I assume most would never steal at all and the only reason they even watch the movie is because it's easily available as a free download, they don't care where it comes from or who's in it as long as it's serves their needs. They would NEVER pay the company, men and women a dime regardless. And since it doesn't cost the company anything in distribution it's basically free advertising, if you can get a superior product out to those who don't care, they may realize that porn worth paying for actually do exist.
When I started buying DVDs I came across a ton of SHIT at first, among it some horribly repacked licensed stuff from Evil Angel (I would never approve these distributors butching the original products like that), I basically just wasted money. But eventually I came across something real, but if I hadn't I would definitely never had payed for porn ever again, I would assume the business was full of shady people not knowing what the hell they're doing, just trying to squeeze ignorant consumers for money. I can gamble by wasting my bandwidth, but I can't afford gambling when buying porn.
If movies like Pirates are losing slightly in revenue I don't care at all, it sells plenty just because those big releases reaches the public, appealing to couples who're not that into the whole filesharing thing and who can easily afford buying a movie now and then. Same goes for certain recording artists followed by more mature fans used to buying records. But many combine the methods, they download a pre-release because they're hyped and has already placed an order. They may not comply with every law there is but there's absolutely nothing immoral about it, calling them 'thiefs' is not making any sense.
I also want to point out the fact that copyright infringement is perfectly ok in some cases, it's not uncommon even in this forum to see copyrighted photographs. I believe that since it can't be controlled, there is no use in trying, the latest Playboy shoot will always be available no matter how many people gets sued for making it available wihout permission... because it is in the public interest just as much as widespread news stories.
The efforts made to stop the unevitable has probably cost the companies way more than the hypothetic loss of revenue. Instead of improving the product and marketing they're fighting long and hard in court over silly rights. Seems to end as best a pyrhic victory...

There is good and bad with everything,
I believe piracy helps the industry.
With piracy a film may get seen. With out piracy, most people would not even pay a nickle to see most of the films. Piracy can make awareness of a film that may not have had success or have got the recognition it deserved.
Porn is like a drug, you give scenes away free, either by piracy or samples, it becomes addictive and then once a customer is addicted you sell at a price that really is too high. Some Porn is just way over priced!! Web Sites to crappy DVDs.
But the good news is
The revolution of DVD rental in this industry
Many people do not want to go to a adult store,
Many people do not want to take a risk on buying a DVD that turns out
to be a flop or just doesn't do anything for their fancy.
For me, I will always rent first, then buy.
I will only buy if it's one of my favorite actresses or the production is of the highest standards.
Before this industry cries a river, they should be planning on how to adapt.
Right now, there is no standard or unification. It seems anyone can get into industry with a hot chick, video camera and a web site. It is actually so spread out with out any rules that it just cries piracy for the protection of the consumer.
This industry should look at what the music industry has done,
sell scenes on like a server like a Iporn.
Every scene from every production company is for sale.
Have a review site that has more than 5 customer reviews per film.
Do a review, get a discount on your next DVD sale. Give an incentive!
For me, Pirates 2 is a definite buy, and is deserving of it.
AnalBang 6,769 may only be seen by piracy or rental
For me I'd never buy it before viewing it first.

The paysite companies seem to have figured out a good answer to this. You can pay $30 for a month of access to a paysite and they have hundreds of high quality scenes to view. You can watch a different scene every day and the price works out to be only a dollar for each one. Usually this is exclusive material produced by and for the site.
With quality scenes available for a dollar a time, most people won't bother to pirate them. Many will not even keep the scenes they have paid for, but delete them after watching. At that price it's cheaper than buying a magazine, and we all throw those away after we have read them. Nobody is complaining about people copying old playboy magazines. It doesn't happen.
What is the producer's profit margin on a DVD anyway? I bet it's less than a dollar per scene. Price and convenience is the answer to illegal copying.

This is very true. I think most people have downloaded something at some point. Whether it be music, pictures or movies. I've done it. I won't deny it. I don't do it habitually but sometimes if I can't find what I want for sale anywhere, the temptation is strong. The "Well. It's only one song/album/whatever" thing.
I think a real solution is going to be extremely complicated. Piracy is huge and almost everyone does it. It's almost impossible to stop that with threats. The various affected industries are going to have to find a mutually agreeable solution. Something that allows people the freedom to download and share pretty much anything their heart desires but also allows the industries to remain profitable.
The kind of control that was possible (and indeed very easy) before the internet and broadband is basically impossible now without locking down the entire internet. And people aren't going to take that lying down.

