-6% of cases I've read.

Well, to the previous point about history being on women's side, it may not only be true that, as others here have interpreted that to mean, the accusations are almost never proven false, but also that women are almost always believed.
Let's set aside stories of famed people none of us personally know, and consider that with rape being purportedly as common as it is, according to the currently cited statistics by activists (which I've seen fluctuate and vary by definition from 1 in 4 women are raped, to 1 in 4 are sexually assaulted, not necessarily raped, to 1 in 5 are sexually assaulted, not raped, to about 1 in 50 are raped), even if it was only half or a quarter as common in actuality as the lowest estimated rate, it always goes without saying it's still too common, whether it is 1 in 10 or 1 in 100. It remains a fact that most of us probably know at least one woman who has been sexually assaulted, if not raped. The pressing question of doubt coming from skeptics is strange to me, because just speaking from my own experience and thinking of the all the females I've known, including friends and family, I cannot imagine doubting any of them if they claimed they were sexually assaulted, let alone raped.
It is hard for me to imagine what world or what sort of circles one lives in in which more often than not feel they have reasonable doubt about said claims. One thing we do know is the instances of rape must be more common than false accusations being made public. Reports in total, whether true or false, are already so very rare, we have to keep track of them in "per 1,000" statistics. So the false claims must be incredibly rarer still, probably per 100,000.
I guess what I am asking is, how many of you actually know of women personally who you would sooner doubt if they should claim being sexually assaulted, rather than believe? And how could it be that those women you doubt would outnumber those you believe? It just seems incredible to me. If I think of all the women I know, I would be inclined to believe them all, or at least I would have to presume they are telling the truth until proven otherwise. Yes, false claims do happen, and in national population of over 330 million, statistically they probably happen every day. But they are roughly outnumbered by actual attacks roughly 100:1.
TL;DR
I just want to know how many of you honestly feel in your experience you know women you'd sooner doubt than believe, and just how common this could be. Think about the women in your family and extended family. Wouldn't you sooner believe them? So wouldn't it follow that for the vast majority of women who do claim they've been assaulted or raped, that most of the people who know them would naturally take them at their word? Unless it happens that most women who claim being assaulted have no living family members, I would have to assume most are believed or trusted, rather than not.

I think automatically you tend to side with Nikki on this case is because of her history with Brazzers, it was obviously a great relationship for the past decade. There were no problems until this issue. I'm just shocked to hear that there was obvious lack of communication before the actual scene. It just appears to me that Brazzers is trying to alter their product to generate more revenue and the result is that you have new people and talent coming in that a lot of the big name stars are not familiar or comfortable with,

Has Xbiz taken any steps to verify that the video hasn't been edited before they show it? There are third party services that can attempt to make such a determination.

So the choking seems to be corroborated, but the "I said no and they didn't stop" either isn't at all or is still up in the air.
Edit: And truthfully, the choking by itself should have been enough to get him fired, I don't see a reason or place for that especially if he isn't the male performer.

^ As I recall, him choking the girl from behind the camera was one of his schticks in the old scenes he directed. I recall one with Roxy Jezel where he was just directing where he did that. So if it was supposed to be part of the scene I don't see why that would be a fireable offense.
Edit: Remembered the name of the movie it was Sore Throat. If you read the linked review you'll see that there are several instances of Tony T. choking female performers from behind the camera.

Lots of possibilities and facts still to be sorted out here. I imagine she could say stop but it wouldn't be heard very well if she's being choked. And, do they really mean Tony T did the choking? Or did they mean Ramon? Was Tony part of this scene or not? How is there consent to continue depending on her state of apparent disorientation?

I don't know if there was any discussion or agreement beforehand about whether or not or to what extent he would participate in the scene. Apparently he has participated a bit in at least some of the scenes he's directed for Brazzers in the past.

Based on my reading of the interviews and lawsuit document, it looks like some other people they believed defamed them will be added to the lawsuit once their actual not porn names are identified.

It's unclear what is meant exactly by disoriented. Quite often these rough type of scenes are actually aiming for a kind of disoriented, overwhelmed look on the part of the female performers. For example, I remember quite a few scenes back in the day where Roxy Jezel was "choked" and briefly "passed out" during the scene. Whether those instances were genuine or not is anybody's guess of course. But it does show that a perceived level of discombobulation might not be out of place or undesired in these type of scenes.

^Samantha Bentley has a scene called "Game of Holes." Rough scene and it did the suit the scene for her to appear overwhelmed, but a little less than half way into the scene she seemed to be really out of it and in response both the male talent and the director stopped to ask her if she was okay. Even though she smiled and gave the camera a thumbs up they cut anyway before proceeding. I love really rough scenes but the director and male talent need to be on the ball.

Well maybe a good takeaway here would be that, that's fucked up and they shouldn't have that as the goal of a scene.
Maybe that kind of shit shouldn't be part of a scene, because...oh I don't know, maybe because choking is really fucked up and dangerous?
Those instances of 'briefly passing out' were real. It's not anyone's guess at all. They were real... and fucked up and dangerous actually understates it.

