FSC statement
"The experience described by Nikki Benz, who says she was choked and stepped on by a director on an adult shoot, are unacceptable in every way. No worker, adult or otherwise, should ever be subjected to physical violence. We are working with the parties, as well as the performer group APAC, to determine what happened on the set, and how we should react as a community. We will update when we have more information."

This came to mind for me, also. Incredibly disturbing.
A couple of people have mentioned abuse and misogyny in connection to Clover, and someone named "Eva" (Angelina?). Can someone provide a link to information regarding that? I'm unfamiliar.

Wow. A lot of depressing reading. And that first thread just goes to show a judge can rule a man guilty, and *still* someone will question whether the woman is telling the truth. I'm opening a beer...

If you read earlier in her timeline before all this blew up, she injured her hand falling on set because she slipped on a wet patch of lube:
Not sure if I should laugh or cry, but the floor on set was full of lube & me wearing nylons, not realizing lube was there = sprained wrist

if you notice in the PR from ZZ, they mention multiple times how they approve/purchase content from producers instead of producing it themselves. yes, we all know where the scenes end up, but good luck suing those cats because they put themselves in the position of being the secondary producer AFTER they've purchased the scene. also, notice how they said a scene like that would most likely never be 'approved'? that's because the legal team would take a look and then discern whether or not it is worth the (potential) hassle of throwing it into their update schedule.
Tony is the producer. Tony takes the tax hit(which is why most ZZ directors re-locate to Nevada to avoid state tax). Tony is responsible. they (ZZ) have this all lined up for scenarios like this should they arise,... one has and now they just wipe their hands because technically, it wasn't their set..
I don't have a dog in this fight as I've never shot Nikki nor do I have Anything to do w/ZZ or mindgeek, or Tony. but to say my relationship and/or feelings for Tony are icy at best is putting it mildly. whatever the outcome, listen to your talent if tell you to stop... kill the scene and eat the $ if it's going awry and there's no way to save the finished product. oh wait, this is 2016 and nobody cares about that anymore. porno is more of a callous factory than ever before and it's all because of who is at the top with the most money/producing the most scenes. the people behind mindgeek/ZZ aren't pornographers, and never were. they have a formula, OCEANS of bandwith & unlimited resource, much like a record label stamping out boy-bands and creating everything w/auto tune & pro-tools. it's never an organic process because they never knew how to create one..
I wish the best for Nikki and hope there's more discovery moving forward. it would be nice if this could weaken/topple those scumbags at ZZ, but those dudes are so deep and ahead of the game I don't see that happening. lates, von S.

^Thank you Sir Swiney for that, it's good seeing the industry stand up against another debacle akin to the whole Prop 60 ordeal (obviously and unfortunately worse) where it caused the industry to rally together rather than be divided by petty politics. As a fan though I feel guilty feeding the ZZ machine but can't deny the almost Hollywood level quality of their productions. Yet it stops there since too much quality can flush out any sort of healthy competition while shedding that glamorous haze that everything is alright with how they allegedly treat performers. It's a near monopoly content wise with who they hire at ZZ but again I feel to blame as I'm constantly joining their site since they own almost of all adult (except guys like you and Jules Jordan) as a fellow fan stated earlier on this very thread. So I did all I could do as a fan in a situation where we are facing goliath and that is stand together spears out in our little fan phalanx! The positivity in all of this is how tight knit the porn community has apparently become thanks to social media (it did something right for once) giving a banner to fly in support of an industry I so dearly love. I hope this brings awareness to the past girls who went through the same thing Nikki did and put a stop to any future mishandlings of performers... because there is no industry with out these girls who perform in front of the camera.

Doesnt matter if you equate or not, Jones has a poor track record as well for being a terrible co-worker. A couple years back, he really overstepped the line on a shoot with a girl, he got aired out, and it was like a beehive of girls swarmed to attack him. I believe Remy LaCroix and Monique Alexander were two actresses at the minimum that called him out for his poor professionalism in terms of disrespect and abuse

^The only name that matters to me Grek, is Nikki's name and performer safety regarding a co-worker that's all. Further thinking about this revealed to me how important communication is on set or anywhere else for that matter. If you watch the beginning of a Hardcore Gangbang they go through the sternly set rules like clockwork every time save for the interview with the particular performer. This also came to mind ; If a stuntman broke his fucking leg on a Hollywood movie set they would stop shooting the scene...

Check this article...
By nature I am trying to be fair and see the events from an integrated point of view, as much as I can because I wasn't an actual witness in the scene and everything I say might be considered misleading.
I have seen Tony's "eccentric" behavior when he was still working as a performer long time ago so I can clearly state that the guy has a lot of mental issues and he needs psychiatrist, not to say he needs to be enclosed in a mental institution.
Being honest there was a moment that I thought that Tony T was the only wrong gear in the story, maybe Nikki was carried away by her hand injury and started to blame everyone.
But now I am starting to believe that there are a lot more things going wrong in the alleged company and that incident was only the tip of the iceberg ... and the ball goes much much further...