Have done nothing, nor will they ever achieve anything... Filesharers will ALWAYS be around, and the people who think they are making the laws are 5 to 10 steps behind them, and always have been.
As long as the net exists, people will find ways to fileshare over it(That was the whole POINT of the internet... The ability to share information)
So why would anyone buy porn? The #1 reason I can think of is to support an industry that has yet to really 'get with the times' while they figure out how they're going to exist in the 21st century. (Making laws that take 10 steps back is not the answer)

It was the inability to distribute analog recording en mass that protected the companies. Cassette tape is/was a mature technology, anyone with a decent home machine can make copies with very little loss over generations, but of course if you care about your music than that loss will be unacceptable.
No one has ever been prosecuted criminally for downloading files from the internet. Intent to deprive the owner of its use and benefit would be impossible to prove in court. Civil liability is difficult to prove also. The harm the owner suffered would need to be specified and there is no real way for a company to do that.
Copyright claims for a product that a porn company no longer has the master for, or that they could not recognize, the movie having been produced decades ago. Legions of dedicated vintage porn fan and others hoping to make a buck are unable to provide tie linage of many of the old films.
The downturn in porn in simply the the market adjusting itself. The invisible hand will soon work its magic and all will be well. We don't want the big government to step in do we.

The problem with trying to label unlicensed copying as theft is that the average person is never going to believe you.
For most people, listening to music on the internet looks and feels no different from listening to music on a radio. Watching a movie on their computer looks and feels no different to watching a movie on TV. What they see is a different kind of radio or TV that has more of the programs and music that they want. They paid to buy the thing and they paid to connect it to the internet. That feels to them as if they are buying a new kind of cable entertainment service. Naturally they feel entitled to use the entertainment that it presents to them.
When you try to hype up the issue by calling these people "thieves", their response is always going to be "Fuck you! I was just watching a movie." It doesn't help your case that the law of every country in the world also says they are not thieves. (This is why many new laws have been created to define penalties for unlicensed copying, a completely different issue from stealing.)
Constantly muddying the water by defining something as stealing when the law says it is not, will simply alienate a whole lot of people who might otherwise have supported your cause. I recommend you take a few deep breaths, then dial back the rhetoric to a more common sense level.
Unlicensed copying is prohibited by law. The law isn't working very well. If you want it to work better, you need to convince people that it is a good thing. Yelling insults that are not even true is not a good technique for convincing people to agree with you.

This is a good question. After all you can go to the pirate bay and get torrents for all the latest movies that are not yet even out on dvd. Learn how to download torrents. Down load the movie and use a program like winavi to create the dvd files and then just burn the dvd.

And this is why, over time and not just with porn but with all movies, the quality will get worse, not better because once you de-monetize something, less people will create and it and the one's who do it for free won't be very good at it. Led Zeppelin didn't want to "share" their music with the world for free. They wanted to get paid. How many albums would they have made if everyone stole their first one?
This debate will never be solved but file sharing is stealing. period. end of discussion. Music isn't free. Art isn't free. Nothing of any intrinsic value is free except a smile or a cool wind on a hot day. If you didn't pay for it, you stole it. Personally I'm not too worried about tube sites because the quality is horrendous but I can't compete with my own stuff, in full DVD or HD quality being downloaded for free.
If my company or any company goes to the expense of shooting, packaging and distributing a movie and you download it for free from pirate bay, where is the incentive on our part to keep making movies? Nevermind the loss of revenue from so many lost sales that make it harder and harder to reinvest in an ever-shrinking piece of the pie.
Hopefully enough people understand the value of entertainment in all it's forms to keep it from disappearing forever but I'm not optimistic. While I was sitting in the theatre watching the Dark Knight a few weeks ago, my nephew had already seen it because he downloaded it for free.
The thieves are everywhere. Even my own family :)

Money does not make music or movies better, neither does the number of people producing it. Surprising as it may sound some people do it for the love of the art. What was that guy name who made "Plan 9 from Outer Space"
The businessmen who are grinding them out, making the same movie time after time may have to make way for a new breed of pornographer.
The porn business parameter have shifted. I foresee other changes: Actors forming some kind of collective, union, guild etc, demanding a bigger piece of the pie. Health concern will have to be addressed. These are two I think that are on the near horizon.