^^ That's definitely a valid point of view. I guess my question is, once we step in and start banning practices we personally find to be "fucked up and dangerous" where do we draw the line? The high-velocity style of anal sex that is commonplace in mainstream porn carries an inherent risk of rectal injuries. Ass-to-mouth carries the risk of contracting an infection. And of course the biggie is all the unprotected sex performers are having. Although the testing regime is in place, performers are still putting themselves at risk. And that's only when limiting ourselves to acts that are physically dangerous. If we broaden the scope to include "fucked up" a whole range of scenarios that are commonplace in porn might be on the chopping block.
Porn caters to human fantasies and our fantasies aren't always pretty. Rather than micro-managing which acts and scenarios should be allowed or disallowed, I think making sure the autonomy of porn performers is respected should be our main concern. So long as the principle of informed consent is respected, why not allow performers to make use of their own judgement about what types of risks they're willing to take?

Tookie and Lafage, the problem is just because you may not be into it, doesn't mean there aren't many who very much are. I would wager there are hundreds of thousands if not millions of women who are into choking during sex.
Evidently Nikki Benz isn't one of them, and she found out the hard way she's not into it. But whose fault is that? Was she not briefed on what the scene would entail? What about safe words? There was mention earlier that they cut repeatedly. None of us are qualified to speak on the evidence cuz none of us have seen it, but even if we did get to see it, we still have to wonder what was omitted.
This doesn't mean those guys should be fired unless it can be proven that they deliberately misled her. It seems like it could still go either way. Maybe if more people started speaking up, the way they all came out of the woodwork to take down Deen after Stoya's bombshell tweet, Nikki's case could be stronger. But IDK.
Has she done rough scenes with choking before with no issue? It seems like she didn't know what she was getting into. If these guys really are bad men, it shouldn't be hard mounting a case against them with testimony from other female performers who, with the clout Nikki lends, should not be afraid to speak out.
I've been mainly reserving judgement as best I can waiting for all the info to come out, although probably favoring Nikki's side more than those guys, however now with Tony counter-suing, and with talk about "disoriented" rather than straight up abused, who knows if she experienced black out symptoms or shock causing her to mis-remember? Maybe she was really in a daze, and yes this does speak to the dangers of that kind of behavior. I don't personally condone it so much as tolerate others who are into it, such that they can regulate themselves with consent. But I could certainly agree it is dangerous, especially with less the less experienced being subjected to hardcore repeated choking. But you don't throw the book at those guys if what you really want to do is prohibit choking altogether.

^^^She could have thought it would merely be faux-rough. I regularly see "rough" scenes which are not actually rough but are aimed at giving naïve viewers the impression that rough sex actually took place. Perhaps that's what Nikki expected. That, or perhaps a shoot that leaned pseudo-rough.

Seems like some members are shifting the goalposts now. At first, when Nikki alleged that Tony T. and company didn't stop when she said cut and that she wasn't briefed on the nature of the scene, the issue was lack of consent and a violation of professional values. Now that there is potentially credible evidence in play that Tony T. and company did stop when asked and that Nikki may have consented, the discussion is shifting to, "Why are these types of scenes even allowed at all?" Like I said, that's a valid question but it's getting a bit removed from the central issue that was originally raised: Whether Nikki Benz was raped on set.

Regarding rough scenes, checking in, performance, etc. I don't understand why directors and performers don't routinely demonstrate consent, negotiation, and communication. It would be so easy to leave those parts in or to emphasize them a little (body language that's detectable by a seasoned pro may go unnoticed by your average civilian porn viewer) and wouldn't damage the fantasy in gonzo because there's no illusion or narrative to violate. In fact, I think it would be hot.

^No, at least not in these sorts of scenes. For me, the fantasy of these scenes is to be taken by your sex partner, basically "used", while the kind of negotiation you describe is normal real life for me. I'd be fine with negotiation appearing in the BTS though, and of course it should happen beforehand too.

Well, I'd like to know where "raped" was the "central issue that was originally raised"?
This is what I see as the original issue(s) from the original post:
I don't know all the details yet. Just spotted some disturbing tweets on her timeline. She seems to be airing out Brazzers more than anybody in particular. She has stated that a performer named Tony (who?) stomped on her head and choked her multiple times, during which it seems she said "no."
As to "shifting the goalposts," as the discussion has evolved, many posters have introduced additional speculation and opinions beyond the original post.
Some of us, like me, respond to these as well.
But, really, the only "goalpost" at play here is, was Nikki Benz abused on set and treated inappropriately?

I guess everyone focused on different aspects of those initial claims, but for me the most alarming thing was the claim that Nikki said stop and they didn't.

Any day now. Right after she and her team decide which font makes the "Official Statement" look most official, I'm guessing, and release it to the public.
The "pinned tweet" at the top of her Twitter account since Dec. 20 states:

I found Tony T. unwatchable as a performer and couldn't stand the genre of porn that he was mostly associated with, and I obviously have no idea what went on on the day in question with Nikki Benz. But I'm glad to see that Tony and Ramon have actually responded to this situation like responsible adults, taking advantage of the procedures and remedies made available by our civil justice system.
