California Assemblymember Introduces Statewide Forced Condom Bill (AVN/Mark Kernes)
LOS ANGELES—In a press conference held today at the offices of AIDS Healthcare Foundation, Assemblymember Isadore Hall III (D-Compton) introduced Assembly Bill (AB) 332, which would change the state's Labor Code to require that adult movie actors use "engineering and work practice controls" when performing sexual acts in adult movies.
Specifically, the bill would create a new Sec. 6720 to the Labor Code, and Sec. 6720(c) reads, "An employer shall maintain engineering and work practice controls sufficient to protect employees from exposure to blood and any potentially infectious materials. Engineering and work practice controls shall include, but are not limited to, the following," below which Sec. 6720(c)(2) states, "Provision of and required use of condoms and other protective barriers whenever acts of vaginal or anal intercourse are filmed."

The adult industry is done for in the United States. Measure b not only dictates mandatory condom usuage but full protective gear! Bye, bye freedom of expression and speech!!! Getting measure b passed state-wide in California is only a preliminary. Soon it will be passed as a nation-wide federal law by congress, you mark my words. It's ironic to me that this thread doesn't get more attention and feelings of outrage by fans. People post on these forums like it's business as usual, well, the industry you know and love is about to fall off the precipice guys and dolls, no big deal...

If the city of Los Angeles had voted on the city proposition mandating condoms, I think it would have been more to the advantage of the adult industry. The city council, mandating condoms before a vote, did not give the adult industry an opportunity to test out different ways to convince people not to vote for a mandatory condom proposition.

Whether the porn industry succeeded or failed at this stage, it would have been better prepared to fight the county wide proposition. I normally vote for democrats but the California democrats supporting Michael Weinstein's efforts to force porn actors to wear condoms are a big disappoint to me. I live in California so I can't vote these people out of office.

LOS ANGELES—Dan "Porno Dan" Leal, owner of adult studio Immoral Productions, went down to the Los Angeles County Department of Public Health's offices in Commerce, Calif. today and left with what might be the first official Conditional Adult Film Production Public Health Permit. According to Leal's attorney, Michael Fattorosi, county officials said that one other studio had applied for a permit, and it was unclear whether who's was issued first, but the producer walked away with a signed temporary "Public Health License/Permit Application."

I was surprised to find out that Traci Lords has criticized Measure B. In an interview that appeared on Huffington Post, Traci said "I was reading about how pissed off the adult industry is about Measure B [a law passed in Los Angeles which requires adult film actors to use condoms]. I was shocked -- shocked! -- that they passed it because it's unenforceable and it's stupid. You're forcing them to do something they don't want to do. And why?" Over the years, Traci has been speaking much less negatively about the x-rated industry.
It couldn't hurt to ask Traci for her help to fight condoms being mandated on porn in all of California. Even if she only signed a petition, rather then TV commercials, that at least is something that would be useful. Even if she would want to be paid for her time, It couldn't hurt to find out what her price would be. If she would help the adult industry in this struggle, this could help make up for the harm she caused during the 1980s.

Okay, now that this shit is apparently getting serious what can we do to help stop this abomination? Can't the industry do some/more lobbying? I'm not talking grassroots type stuff, but actual in-the-halls-of-power, corporate America-type lobbying. Can we use Kick-Starter or something similar to help fund said lobbying?

AHF Seeks to Intervene in Vivid's Lawsuit Over Measure B (Xbiz)
LOS ANGELES — A group led by AIDS Healthcare Foundation President Michael Weinstein has asked a federal court to allow them to intervene in Vivid Entertainment's suit against the county over implementation of Measure B.
Weinstein, in a declaration to the court, says that at least two Los Angeles County supervisors have been critical over Measure B and that two other county officials — the county counsel and the public health director — have voiced skepticism over whether the law passed by voters can be enforced.
As a result, Weinstein and other proposed intervenors — AHF employees Marijane Jackson, Arlette De La Cruz, Mark McGrath and Whitney Engeran, as well as the AHF-funded Campaign Committee Yes on B — have asked U.S. District Judge Dean Pregerson to allow them to intervene.
Generally, to be admitted into a lawsuit, an intervenor must have an interest in the subject matter of the original suit. In this case, AHF spent $2 million to qualify Measure B on the Los Angeles County ballot.

