The takes I've read from some industry people is that requiring warrants might make enforcing it impractical. I don't know enough about the county's resources/willingness to enforce it, though.

Here's a reminder that Cal/OSHA can still take their own action.
Of the "serious" citations, three resulted in $9,000 in fines a piece, including one for failure to maintain an "exposure control plan; a second, for failure to observe and practice "universal precautions" for possible contact with or exposure to blood or other potentially infectious materials; and a third for failing to use engineering and work practice controls to eliminate or minimize employee exposure to “… minimize splashing, spraying, spattering, and generation of droplets of… blood or other potentially infectious materials."

Porn Gets 'Landmark Decision' on Condoms (LA Weekly)

Condoms are mandatory for porn production in California, an administrative law judge has ruled.
The AIDS Healthcare Foundation, which has been fighting for laws that explicitly require prophylactic use in adult film, last night called the decision by a California Division of Occupational Safety and Health (Cal/OSHA) judge a "landmark decision" that affirms "barrier protection" applies specifically to the porn business.
AHF spokesman Ged Kenslea told us that one of the most important aspects of the ruling ...
... is its affirmation that performers are indeed employees due protection under under workplace safety rules. The group has long argued that federal law prohibiting exposure to bloodborne pathogens such as sperm at the workplace applies to California's adult performers.
The industry has said that porn stars are very part-time workers who paid per "scene" as independent contractors.
The ruling by Judge Mary Droyovage wrote that, without condoms, there is "substantial probability that employees would suffer serious exposure resulting in serious physical harm or death if violation occurred."
Kenslea said AHF's stance is that the ruling applies only to condom use and that it does not mandate dental dams, surgical masks, eye protection, gloves and other gear feared by the industry.

So what does this mean then? Are even more companies going to move to Vegas? Unless I'm vastly overstating the number of consumers who are not willing to buy condom-only porn, I'm worried about the viability of the industry in CA, especially given its weakened state due to piracy.

There's really nothing new there. The Appeals Board just upheld things the way Cal/OSHA has been doing them for years. Cal/OSHA already considers condoms mandatory under 5193 (Bloodborne Pathogen Standard) and performers are considered employees.

Kink fined $78,000+ by Cal/OSHA (Xbiz)
SAN FRANCISCO — Adult film producer Kink.com is firing back at Cal-OSHA after it announced fines against the company in excess of $78,000, Kink said in a release.
According to Kink, the majority of the citations are related to relatively minor issues, such as extension cord violations and paperwork, which it believes are due to its ongoing overhaul of the 100-year-old National Guard Armory where its shoots take place. However, the largest fines are related to the company’s policy of allowing performers to choose whether or not to use a condom.

Ninth Circuit Hears Measure B Appeal (AVN)
PASADENA, Calif.—The appeal of Judge Dean D. Pregerson's ruling denying a preliminary injunction to Vivid Entertainment Group and its co-plaintiffs, including performers Logan Pierce and Kayden Kross, was argued this morning before the Ninth Circuit Court of Appeals, with the three-judge panel asking pointed questions to both the appellants and the appellee, which in the current situation is AIDS Healthcare Foundation (AHF) rather than the lawsuit's official defendant, Los Angeles County.

Looks like this AB 1576/Measure B bill is going to actually pass. Will the industry comply or move out of LA county so they can still shoot scenes w/o condoms?

I also wacthed an interview with Dennis Hof (bunny ranch owner) recently where he was saying Measure B is a great thing and all porn stars should always wear condoms. I thought Hof was a libertarian, why would he support mandated use of condoms in porn?

Measure B is just about LA County. If 1576 passes, it applies to the whole state, so moving out of LA County wouldn't be enough, and you'd see a serious flight to Las Vegas/Nevada.
Edit: And Hof would support it because Hof hates porn, and more specifically hates what porn has done to the girls he's had that got into it (for example, he blames porn specifically for Isabella Soprano moving on from the the sex industry and has a few videos out there where he talks about it).

I found the video that you mentioned. In it Dennis Hof says Isabella Soprano got involved with some "bad people" in the porn industry. He also says Soprano got involved in "skank porn" by which I'm assuming he means any porn outside the type where women get put on pedestals and ridiculously overpaid (e.g. Jenna Jameson).
I think that's Hof's whole gig - he rips off men dumb enough to visit his "Bunny Ranch" and pay some ridiculous amount of money to sleep with girls who aren't even that hot (half the girls at his place are 4's and 5's at best). On top of that I believe there are cameras in every room of the brothel, so basically you're paying an ugly girl a lot of money to fuck her on camera... sound like a pretty good deal, LOL

MOD I tweaked the post so it's not the same, just trying to get more opinions on this topic. BTW I didn't post in the other topic you removed, only this one which is more related to condoms in porn.