But acquiring a product without paying is theft.
Even if it isn't defined by law as theft it is theft morally.
And that's the point I was making.
We need a consensus that downloading without paying is theft.
People need to understand that downloading without paying is something that an upright citizen won't do.
I see only two alternatives if we don't find a consensus:
New and strongly enforced laws.
For example: Anybody with a monthly download volume 10GB+ gets a visit from the police to check the harddrive.
That's a nightmare.
The entertainment industry focuses more on live shows.
For porn this would mean: The money will be made with feature dancing and escorting. The film will be only advertisement for the live show.
This would reduce a porn company to a pimp agency.
That's a nightmare too.

And it's funny today to see all the rappers blinging it out on MTV, and then the viewer is told that illegal downloading hurts the artists... As most companies they just want to eliminate all forms of competition, they buy competing companies, buy expensive lawyers, place the music in movies... all to maximize profit for themselves and stock holders. I doubt there's any CEO that actually enjoys listening to music or watching porn... maybe they did so once, but now they're turned on by numbers.

There won't be any new rock group as big as Led Zeppelin because the younger audiences don't share the same respect for artists as the older audiences do.

I own that first Zeppelin album, and yes, of course I stole it, I just took it under my arm and bolted out of the store (almost tripped on the owners fat ugly cat)... no way I'm paying those ridiculous prices on used vinyl. And I hate computers and want everything like it was back in the late 60s. Stealing over the internet!? What kind of cowardly sonovabitch would want to do that? Wherein lies the thrill and what about the joy of adrenaline jetting through your bloodstream?

I have paid money to producers that I never heard of until somebody posted some of their stuff on usenet. This includes buying their DVDs and/or joining their paysites. Those people would never have got any money from me unless some unidentified twelve year old had "stolen" their product and shown it to me.
You say "stealing", I say "free advertising", but I am one of the people who has been paying you an income. I could have copied ZT stuff any time in recent years, but never have. Instead I bought your DVDs.
Some families pay $100 to go to a cinema, when they could hire a movie to watch at home for $5.
Releasing a book for free download on the Internet ALWAYS boosts sales of the printed version in bookstores.
People don't necessarily always choose the cheapest option. Downloading pirated stuff and burning it to DVD takes technical knowledge and requires free time that can be used for the task. Buying or hiring the DVD is much more convenient. I am betting that very few of your genuine customers will take enough illegal copies to have a serious impact on your sales. I hope I am right.

I don't like it when communism is presented as satan and capitalism as god. Both strategies has obviously gone rotten 'cause of greed which offsets the balance supposed to make them work.
I can see why directors don't want consumers to download for free instead of buying, but I can't understand the irrational anger aimed at those who only consume the product because it's free. It's something I think everyone must accept, that anything that can be reproduced and distributed on the internet will be distributed beyond control. If you don't want that to happen, don't make the work available at all.

They should have done this years ago when there was a larger pie to take a piece of. The pie is much smaller now and there's not much room, if any for some companies, to give any slices away no matter how worthy the cause might be.
I'll agree that there's a huge opportunity for amateur couples and home-based gonzo shooters to make a name for themselves, however it's highly unlikely that any of the new entrants into the business are going to get rich or even mildly wealthy. Those days are over.
IMO, the biggest problem with the porn business is the dinosaur middleman distributors. These are the companies that essentially have controlled the physical distribution business for far too long. They took too long to adapt to the pressure of the internet and have squeezed the studios' very hard in so many ways that their profits on physical goods (DVDs, videos) are very slim. These companies will buy your product at a wholesale price today and then 90 or 120 days later tell you that they aren't paying you the full price. If they bought it for $5 they'll pay you $4, take it or leave it months after you sold it to them. It's hard to grow a business on cash flow when this is part of your distribution channel.

If you think there is nothing wrong with Tube Sites then there's a real simple way to prove it.
Assuming you have a job and some sort of income, I'd like for you to inform your company that your name is now "Nate Glass" and give them my checking account information for your direct deposits of your paycheck.
From now on, whenever you work and are paid for it, that money will instead be given to me, not you. This should be no problem for you, as you are only doing your job for the "love of it" and not to be financially compensated.

If YOU don't like downloading, don't download.... Other people view it differently. (In my country, downloading is legal)
Laws made to try to stop them will end up being unenforceable anyway... File sharing has been around as long as there has been 'internet'...
I love how people cry, and wring-their-hands about torrents, and peer-to-peer and such, and FTP servers are still all over the place, going strong as they have always been.
Trying to stop it is a waste of resources. The people who want to support someone will. The people who want to file-share will file-share...