Calif. Legislative Panel Votes to Move AB 332 Forward (Xbiz)
SACRAMENTO, Calif. — AB 332 moved forward today after a California Legislative panel voted 6-1 in favor of the bill.
The bill, introduced in February by Assemblyman Isadore Hall from Compton, Calif., mirrors Measure B, which makes condoms mandatory for porn shoots in Los Angeles County.
Hall's proposal, denounced by adult entertainment trade group Free Speech Coalition and a majority of the industry, was heard this morning by the Arts, Entertainment, Sports, Tourism and Internet Media legislative committee.
The hour-long hearing included testimony against the proposal from Wicked Pictures director Eli Cross, performers Alana Evans and Lydia Lee and the FSC's Diane Duke.

As long as performers continue escorting and falsifying test then Measure B (#AB332) will be in affect. They (performers) want to complain about Measure B and the harm that it will do to the industry but then you continue to work with performers, male and female, that continue to have unprotected sex outside of the business. Many performers escort and it's no secret. I as a fan don't want Measure B anywhere near porn but you cannot be hypocritical about it. I challenge any performer who disapproves of Measure B to explain how this major issue of escorting isn't being addressed and why it won't ultimately be the smoking gun that seals the deal?

"It is uncontested that proposed intervenors were the official proponents of Measure B," Pregerson wrote in his ruling. "As such, the court finds that they have a significant protectable interest in the subject matter of the litigation, sufficient to support intervention.
Ventura County Supervisor to Propose Porn-Condom Ordinance (Xbiz)
VENTURA, Calif. — Ventura County may be the next region to regulate porn shoots.
Ventura County Supervisor Linda Parks said she is planning to introduce countywide legislation modeled on Los Angeles County's Measure B, which was passed by voters in November.
Parks told XBIZ on Thursday that the county proposal, which she plans to introduce in the first week of May, would apply to unincorporated parts of Ventura County.
She plans on expediting the proposed ordinance by placing it on a fast-track "urgency" basis. If passed by Ventura supervisors, the proposal could go into law within two weeks.
Parks said that since Measure B passed in Los Angeles County she has been getting emails and phone calls from constituents in her district who are upset by an increasing amount of porn shoots. She said that the constituents aren't just hearing "moans and groans" from nearby houses, they're "seeing naked people."

To be clear, it passed the Labor committee. Next up is Appropriations, then the full Assembly, then it goes to the Senate side.
The surprise today was Jessie Rogers showing up to
testify in favor of AB 332. She talked about getting herpes and also an injury sustained on set last year.

It wouldn't be just condoms but having to wear dental gams, googles, etc. That would make porn an unwatchable piece of garbage. The bill is a free expression killer in sheep's clothing under the euphemistic guise of "protect the worker". Why should the adult industry do anything else but close up shop? After this becomes state law in California, they'll make it federal law as well, you mark my words. Why bother with the expense and risk of relocation anywhere in this country if they're soon to be subjected to the same unworkable restrictions anyway?

I think that porn actors and actresses who want either mandatory or optional condom use, can start their own x-rated companies. They can take the final risk of putting out movies with condoms, rather then the government force companies to do what they want. I'm aware that many porn actors and actresses are not millionaires like Ron Jeremy and Jenna Jameson. The thing is that if many of the porn talent (who want condoms used) combined their money together , they would have enough money to start companies. I prefer to watch movies without condoms but I also buy movies with condom scenes in them.