Disappointing indeed. Additionally unsettling, the number of performers who are saying that they complained about Tony T or assumed he had been fired suggests this is a bigger problem than just some dude randomly being violent on set. It appears the company (and who knows how many individuals) enabled and/or supported this guy in the face of multiple incidents.

Icey Mike (Florida-based, recent addition, previously involved with Reality Kings)
Keiran Lee
Levi Cash (Florida-based, not sure if he's actually the director or just the producer)

What more could they have done, short of predicting with a crystal ball that these guys were going to attack her? It will have to be proved that they knew these 3rd party producers, which sounds to me like independent contractors, had a record of abuse. Some have alleged in this thread that is the case of one Tony but IDK if it's been confirmed to be the same one. Shortly after that comment, someone said it was a different Tony.
Labor laws for safe work environments are one thing, but you can't hold a company accountable if a 3rd party has a psychotic flip-out. I don't see how they could be liable, as if they knew it was bound to happen.
On the other hand, yes, I understand the case against them could become more legitimate if they did know that the people they were hiring had a history of being abusive. Nikki should at the very least have been warned about them before being put in such a situation. But we still don't know.
I am not saying they have no liability here. I already said they certainly have a responsibility, but for all we know they were as responsible to the best of their ability that they could be, short of having shock collars on these guys on the random chance that they flip out like savage uncontrollable beasts in a heavy petting zoo...
Full contact is expected. Rough contact sounds like was called for regarding the intentions of the scene. It is important to find out how this was communicated to Nikki, how aware she was of what the scene was supposed to entail. I still have to think she had at least a clue that it was a scene calling for some general rough contact - which as I said before still does not absolve the actors (performer and director) who evidently went too far.
Even if ZZ owned the set, their liability would be more for an instance of some apparatus falling down on someone or some other environmental hazard. People can be unpredictable. I wonder if their was some personal vendetta at play here. Some assholes going savage on someone, *allegedly* out of the blue, does not seem like anything an employer could account for.

Well that much is most certainly hogwash. Some scenes specifically call for violence, and some performers sign up specifically for that cuz it's what they're into. There's a whole giant domain within the industry catering to this. Kink delivers this type of content daily.
That's just a dumb boilerplate statement. The sentence preceding it and sentences following are made more effective by removing the nonsense.

Stargrek, I have to say your signature cracks me up sometimes, given how incongruous it can be with the message of your post. Don't change it. It's a fine sig. I might suggest just put some kind of ________________ or --------------------------- breaker line above it.
I just envision you as law enforcement arriving at the scene in question, asking who saw what, how many people were on set, and then telling them to explore sexuality! :D

Jesus.
Please tell me Kink is not owned by Manwin/Mindgeek.
I would really like to see more women live up to their potential and just take the reigns instead of putting up with bullshit and just bitching about it all the time. Maitresse Madeline started with modest femdom amateur videos with her and her boyfriend and turned it into a massive empire known as Kink.
I think it would be better for Nikki instead of playing ball with ZZ, to just team with other major females and start their own porn empire.
It has never made sense to me how women can make so much more money per scene/hour in this industry and yet it seems are perpetually victimized. You would think being able to earn more than anyone else, particularly the demographic supposedly oppressing you, should give them more control over their lives.
These women don't even have to know how to direct. All they have to do is know how to manage money (something most women do in their households anyway) and just hire some talented guys to direct for them. Women are making the most money in this biz. Why are so few interested in creating anything other than their personal sexual performances? Why aren't there more female directors?
Maybe the truth is they just don't like being in control. Sigh...
At any rate, I'm just saying they don't have to take this shit anymore. There will come a point where my sympathy is exhausted.

As far as I know Cybernet Entertainment has nothing to do with Mindgeek, and is owned by Peter Ackworth, who started what was to become Kink when he created Hogtied.

plus Danny D lately he directs with his wife together for brazzers, for example the Viola Bailey scene was directed by them and the Lucia Love scene from a few days ago too. Also Icey Mike did a lot of stuff for Mofos before RK and Brazzers gave him a kind of promotion to their A branch from the b league mofos stuff.

Wow.
To add a little more (lol), this will be an interesting development. The footage presumably doesn't show the discussion beforehand but must show whether they stopped the scene when she said so/whether he choked her in response. The footage also doesn't dispel the many other performer remarks about these guys. Regardless, if and when the footage is released I will be interested to discover its contents.

Which journalists would one give that, in order to get a unbiased, trustworthy and competent assessment of the footage? Industry media or outside media, or both?

Specific claims were made:
1. Nikki "got her head stomped on."
2. Tony choked Nikki "several times . . . after she got her head stomped on."
3. "Nikki kept yelling cut and they kept going."
These things either happened or they did not. The journalists who are given access to the footage should be able to see/hear easily enough whether what was claimed to have occurred actually did occur. They might disagree on, say, Nikki's demeanor or something of that sort, but Nikki either called "Cut!" or she didn't.