For those who feel that it is perfectly fine to download illegally stolen movies (I'm not talking about legal VOD or PPM sites), how would you feel if someone stole your car. Then how would you feel if that person said it was okay that they stole your car because they were just "test driving it." Then how would you feel if tons of other idiots who just want everything for free stood up and said it's okay that the car was taken because it was just a test drive even though you were never getting paid for your car (which is still stolen at the time)? You never get a dime from the insurance company because your car wasn't "stolen" it was just "test driven." Is this scenario okay with you? If so please post your addresses here and times you aren't home so people can go "test" your stuff.

Downloading a COPY of something doesn't deprive anyone of the original... So your analogy is kinda flawed. The DVD, or CD, or whatever is still there for others to buy (And they do... )
What was the band recently ( a few months ago) who released their new CD online on a pay-what-you-want basis... You could DL it for free, or you could paypal them a few bucks for it...
IIRC they reported that they made more $ off doing it that way, than they would have selling it in stores through their record company and such...
As I said, the people who want to support an 'artist' will support that artist...
and well, all the analogies in the world won't change the fact that file sharing is never going to go away, as long as there's a global network of computers...

If the originator of the material, in this case Mike Quasar, tells you, that he doesn't approve "free advertising" through filesharing you can't say "I know better what's good for the originator".
If you download against the will of the originator its theft morally. Period.

They made money through the concerts after the release but they didn't make much money through the virtual CD.
Your only point is "it won't go away". And that's why I call your whole argument immoral.

Getting rid of the distributors is easier said than done.
The Eagles sold their latest album directly through Walmart, no record company or distributor involved.
But how many American record artists are big enough to make a similar deal?
Not that many.
I guess not many porn producers are big enough to bring their stuff directly to the audience, at least not to the audience that still wants to buy porn on DVD.

Fine.. but again, what you think of my morals or immorals really doesn't matter much to me... Exactly the same way that some people think that buggery is immoral....
I'd like to see your evidence that Radiohead's experiment is widely considered a flop though, as Radiohead has never released numbers regarding their internet sales... Isn't it possible that they made SO much money off it, they're embarrassed to publish the figure? LOL

Ummm... Actually, can do and have done. (And will do again probably) It's my experience (Anecdote... not evidence) that the people who say they don't approve most often don't understand the internet as a distribution model...
To simply throw up one's hands and say "I don't like it" in the face of something that is not going away is, I almost hate to say it, pretty childish. Simply saying "No" over and over and over again isn't going to make it go away... In fact, it's likely to engender ill-will and spite toward a person. (Please, that is NOT meant to be taken personally in the least!! )
As the internet is still only what, 5000 or so days old, one must recognize that it is an emerging technology, and accept that we have much to learn about how we're going to use this tool...
I may be biased, but I suspect the end model will be closer to what is happening currently than anything... that it will be less restrictive rather than more.

I do all the shop work on my two olds cars I derive great satisfaction doing so. The mechanic shops does not figure into their profit loss statement monies they believe was loss to home mechanics.

If there were ever a product that sells itself it's porn, well..music gotta have music. Someone is getting rich from both. and will continue to get richer.
Of course there is some economic loss from file-sharing, but business cannot count money it never had.
file-sharing is laissez faire economics at its purest. The down-loader are exploiting a new technology and acting on their self interest. Porno companies maybe need to step away and take a fresh look at their business model. These companies are to my eyes, and I'm not an insider, like the five biggest oil companies, there is no real competition.

This site and other web-site are an invaluable free research tool. No other media has the opportunity to interact as intimately with thousands of fan across the spectrum, and yet companies continue to show the "man cum face".

The usual flinty-eyed what's the bottom line approach to porn might have to be scrapped for a more fan friendly we are in this together and I want to give you what you like approach.
I can hear the sound of jaws dripping all over this board following the statement that women in porn are not lining up to be ass fucked for the thrill of it.

Everybody's story is different, but I think that, generally, the filesharers will just abstain from porn if filesharing were not available. There's a lot of people chiming in saying that they think grabbing stuff for free from the internet is OK and not stealing. I have a few questions for you:
Have you ever purchased DVDs? Do you currently download movies for free and still occasionally buy a DVD now and then? Do you no longer purchase any DVDs since you learned where to get your porn for free?
Just curious.

I know that the thread has pretty much gone the route of stealing DVD content,but I have a different take on it.
I must have a 100+ vcr tapes & 150+ DVD's collected over the last 15 or 20 years. It has been a year since I have not bought anything new as I find myself going back through the archives.