That said, is there a legal definition for pornography in the USA? Plenty of non-pornographic european films explicitly show sex, is it now forbidden for a non-pornographic movie to explicitly depict condomless sex? If not then what's to prevent smut producers from simply reclassifying their condomless variety of erotica? If the idea behind this measure is truly to protect the actors from catching a disease and not just a poorly veiled attack on pornography itself does that mean you will also ban french kissing for fear of herpes? Will you call it freedom kissing?

^This touches on the actual biggest problem with the laws the way they're written, and is the only reason why there's even a chance that the laws might be struck down in court. They're entirely too broad in terms of what they are and aren't asking for. If I've read up on them correctly, it doesn't matter whether or not the movie is deemed as "pornography". It could be Jules Jordan or Steven Spielberg filming it, they'd still have to wrap it up. Doesn't matter if it's for a DVD release or a website. Doesn't matter if it's on a set on in your own bedroom. Doesn't matter if it's with your husband/wife or someone you just picked up off the street. Doesn't matter if it's being filmed to be edited and distributed later, or broadcast live right now. If there's sexual contact where fluids are being exchanged, protection has to be used.

Well, maybe you think it will help but the net result will be that they just add momentum to the rubber dictators.
The way I look at it, they're just backstabbers. They were never obligated to do porn. They chose to do it. They signed the papers. They decided they would do it without a rubber. The terms and conditions were always clear enough. They took the money/cashed the checks. And now they want to play the victims?

That may be his/her money but it's the performer's health that's at stake when talking about condoms during penetration scenes. No amount of money will cure a performer who catches herpes during a sex scene. I know you'll tell me there's a good chance that he/she caught it from someone outisde the industry and that could be true but there's no way of knowing that.
That tells me that she is quite naive because the porn talent pool is so small in the industry that even if she limits herself to only one guy then she's still having sex with every girl that guy had sex with and with every guy those girls had sex with. I also wonder if Mr Marcus was one upon a time on her trust list.
The simple dirty truth is that porn is a giant ocean filled with std's predators where performers knowingly or unknowingly take a chance swimming in. They hope that their swim will be without incident but as the ocean keeps getting filled with more and more predators then that becomes less likely everyday and sooner or later they get bit and then they hope that it's one of the lesser predators

Then they should think of that before they do it. It's that fucking simple. This is the whole reason why they have to check IDs and keep records. People are supposed to be bright enough to weigh basic pros and cons and make a simple yes or no decision by the time they're old enough to make porn.
Nothing you can say is ever going to convince me the vast majority of these people are incapable of doing so.

SHERMAN OAKS, Calif. — This morning's Hollingsworth vs. Perry decision at the U.S. Supreme Court deprives the AIDS Healthcare Foundation standing to defend Measure B in federal court, according to industry attorney Allan Gelbard.
In April, U.S. District Judge Dean Pregerson ruled that the AHF could intervene in Vivid Entertainment's suit seeking injunctive relief over enforcement of Los Angeles County's Safer Sex in the Adult Film Industry Act, which was approved by voters in November.
The AHF, in its arguments for intervenor status, contended that counsel for Los Angeles County won't make any arguments made by the proposed intervenors because it won't defend the constitutionality of Measure B.
But today's U.S. Supreme Court ruling, Hollingsworth vs. Perry, which dismisses a case relative to California's Proposition 8 gay marriage ban, could be key in the possibility of tossing the AHF from the Measure B case.
The U.S. Supreme Court today held in Hollingsworth vs. Perry, 5-4, that opponents of gay marriage behind California's 2008 Proposition 8 effort did not have the constitutional authority, or standing, to defend the law in federal courts after the state refused to appeal its loss at trial years earlier.
"The court [in the Measure B case] granted AHF's intervention motion based on the Hollingsworth vs. Perry (Proposition 8) 9th U.S. Circuit Court of Appeals decision that as a proponent of an initiative, they had standing," Gelbard told XBIZ.
"The Supreme Court ruled this morning that was incorrect when it held that the proponents of Proposition 8 lacked Article III standing in federal court and vacated the 9th Circuit opinion," Gelbard said.