Why are condoms in porn such a big deal for people?
I definitely prefer viewing porn without them but it's the female I enjoy watching, so it's not the end of the world if a dude has on condom since I'm mainly paying attention to her and not the guy (or his penis).
What are your thoughts?

ATK Agrees to Pay $8K in Cal/OSHA Fines (Xbiz)
TARZANA, Calif. — ATK (Amateur Teen Kingdom) and AMKingdom.com owner Kim Nielsen recently agreed to pay about $8,000 in fines to Cal/OSHA for citations issued over three workplace violations, XBIZ has learned.
Nielsen told XBIZ that the fines, stemming from an anonymous tip over film shoots, were halved after he and his company agreed to incorporate a certified safety expert for all films shot by the porn studio.
In June, Cal/OSHA issued citations to ATK over failure to maintain an effective injury and illness prevention program, failure to implement an effective exposure control plan and failure to implement precautions — such as condoms — to prevent potentially infectious exposures during vaginal intercourse.

AB 1576 Moves to the 'Suspense' File (Xbiz)
SACRAMENTO, Calif. — AB 1576, the California bill that requires a minimum 14-day testing protocol and use of a condom or barrier device in the production of adult films, has been moved to the "suspense file" by the state Senate Appropriations committee.
The committee, which did not vote on the bill, will meet Friday, Aug. 15, to decide whether the piece of legislation is approved or nixed.

AHF files complaint with Nevada OSHA against Kink (Xbiz)
LAS VEGAS — The AIDS Healthcare Foundation has filed its first shot in Nevada against an adult entertainment company.
Late Wednesday, the organization said it filed a complaint last week with Nevada OSHA against Kink.com over a recent filming that may have exposed performers to infectious disease by exposure to blood and other potentially infectious materials.
In the complaint, officials from AHF said that a June 8 shoot for the studio’s HogTied.com film, “Hogtied Whores,” broke labor rules.
San Francisco-based Kink last month said that it had moved some production to Las Vegas and has opened an office there, as well.

I've been thinking, why not look at production in Canada within the border regions. Places that come to mind would be Vancouver, Montreal and Toronto. Basically the North East and the Pacific North West. Laws in Canada on porn production are not problematic like they are in the US. At least that's what I think.

^Not going to happen. If there was a porn industry in Canada then Canadian women would not fly to the US to shoot there. There is a tiny porn industry in Quebec but is so small that all the performers could fit in a school bus and there would be some empty seats.

Because "if you're going to shoot porn in LA County, the man has to wear a condom" is totally the same thing as "if you're going to shoot porn in LA County, or anywhere else, we will devote the full resources of the federal government to create farcically biased studies to establish the "harm" of porn, to staff US Attorneys offices with anti-porn zealots, and to prosecute pornographers in backwater Bible belt federal districts thousands of miles away from where they live and work (in order to make it almost impossible for the pornographer to mount an effective defense and get a fair trial), with the ultimate goal of putting the pornographer in a federal penitentiary for decades. Didn't say it was the same thing. Pointed out that electing Democratic politicians who appoint judges doesn't protect the porn industry. Also, CA politician who introduced a similar law on the state level is a Democrat. Democratic party has proven to be no friend of the adult film industry.

What is exactly is the issue. The point is to diversify the porn industry by increasing geographical options. You mentioned Quebec which already has a good building block. In the future you could have a site like pegas productions become a go to area for performers around North America. The point is Porn needs to become more regional and not indentured in Cali and Canada-US border regions make a lot of sense.

^The main reason why porn is mostly all shot in California is because it's one of the only two Sates where it's legal to shoot porn. That's not to say that porn isn't shot in many other States but you can get prosecuted if you shoot in those States. Shooting porn in Canada may or may not be illegal but there is a serious travel cost involved in getting US performers flown to Canada and that means that most studios would not want to do that.

^I'm aware of travel cost which is why I emphasize that the potential Canadian areas be satellite regions that border the US. A performer that grew up and lives around the Pacific North West or North East might find this a good option. It should be no more a travel issue then say Miami/Florida.

HOLLYWOOD, Calif. — Michael Weinstein, the president of the AIDS Healthcare Foundation and proponent of the proposed California Safer Sex in the Adult Film Industry Act, has revised the ballot measure's language that, in particular, punishes adult film producers with harsher civil fines for noncompliance of the mandatory condom drive and its regulations.
Adult filmmakers, according to the proposed ballot measure’s new language, could face fines of up to $70,000 for making falsehoods upon certification that condoms are used in productions. Recordkeeping violations would amount to fines from $1,000 to $7,000, with repeat offenders on the hook for up to $15,000 per violation.
Corporations or limited liability companies also would be faced with Cal/OSHA fines of up to $1.5 million when a violation to the measure results in death or permanent impairment to performers or even stage crew.