I buy the "good" (imo) stuff. I download known mediocre-to-crappy stuff, "mystery" stuff where the boxcover/promotion/marketing is hype/shady/uninformative, out-of print filmloop/VHS scenes of forgotten starlets (i.e. Lili Marlene), obscure old out-of-print Euro-kink extreme queens (i.e. Anita Feller), and the occasional newer Euro-kink fisting title that is not legally available to me.

Why has no major company implemented an iTunes like model for downloading INDIVIDUAL scenes? 99% of the time, a movie has just one or two girls I'm interested in. I don't want a monthly subscription, a trial, streaming video, or a dvd loaded with filler. For example, I want to be able to go on Evil Angel's website and grab any scene from their catalog. A few dollars for a dvd quality file is reasonable. I'd gladly pay four or five bucks for a 1080P file. But I can't do that. It has to be more convenient for the consumer to get the product directly from the content provider instead of from a torrent site, usenet, etc.

Big difference, the band decided to make it available this way. This is the same as if you made food, put it in your yard, anyone can take it and leave what they felt like versus you making food and people walking into your kitchen and taking it from you. Illegal downloading is like the people walking into your kitchen and taking your food from you. I know you are going to state that it's different, anyone can make a copy that they want and it's fine, whatever, you are still stealing.

It's a complete and total waste of trying to convince people getting something for free is wrong. They're just going to come up with rationalizations to justify what they do. The main reason they're convinced that there's nothing wrong with this is because when they do it there aren't any concequences they have to deal with personally. The mentality would be exactly the same if nothing would happen to people who walked into a grocery store and just walked out with paying for food.
They would come up with the equally lame rationalizations. People would say..."They end up throwing that stuff out anyway...", "I only take a little bit of stuff...", "Yeah, I take food but I still pay for meals when I go out to dinner...", "They want us to have that stuff...", "A lot of that food isn't even that good...", "If you pay for that stuff you just end up cloggingup the check-out lines....", "Those big corporate grocery chains already make plenty of money already..." "Free groceries aren't going away, it's just the way it is...", "The farmers don't even make that much money from the crops they sell..." etc., etc., etc...
The thing that keeps people from just walking out a store with stuff is the fear from knowing if you get caught they're going to toss their ass in jail. If that fear doesn't isn't there and no consequences to be inflicted then people will come up rationalizations why it's their right to not pay for that food.

There's a few things at play here: Tube Sites and Filesharing (be it via FTP, torrent, usenet).
Filesharing via torrents and such are never going to go away. And to go after eradicating them (besides being pointless and unwinnable) is to go after the enduser. I'm not a fan of going after the enduser. As Mark Cuban put it recently "these people have more time than money".
However the Tube Sites make it exceedingly easy for ANYONE to view free porn. It also is creating a generation of consumers who think that paying for porn is ridiculous. Not paying for shitty porn IS ridiculous, but you won't find quality smut being made for no financial gain, the cost will prohibit high quality productions on a regular basis.
What is important to take note of is that there are people in this industry making hundreds of thousands of dollars running tube sites that are full of material that they don't own. How do these sites make money if the vids are free you ask? By ADVERTISING dollars. Since these sites get huge traffic, advertisers will pay money for that traffic. While this is no new concept the fact that those sites are using another person's work to bring in the traffic is not only completely unethical, it's illegal. So when companies like Adult Friend Finder (Penthouse) and Fling.com pay these companies for advertising, they are subsidizing the continued copyright infringement. As a porn producer I can't tell you to whom you can loan my DVD that you legally bought. But I can tell you that you can NOT put up a website, earning you thousands of dollars by using MY product without paying me a cent! That is copyright infringement, plain and simple.
And if you don't think these tube sites are breaking the law...why is it that EVERY SINGLE ONE OF THEM is based in another country? Must be these oppressive taxes we have here eh? No...it's because they know that they are breaking the law and countries like Antigua and Portugal will not cooperate in prosecuting them.

Actually, it's nothing like that at all... But you already know why, because you stated so yourself....
So to get back to the OT, why buy porn?
To support the industry we all love, while it sorts out how it's going to exist in the new. digital world.

There are clips on some of those sites, clips from major adult studios, that have been viewed 1.3 million times. If that site paid that studio one cent everytime someone viewed it, they would have paid that studio 13 grand. I'm sure the studio wouldn't be opposed to that. Or even 1/10th of 1 cent would still yield the studio $1300 for a 20 minute clip, so in essence that site would be paying almost 7 grand for the rights to show the 5 scenes for 6.5 million pageviews. But those sites have absolutely no desire whatsoever to pay the studios for their works, they use the content without permission, take the ad dollars from american companies and then hide the money overseas. It's indefensible.