There are two sides to every story. Even if these things did happen, how do they equate to rape or abuse? Rape is non-consentual. Did Nikki ever say that she did not consent to the scene? She even said herself that she stated in the post-interview that it was consentual, even though she also said that she was forced to say that to get paid. So who knows?
1. Stepping on a girl's head during sex is not rape. There are plenty of scenes where this happens. Hence, the category "rough sex."
2. See #1. Did she ever tell him not to choke her?
3. The performer has no authority to cut the scene. That is the director's job. The camera crew doesn't work for the performer. They work for the director. It's not rape or abuse just because the director refuses to cut the scene. For example, if a performer yells "cut" 10 times during the scene because she wants to keep going on smoke breaks, or to go check her make-up, then the director may well instruct the crew to not cut the shoot again. However, she can still tell the male performer to stop (or use her safeword), which she never explicitly said she did. She can also refuse to continue shooting the scene. She can refuse to sign the release form. She can tell the truth in the post-interview if she really did not consent. She could do any of those things. But the crew is not obligated to stop shooting unless the director tells them to. Now, should he have directed the crew to stop shooting if she yelled "cut?" Probably so. But again, we don't know what really happened.
I'm also wondering to which "journalists" he's supposedly releasing this footage. Why not just release it publicly so everyone can see it?

If the scene is a rough roleplay in the vein of the old Pornstar Punishment scenes, I genuinely wonder if any mainstream journalists would have the expertise necessary to discern reality from performance. Hell, many veteran members on this forum have said they have a hard time telling the difference with some scenes of that nature.

^^ If a performer is genuinely distressed and telling the director to stop the scene, the director should stop the scene and assess the situation, full stop. If Nikki was saying cut then Tony T. should have cut, no "probably" about it. But we'll see what the tape reveals, assuming Tony T. follows through on releasing it.

First, I seriously doubt that there is continuous footage of the entire event, and would strongly suspect that there were/are gaps in any video record, simply because that's what happens when things get heated and people start arguing (and, I don't mean deliberate gaps).
Let's ask ourselves one question: Why would Nikki make this up, and, based on our common knowledge of the people involved, who do you believe?
Seriously, it takes someone of Nikki's stature to finally stand up to the status-quo misogynist's.
(Just like it took the full star-power of Lisa Ann to finally get Alex "Hep C" Gonz held to account.)

I don't think she is making up the account. I think what she said happened probably did happen. My question is, why should we automatically interpret whatever happened to be "rape" or "abuse," when she herself acknowledges that she made no explicit refusal or complaint at the time of shooting? She didn't complain that it was non-consentual until after the fact. It's not non-consentual just because you change your mind afterward.

Ramon Nomar is another performer that can be very arrogant and ultimately pigheaded when on set. He often pushes the boundaries too much. He is a rule-breaker, not like a Manuel, ask the girl her no list and pick two tamer things and break them right out the gate, but a "Imma do this and basically trick her into liking it" rule-breaker.
There was a Live Episode he did that had Veronica Avluv in it. Veronica was supposed to be the host and just get a quick b/g vag at the end. So what does Ramon do, constantly play around her butt. After several pleads against, and him coming on and off set, he finally decides to just "put the tip in", which in his world is half his dick. But Veronica is a classy pro and took it in stride, she went from a simple 10 min b/g vag to getting an unscripted airtight thanks to the peer pressure of Ramon.
BTW, I didnt know Devon put ZZ on the no list. I knew in the past that Veronica Avluv and Remy Lacroix were two also who went on ZZ hiatus. I think Siri as well.
Speaking of live shows, there was the infamous one where a girl took vicodin and consumed alcohol in the middle of the shoot and passed out while they were filming and one that involved off camera conflict between Phoenix Marie and Bridgette B
And in regards to the PSP scenes, I remember two infamous shoots, one with Savannah Stern and one with Lisa Ann where safe words were ignored

If she asked for the scene to stop and the scene continued, that's sexual assault at best. Asking for the scene to stop is an explicit no to continuing to have intercourse, and ignoring said explicit no, even in the middle of the scene, is just as bad as ignoring it before the scene starts.
Lux would be good. I would also think Aurora Snow could be trusted, if she's still writing for the Daily Beast.

A police case will be filed here or will this just be another of those twitter he said she said types?
Benz seemed to be way too powerful at Brazzers and so this comes as a shock to me.Infact i had stopped my Brazzers subscription because she became a contract star and i was bored of her.I thought she was way too involved at Brazzers and felt like she was being forced fed to me with so many scenes all the time.Very surprised somebody this important to them has been put through this.

Few Things:
Veronica must not hate Ramon as she has worked with him again since on the site.
Veronica put ZZ on her no-list due to hate-rid on the forums (Someone said she was on drugs). Worst I said was she should wear natural color lipstick
Remy was put on the No-List cause she cancelled like 3-4 shoots in a row including a Live show
The girl that passed out was Jennifer White. It was in the show with Amber Rayne(RIP) & Jynx Maze.
Dylan Ryder also didn't like her PSP scene (If your playing at home, All 3 co-starred James Deen)