SAN DIEGO — Cal/OSHA's standards board plans to hold a public hearing in San Diego next month over a proposal to amend California's bloodborne pathogens statutes for condom use in adult film production.
At the public hearing to be held May 21, any person may present statements or arguments orally or in writing relevant to the proposed action that would significantly alter California Code of Regulations Title 8 § 5193, and mandate barrier protection, including condoms, to shield performers from contact with bloodborne pathogens, or other potentially infectious material during the production of films.

Xbiz streamed the Cal/OSHA hearing live on Periscope yesterday. This was the last chance for public comment before Cal/OSHA makes a decision on 5193.1 at some point in the future. The FSC introduced their own proposal which would make the PASS testing system the standard. The most interesting change is an offer to accept paid testing for performers.
Here's a list of the performers who made the effort to go to San Diego and speak up: James Deen, Chanel Preston, Ela Darling, Alex Chance, Layla Price, Veruca James, Mo Reese, Dave Cummings, Ariel X, April Flores, Conor Habib, Lotus Lane/Lain, Maitresse Madelyn, Marrugan the Mystic, Brock Doom and John Smith, all speaking against 5193.1. There were a couple more gay performers whose name I didn't catch.
Speaking in support of the new regulations were Cameron Bay, Rod Dailey, Derrick Burts, and Sofia Delgado.

You know, at the end of the day what has to happen is there needs to be a challenge to the dominant paradigm of how disease is viewed.
I happen to think that Bechamp was less wrong the Pasteur on the subject of disease and what causes them. It's because we opt for the latter paradigm that we have this notion of disease emanating from 'agents'. What porn needs is a health strategy more then anything to control things like free radicals and create a healthy body standard for performers to follow. That way disease rates will plummet.
AIDS is a pile rubbish. To by into the current view you have to believe that germs primarily cause disease(they don't) and you have to believe in the existence of an immune system(no such evidence exists). For HIV you have to entertain the existence of exogenous viral entities, again no such evidence exists. Until these paradigmatic assumptions are challenged, people like Weinstein will continue to have their day.

The FSC needs to start putting performers out there to talk about how this is being imposed on them against their wishes. Casey Calvert has written cogently against condoms in porn before, and I think Carter Cruise is another performer who would be a great spokesperson for the industry on this.

The issue last time is that AHF was out there campaigning and putting up billboards like 5-6 months before the election, while FSC and the rest of the industry didn't really do anything until about 2 months before the election, and even then it was a couple Youtube videos and some op-ed pieces in the local papers. And attempting to rally their fans, but their fans aren't who they need to be talking to because the vast majority of them don't live in California and won't be voting on this. They need to be getting on TV, getting on the radio, getting out there in the communities and talking to people, and not just hoping that talking about it on Twitter will be enough to sway the vote. And they need to start doing it early, like at the end of this year or the start of next year early. Beat AHF to the punch, and be the first word people hear about this.

They do indeed. They need to put a face to the issue. I guarantee that the average voter who doesn't know anything about the debate just thinks "oh they want to make things safer? Well who doesn't like safer? I'm in."
It becomes a lot different for them when they have someone dressed like a 'normal' person, standing in their kids' gymnasium on a Tuesday evening, saying "look I'm a woman who makes a living at this, and this is what's best for my body."
In many areas that can actually have traction.
But in just as many areas, it's a hard sell to get people to not just think "look at this evil porn star; I'm going to do whatever she doesn't want me to, simply because she is evil."

Yeah, you can't really go out to the middle of the state and necessarily expect to find an audience that's willing to listen, but if I were them I'd start simple with the huge cities where there's already performers and companies there that can do outreach (LA, San Fran, San Diego), and on college campuses, which tend to be more liberal and have more people willing to listen, and those students can take your message back to wherever they live and spread it that way.

UNIVERSAL CITY, Calif. — The AIDS Healthcare Foundation today filed seven additional workplace safety complaints against porn producers with both Cal/OSHA and the Los Angeles County Department of Public Health for filming in the county without condoms.
At least seven adult film productions by the studios were shot in Los Angeles between May 6-July 30 without condom use, nor with any film permits taken out, AHF spokesman Mark Cohen told XBIZ.
The new safety complaints include the following producers and productions:
James Deen, Productions: “Stockholm Syndrome,” filmed June 28.
Brazzers: “Fourth of July: Big Butt Independence,” filmed May 27.
Zero Tolerance Entertainment: “How to Train Your Teen’s Ass,” filmed May 11.
Burning Angel: “Ronda Arouse Me,” filmed July 30.
Evil Angel Productions: “His Ass is Mine #2: MILF Edition,” filmed May 6.
Jules Jordan Video: “Bra Busters 7,” filmed July 15.
Elegant Angel: “Busty Workout,” filmed June 27.
